Court bars KTN, Citizen TV,
NTV from airing Anti GoTV /

The Kenya high court has barred local
broadcasters KTN, NTV and Citizen TV from
airing an informercial alleging that
Multichoice's Gotv and Star Times were
violating their copyright by carrying their
signal without permission. The court issued
the injunction on Monday stopping the
advert pending the hearing and
determination of the case filed by Gotv and
Startime. Speaking anonymously to
Trending Newsroom, the media houses, say
it was a great opportunity for them to go to
court and raise their legitimate concerns as
regards copyright infringement.
"Such violation is going to set a bad
precedence not only in Kenya but in Africa
if such copyright infringement is going to
be tolerated," said the source.
StarTimes and GOtv sued the four local
media stations for defamation.The two said
in separate statements had thereatened to
take NTV,KTN, Citizen and QTV to court for
defaming and maligning their brand.
This is after the four TV stations ran an
infomercial urging Kenyans not to buy
decoders from GOtv and StarTimes but
instead wait for other legit decoders
which will be in the market soon.
The stations state that they have not
authorised StarTimes and GOtv to run their
content and have therefore infringed on
the copyright of the stations.
StarTimes have however defended
themselves saying that they "air the
content of the above mentioned four
stations, amongst others, pursuant to a
'must carry' obligation imposed by
Regulation 14 (2) (b) of the Kenya
Information and Communications
(Broadcasting) Regulations 2009, whose
objective is to ensure that the public has
access to information."
They accused the four local stations of
misleading Kenyans.
