Ms Winnie Byanyima, the wife to Ugandan opposition leader Dr. Kizza Besigye was on Monday morning besieged in her car right outside their family gate at about 6:30 am and towed by a police truck to Kasangati police station, about 20 kilometers from the Uganda’s capital, Kampala.

The police believed the opposition leader was in the car.

Ms Byanyima however was with Dr. Besigye’s driver and two aides heading to Entebbe International Airport, to catch a 9:00am British Airways flight to New York, where she works as director for gender in the Bureau for Development Policy at the UNDP.

Ms Byanyima says she is outraged by the incident and will instruct her lawyers to take on the Police Chief Maj. Gen. Kale Kayihura and also demand a formal apology.

She said their family home is now under siege by the police and other security operatives. “I am absolutely furious at this incident, and it seems my husband is now a hostage… they (police) have besieged my home,” Ms Byanyima said in an interview with Daily Monitor, moments after she was released from the brief detention.
Ms Byanyima has now returned home and says she is making arrangement for the next available flight. Meanwhile, Dr. Besigye is held up at his home with heavy police presence at his gate.

Besigye said in an interview with this Newspaper that he has flu and would not be walking to work on Monday Morning. “My wife was travelling back to New York, I don’t know what is going on, but I intend to go to a clinic,” the opposition leader said.

It is not clear whether police will allow him to visit the clinic. The development comes after Uganda’s President Yoweri Kaguta Museveni was sworn in last Thursday for the Fourth term after winning the February 18 elections with 68 percent but the ceremony was overshadowed by the arrival of his arch rival and three time challenger Dr. Besigye who had been flown to Nairobi for medical treatment from injuries sustained during a violent arrest last month.

Dr Kizza Besigye was effectively put under house arrest after police surrounded his home and arrested his wife when she tried to drive out of the gate, his FDC party said yesterday.

Police officers intercepted Dr Besigye’s car outside his gate early in the morning and towed it to Kasangati Police Station – only to discover that it was his wife, Winnie, who was headed to the airport to catch a flight to New York, in the car.

Ms Byanyima was released without charge and returned home after missing her flight but said the opposition leader was not free to move out of his home.
She said the surrounding of their home by police officers was “a form of house arrest” and that Dr Besigye had been denied access to a doctor.

“Nobody has been in here to arrest him but since 6:15am when I tried to go out of the gate on the way to the airport, police have been stationed at our farm gate and are still there and I do not understand why they are here,” she said.

Daily Monitor journalists who visited Dr Besigye’s home in Kasangati, 20 kilometres out of the city centre, at 6pm yesterday saw several police patrol pick-up trucks and dozens of anti-riot police officers in the vicinity.

The police officers threatened journalists and barred them from taking photographs. “We consider Besigye under house arrest,” FDC official Anne Mugisha said, although the police gave different accounts.
Vincent Ssekatte, the deputy police spokesman said: “The police officers are on their normal foot patrol which they do in Kampala every day but he isn’t under house arrest.” He added that Dr Besigye’s car had been towed for violating “routine” traffic police directives.

However, when asked if Dr Besigye was free to leave his house, Mr Ssekatte’s superior, Ms Judith Nabakooba, said: “It would depend on the circumstances.”

She added: “We are trying to prevent lawlessness.” Human rights lawyer Ladislaus Rwakafuuzi told Daily Monitor that blocking a person at their residence without a court order is unlawful.

Dr Besigye has been arrested four times in the last month for participating in the Walk-to-Work protests against the rising cost of living and government wasteful expenditure.

His last arrest was particularly brutal and left him partially blinded, forcing him to seek medical attention in Nairobi. Large crowds turned out to receive him on his return last week and Dr Besigye said he would continue his protests but it appears that yesterday’s police actions could have been intended to stop him.

At least 10 people have been killed and hundreds injured in the protests.

PRESIDENT Yoweri Museveni has said opposition leader Col. Kizza Besigye has a hidden agenda, disguised as a walk-to-work demonstration over the high cost of commodities including fuel.

The opposition has conducted close to a month of the walk-to-work demonstrations that have often resulted in clashes with the Police leading to death and serious injuries. Several opposition leaders have also been arrested and charged in courts of law.

Museveni, in a statement yesterday, said Besigye’s walk-to-work demonstration is part of his treacherous hidden agenda to cause destruction and ignite riots using alcoholics or hired groups.

“I have been told of a man at Equatoria shopping mall who lost about $500,000 worth of goods. On the day, Besigye conducted his criminal circus on Entebbe Road, roadside fruit-sellers had covered their produce with tarpaulin,” he said.

“They were not selling in apprehension of looting. This will not continue. We are seeking everybody’s understanding as we end this criminality using the law,” Museveni added.

He said Besigye had tried to go to Makerere University because he wanted to link up with other rioters who had previously caused trouble by misinforming students that university fees had been raised when the matter had never been discussed.

Museveni said the Government had asked people to liase with the Police if they want to ‘walk’ so that their ‘walking’ does not interfere with the activities of other Ugandans. According to the President, those who said the walk-to-work demonstrations were harmless were wrong.

Museveni said the Police were right to block the demonstrations as they had saved people’s property from being looted and destroyed.

He added that the protests not only scare away tourists and investors, but force the business community to close shops. Besigye’s return from a medical trip in Nairobi, Kenya coincided with the swearing-in of President Museveni last Thursday.

Several of the foreign dignitaries who were here for the ceremony were reportedly inconvenienced.

President M7 is one of the Dictators of our time in Africa! What M7 is doing now in Uganda is barbaric,crazy,lunatic and cowardice system of ruling. He is opressing his opponents as if he'll never die one day!

