African Union: Ban Ki-moon urges respect for gay rights

Ban Ki-moon said "confronting discrimination is a challenge"

United Nations Secretary General Ban Ki-moon has urged African leaders to respect gay rights.

Discrimination based on sexual orientation had been ignored or even sanctioned by many states for too long, Mr Ban told an African Union summit.

Homosexuality is illegal in many African countries - a situation which has drawn increasing criticism from activists and the West.

Mr Ban also said the Arab Spring proved leaders "must listen to their people".

The two-day summit, in the AU's new building in the Ethiopian capital Addis Ababa, is set to elect a new AU Commission chair.

South Africa has put forward long-serving minister Nkosozana Dlamini Zuma - the ex-wife of President Jacob Zuma - to challenge the incumbent, Jean Ping of Gabon, who has been in post since 2008.

If Ms Zuma wins Monday's vote, she will be the first woman to take the helm of the 54-nation bloc's executive council.

The AU has already chosen Benin President Thomas Boni Yayi to become AU chairman - replacing Equatorial Guinea President Teodoro Obiang Nguema in the one-year rotating post, the AFP news agency quotes officials as saying.

Chinese-built HQ Ban Ki-moon told delegates that discrimination based on sexual orientation or gender identity "prompted governments to treat people as second class citizens or even criminals".

The new Chinese-built AU headquarters is seen as a symbol of Beijing's new role in Africa.

"Confronting these discriminations is a challenge, but we must not give up on the ideas of the universal declaration (of human rights)," he said, quoted by AFP.

Homosexual acts are illegal in most African countries, including key Western allies such as Uganda, Nigeria, Kenya, Egypt and Botswana.
Both the US and UK have recently warned they would use foreign aid to push for homosexuality to be decriminalised on the socially conservative continent.

The Arab Spring, Mr Ban noted, was a "reminder that leaders must listen to their people".

"Events proved that repression is dead. Police power is no match to people power seeking dignity and justice," he said.

He also called on the leaders of Sudan and South Sudan to reach agreement on how to divide up their oil wealth. Some analysts warn the feud risks seeing a return to all-out conflict.

'Nuisance' Delegates are meeting in the new $200m (£127m) AU headquarters, funded and built by China, which was officially opened on Saturday.

The 100m tall building - which dominates the Addis skyline - is a "testimony" to the growing relationship between China and Africa, project co-ordinator Fantalum Michael said.

It is the first summit since the death of Libya's Colonel Gaddafi, who played a key role in the formation of the African Union.

Heads of states never admitted it, but his eccentric manner and constant grandstanding at summits would often hold up any meaningful talk for hours, the BBC's Will Ross reports from Addis Ababa.

"He was a nuisance," one senior politician told our correspondent.

As well as the growing tension between Sudan and South Sudan, the war in Somalia and the escalating violence in Nigeria are also expected to be discussed during the summit.

Kama kuna watanzania huko basi wasema "Honorouble Mr. Kimoon, we have high regard on you, but under no circumstance homosexuality will never be legalised in Tanzania".

Wakimtamkia hivi, binafsi niko tayari kushiriki maandamano ya kumpokea kiongozi yeyote aliyetoa kauli inayofanana na hii.

Lakini kama hawawezi basi hata waandishi wa habari wasijisumbue kuwauliza hili watakapokuwa wanateremka kwenye ndege, maana kila kitu tunasikia kutoka hukohuo Ethiopia.

Yes, African leaders must listen to their people, not Western hegemonists, the preponderant majority of African masses vehemently abhor wayward sexual behavior such as homosexuality.

"Police power is no match to people power seeking dignity and justice," he said.
There is not a single police case on record in my country where a homosexual was arrested and prosecuted, homosexuality in Africa is prohibited by tradition and values, not by police force. We reject Western hegemony seeking to impose wanton non-values on us.

Acheni kumpinga Ban Kimoon. Aliyosema Ban Kimoon yapo kwenye Tangazo la Haki Za Binadamu na Umoja wa mataifa ambalo Tanzania imetia saini kuliunga mkono na lipo kwenye katiba ya Tanzania toka mwaka 1984. Hivyo alichofanya ni kuwakumbusha kile kilichokubalika na Umoja wa Mataifa.

I beg to differ with you. Kila nchi Africa ina tafsiri kutokana na sheria za nchi yake. Hivyo acha generatization ya waAfrica kutafsiri kwa mtazamo mmoja. Soma article ya pili ya Tangazo la haki za binadamu na vifungu vya katiba ya Tanzania kuhusu kukubali haki hizo.

