Haki ya kupata Elimu ni ya msingi kwa kila Mtu na inatambuliwa na Mikataba ya Kimataifa ya #HakiZaBinadamu. Haki hii inahakikisha kuwa kila mtu ana fursa sawa ya kupata elimu bila ubaguzi wa aina yoyote.

Haki ya kupata Elimu imefanywa kuwa haki ya kimsingi ili kuwezesha maendeleo ya mtu binafsi na kuchangia katika maendeleo ya Jamii na Taifa kwa ujumla. Elimu ni msingi muhimu katika kujenga Jamii yenye Usawa, Uhuru, na Maendeleo Endelevu.

Serikali na Jamii zina jukumu la kuhakikisha utekelezaji wa Haki ya kupata Elimu kwa wote kwa kuzingatia Tamko la Haki za Binadamu la Umoja wa Mataifa na Mkataba wa Kimataifa wa Haki za Kiuchumi, Kijamii na Kitamaduni.

'Unknown Assailants': A Threat to Human Rights. Tanzania Human Rights Report -2017

The main objective of the report is to highlight the situation of human rights in Tanzania for the year 2017, indicating human rights violations and efforts made to promote or safeguard human rights. The report also seeks remind duty bearers of their human rights protection obligations and make comparisons on human rights situation between the years 2016 and 2017. In 2017 the situation of human rights in Tanzania has deteriorated compared to last year, 2016. Civil and political rights in particular, suffered the most, with violations or restrictions of right to life, freedom of expression, freedom of assembly and right to liberty and personal security increasing. Rights of women and children continue to be jeopardized by incidents of violence against women (VAW) and violence against children (VAC), especially sexual violence, which was on the rise in 2017. On the other hand, government action helped to boost right to education, through increased access to education under the new education policy, although quality of such education remains a challenge as is learning and teaching environment. The Government also moved to safeguard the right to benefit from natural resources through sweeping reforms in the mining sector and changes on the mining laws.

Protection and Advancement of the Female Child's Right to Education in Mainland Tanzania: A Legal Perspective

The female child’s right to education is a complex right, therefore it is important to discuss and evaluate female child’s right to education in reference to both regional and international legal instruments and its effect on the female child’s right to education. A vast right and a notion vastly recognized by most nations across the globe “the right to education” has been emphasized to a large extent by the United Nations (UN) organization in the International Covenant on Economic, Social and Cultural Rights (ICESCR).Article 1 (2) of the Convention Against Discrimination in Education (CADE), United Nations Educational Scientific and Cultural Organization (UNESCO) 1960, prepared by the UNESCO, defines education as being, “all types and levels of education, and includes access to education, the standard and equality of education, and the conditions under which it is given.” This article examines relevant international, regional, and domestic Tanzanian laws providing for female child’s right education. It seeks to prompt discussion by identifying ambiguities where female child’s is inadequately protected and is exposed to exclusion and expulsion from schools. This article suggests that Mainland Tanzanian laws must be in alignment with regional and international laws for protecting and advancing the female child’s right to education as a basic right.

Constitutional Protection of the Right to Social Security in Tanzania, Kenya and South Africa.

This thesis looks at the constitutional protection of the right to social security in the United Republic of Tanzania, The Republic of Kenya and the Republic of South Africa. The right to social security is one of the social rights provided for under the International covenant on Economic, Social and Cultural Rights of 1976 and it deserves protection under national constitutions. 1996 South African constitution and the South African constitutional court, to a large extent managed to develop a well appreciated Jurisprudence on protection of economic and social rights including the right to social security. The 2010 Kenyan Constitution followed suit. In 2011, the United Republic of Tanzania started the constitutional review process. Aiming at promoting social justice and human rights observation, by making the new constitution "a people driven constitution", regrettably the process ended by producing a draft constitution (awaiting for a referendum to take place in April 2014-As to the time of writing this thesis. The referendum is however postponed by the National Electoral Commission till further notice) which does not recognize the right to social security and other economic and social rights as justiciable.

THE LEGAL STATUS OF REFUGEE PROTECTION AND STATE OBLIGATIONS IN UGANDA

Uganda is a host country to refugees from neighboring countries affected by conflicts and war. According to UNHCR, by the end of 2015, Uganda was the 8th and 3rd top refugee hosting country in the world and Africa respectively. It hosted around 512,968 refugees. Uganda was estimated to host around 810,000 refugees by the end of 2016. This raises the questions that as one of the top refugee hosting countries; are refugees legally protected in Uganda? What are the gaps existing in this legal framework? What legal obligations does Uganda have in refugee protection? This paper answers these questions by analyzing the existing refugee and human rights legal instruments to which Uganda is a signatory. The paper further makes reference to case law as evidence that states have obligations to protect refugees. In analyzing the legal framework, the existing gaps are identified. This paper argues that refugees in Uganda are protected by both refugee and human rights law. Refugee law protects refugees by virtue of their status as refugees who have crossed international borders and in need of international protection. Refugees are also protected by human rights law as individuals and human beings regardless of their status as refugees or aliens and wherever they have gone. Courts' jurisprudence has confirmed that states have obligations to protect refugees.
