CHANCES are that the Government of Tanzania will have to part with hundreds of billions of shillings in favour of the Standard Chartered Bank of Hong Hong (SCB-HK) following a judgment and demand note delivered by the International Centre for Settlement of Investment Disputes (ICSID), a world renowned tribunal based in the US capital of Washington, DC!
While the formal debtor in the case is the state power monopoly TanESCo (Tanzania Electric Supply Co. Ltd), the matter has all along been handled by top organs of the central government, namely the Ministry of Energy & Minerals, the Ministry of Finance, the Bank of Tanzania (BoT) and the Attorney-General's Chambers.
As it happens, all of these institutions were involved in one way or another in sanctioning the transfer of funds held in escrow at BoT the central bank and banker to the Government in respect of a highly controversial power purchase deal involving the now liquidated Independent Power Tanzania Ltd (IPTL).
The funds, amounting to US$122m (roughly Tsh201bn), were transfered to the account of another power firm, Pan-Africa Power Solutions (PAP), which purchased IPTL following the latter's liquidation!

MAHAKAMA Kuu ya Tanzania, imeiamuru Benki ya Standard Chartered ya Hong Kong (SCBHK) na Shirika la Usambazaji Umeme Tanzania (Tanesco) kuacha kuingilia utulivu, umiliki, usimamizi na utawala wa mitambo ya ufuaji umeme ya Harbinder Singh Sethi iliyopo Tegeta, na kusubiri uamuzi wa mwisho wa kesi ya msingi.
Kampuni ya Independent Power Tanzania Limited (IPTL) na Pan African Power Solutions Limited (PAP) zilifungua kesi kwa kuhoji uhalali wa maamuzi ya Kituo cha Kimataifa cha Kutatua Migogoro ya Uwekezaji (ICSID) dhidi ya Benki ya Standard Chartered ya Hong Kong (SCB-HK) na Martha Renju (anayedaiwa kuwa msimamizi wa mali zake), iliyotolewa katika kesi ya ICSD namba ARB / 10/20.
Katika hukumu hiyo iliyoandikwa na Jaji Dk. Fauz Twaib na kusomwa kwa niaba yake na Jaji Amri Msumi Hamisi, Jaji Twaib aliamuru Tanesco kutofanya biashara yoyote na SCB-HK au Martha Renju kwa niaba ya IPTL / PAP bila ya idhini ya kimaandishi kutoka IPTL / PAP.
Wadaiwa kwa pamoja wanazuiliwa kufanya utekelezaji wa maamuzi iliyotolewa katika chombo cha kimataifa ya ICSD yenye namba ARB / 10/20 na kusambazwa kwa wahusika Februari 12, 2014, kwa namna yoyote ile, na kusubiri uamuzi wa mwisho wa kesi yao ya mdai, ilisomeka sehemu ya hukumu hiyo.
Tanesco pia imezuiwa kutolipa kwa SCB-HK na Martha Renju malipo yoyote wanayostahili IPTL / PAP bila ya idhini ya maandishi kutoka kwa IPTL / PAP.
Mahakama pia imeizuia Tanesco kutotekeleza au kukubaliana na au kuyatekeleza maamuzi ya ICSID, na kusubiri uamuzi wa mwisho wa kesi yao ya msingi.
Pia mahakama hiyo ilitupilia mbali hoja ya mwanasheria wa SCB-HK, Charles Morrison, ambaye alisema Mahakama Kuu ya Tanzania haipaswi kusikiliza na kutoa maamuzi juu ya ombi hilo sababu Tanzania ni mwanachama wa ICSID ambayo pia inajulikana kama Washington Convention au ICSID .
Kwa mujibu wa Jaji Twaib, Wakili Morrison alionya kuwa kama Tanzania haitotii wajibu huo, itajiweka sehemu mbaya katika nyanja ya kimataifa.