Article ya pili ya tangazo hili inasema:
  • Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

Azimio hii lilitungwa 1948 kabla Asha Migiro hajazaliwa. Mwaka 1984 serikali ya Tanzania ilifanya mabadiliko ya kikatiba na kutambua haki za binadamu. Soma kipengle hiki chini:
  • (9) Lengo la Katiba hii ni kuwezesha ujenzi wa Jamhuri ya Muungano na Serikali ya Mapinduzi ya Zanzibar au wa chochote kati ya vyombo vyake na udugu na amani kutokana na kufuata siasa ya Ujamaa na Kujitegemea, amabyo inasisitiza utekelezaji wa misingi ya kijamaa kwa kuzingatia mazingira yaliyomo katika Jamhuri ya Muungano. Kwa hiyo, Mamlaka ya Nchi na vyombo vyake vyote vinawajibika kuelekeza sera na shughuli zake zote katika lengo la kuhakikisha-

Ndio, wameanza na kila mtu lakini wamemalizia na nini? Huyo "kila mtu" ana haki na uhuru wa kufanya nini au kuwa nani? Wametaja haki na uhuru wa dini, itikadi, jinsia, lugha n.k. Hakuna haki ya kila mtu kufanya kila kitu, ndo maana, kwa mfano, ukifanya ngono hadharani kwa sheria za Tanzania utakamatwa na ukijisaidia barabarani kwa sheria za nchi yeyote ile utakamatwa! Haki zote zinapotolewa huanishwa. Ushoga haujatajwa katika Tangazo la Dunia la Haki za Binadamu.

Sasa, umegusia pia katiba ya Tanzania, tuje huko. Katiba inasema nini kuhusu hizi haki na uhuru wa watu?

Upo kaka?

Katiba yetu imejenga misingi inayoruhusu sheria za kulinda maadili ya jamii, ya utu wetu, utu wa Muafrika, tamaduni za Mtanzania, tamaduni inayopinga mapenzi ya kishoga baina ya wake kwa wake au waume kwa waume.
 
Ndio, wameanza na kila mtu lakini wamemalizia na nini? Huyo "kila mtu" ana haki na uhuru wa kufanya nini au kuwa nani? Wametaja haki na uhuru wa dini, itikadi, jinsia, lugha n.k. Hakuna haki ya kila mtu kufanya kila kitu, ndo maana, kwa mfano, ukifanya ngono hadharani kwa sheria za Tanzania utakamatwa na ukijisaidia barabarani kwa sheria za nchi yeyote ile utakamatwa! Haki zote zinapotolewa huanishwa. Ushoga haujatajwa katika Tangazo la Dunia la Haki za Binadamu.

Sasa, umegusia pia katiba ya Tanzania, tuje huko. Katiba inasema nini kuhusu hizi haki na uhuru wa watu?

Upo kaka?

Katiba yetu imejenga misingi inayoruhusu sheria za kulinda maadili ya jamii, ya utu wetu, utu wa Muafrika, tamaduni za Mtanzania, tamaduni inayopinga mapenzi ya kishoga baina ya wake kwa wake au waume kwa waume.

Bado unaboronga. Kuna nchi ambazo hazikutia saini ya Tangazo hilo. Mojawapo ni Saudi Arabia ambao wameona kuwa Tangazo hilo linatumia misingi ya kiMagharibi.

Kwa kuona kuwa mtanyimwa misaada, mlitia saini ya kukubali Tangazo hilo bila kujua tafsiri yake. Kwenye neno everyone maana yake ni mtu yoyote. Na kama hamtaki hizo definitions rudini kwenye drawing boards na mwandike upya katiba.

Maadili ya nchi sio sheria ya nchi. Hivyo mtu anaweza asifuate maadili ya kitanzania au kiafrika na bado akawa yumo ndani ya sheria za nchi. Vilevile maadili ya kiAfrika na Kitanzania ni imagination yako. Tanzania is a tribe society na maadili hayafanani nchi nzima.

Na kama unataka kung'ania maadili ya kiAfrika kuna jamii za kiAfrika zinazo-practise ushoga. Kuna makabila ya wafugaji kama vile wakurya, Nuer (Sudan), Ndebele (Zimbabwe) ambayo mwanamke anaruhusiwa kuoa mwanamke mwenzake.

Na kuhusiana na hiyo Ibara ya 30. Watanzania ndio maana mnaomba katiba mpya. Katiba siku zote is a supreme law of the land, na kunatakiwa zisiwepo sheria zozote zinazokiuka katiba au haki alizopewa mwananchi kikatiba.