Let me ask Mr. M7:Where are his predecessors like Dictator Idd Amin Dada and Milton Obote who tortured,butchered and killed thousands of Ugandans, where are they? They are dead and forgotten!

Surely M7 shall never rule Uganda for ever. He is now 66 years old. Old enough to retire and rest in his home village at Rwakitura, Kiruhuura district and continue eating Matoke peacefully!

M7 shall remember that we are living in a new era age where there is new wind of CHANGE blowing all over Africa, from North Africa,Central,West,East and South Africa. That Africans now do need changes irrespective of their colours,physical locations or religious issues. If M7 is smart enough let him stop these rubbish and focus on building a peaceful,democratic,economically stable and a freely Uganda.

Fighting Besigye and other opposition Leaders in Uganda won't help M7 rather than creating a more worse situation than before. He will be creating his own exit door from the Kampala State House!

Don't tell me M7 ordered Besigye to make the long walk back home


Kizza Besigye's first name means "darkness," and he was understandly alarmed when KQ, the airline that proclaims to be the Pride of Africa, appeared to nudge him to board only after darkness.

I'm not interested in the ping-pong game that grown men and women played on our Ugandan guest, especially when he came here for treatment, not visiting his grandmother.

Moreover, his eyes can't possibly see in the dark, not
after the jets of red pepper administered in generous doses to the eye a week ago.

Rather than take pity on the man whose arm is still in a sling, and eyes that can barely see beyond his nose, the airline is said to have played delaying tactics, and only relented when dusk approached.
I do not for one moment believe any of the stories being bandied about KQ; they are too proud of their reputation for that.

In fact, I'm more inclined to trust Besigye's story that the airline was radioed by M7, which is the official title of the Ugandan President, and told in that chuckling voice, chubby cheeks swollen like a puff adder: "That man has been fighting to be allowed to walk in city streets. Tell him he is free to walk back to Kampala."
Now, those who know M7 say he often means what he says, unless of course it relates to the terms he is going to serve in office.

Those who dare remind him to keep his word are often driven into exile (as Besigye was about to) or rushed into prison, as he barely escaped a fortnight ago.

That's what Big Men do, but M7 declines to be lampooned among the continent's buffoonery. He is too intelligent for that, particularly because he studied Economics when Dar es Salaam was Dar es Salaam, so he regularly organises elections to legitimise his long reign.

Both Besigye and M7 have known each other rather long, perhaps too long and closely, for the other's comfort.
You see, one was the personal physician for the other, from those days in the bush when they had a common enemy they wanted to oust.

They shared other interests. I hear there was a woman or two, maybe more. One married the other's mistress.
When M7 claimed, during a campaign rally many moons ago, that his old, field doctor had a terminal condition normally transmitted through sex, Besigye fired back that he had deflowered M7's wife.

That explains a lot of things, like the specific areas targeted by the M7 goons when they stopped Besigye from his morning walk the other day. They appeared intent on occasioning soft-tissue injury, the sort that leaves no mark that can be displayed in court.

It's transitional justice in the cityThe decision by the Judiciary to move most of its courts to Nairobi's Milimani area has been welcomed by many.

But commuters say some buses plying the Community and Central Business District route have changed their operations in a bid to compete for customers in the area.

So they pick commuters pretending that they would drop them at designated bus stops. But most commuters are left holding the short end of the stick, like those on a KBS bus, registration number KBA 931G on Monday.
The driver flatly declined to stop at any designated bus stop from Community to the Central Business District, in spite of commuters' requests.

The driver explained, rather sensibly, one should say, that he had to rush back to Community to pick more customers and meet the fares' quota demanded by the company management.
We appreciate kazi ni kazi (work is work), and times have been particularly hard for most Kenyans, what with rising oil prices and resultant fare hikes.

But what KBS should do, if it badly needs the money, is to scrape off the colours of respectability that the soft blue hues confer, and paint the buses like matatus that are a law unto themselves, and have no apologies to make for their brash manner.

Judicial insults and art of politenessThe Judicial Service Commission panel that has been interviewing candidates shortlisted for Chief Justice and Deputy Chief Justice positions have no doubt enjoyed their work.

Besides demystifying the judges, by literally removing those silly wigs most wear to court, they displayed their indecency in public by hurling brickbats at people who were in position to respond.

Sample this: "Some people say you have the mentality of a kindergarten teacher and lack the capacity to develop constitutional law..."

The interviewees would politely blabber about the criticism being unfounded and generalised when the proper response should have been: "That observation must have come from a kindergarten pupil..."
Another was accused of being disorganised, indecisive and regularly delayed rulings. She, too, carefully skirted around the issue without properly tacking the allegation, which only reinforced the perception of the candidate's alleged indecisiveness.

Ugandan police on Thursday blocked opposition leader Kizza Besigye from driving from his home in Kasangati to Kampala city centre, saying the outing would spark criminal acts after he vowed to resume protests.

Besigye's car was stopped by police around his home outside Kampala and forced to return.

"They told me that I am under preventive arrest but I have never heard of that law," Besigye told AFP after returning home, adding that he was testing if the police would allow him free movement.

"I believe that we can seek an injunction to get these people away," he said, referring to the security presence around his home.

Police spokeswoman Judith Nabakooba however denied that the opposition chief was under house arrest, but said he had been stopped as he had vowed Wednesday to press on with his protests against the rising cost of living.



"He is not under house arrest," Nabakooba told AFP. "He is free. We only wanted to show him that we knew what he was planning to do and that it would lead to acts of criminality."

Besigye begun "walk to work" protests last month against soaring commodity prices, sparking a heavy police repression in which at least nine people were killed and the opposition chief injured.

He faces charges arising from the series of demonstrations that President Yoweru Museveni had vowed to end.

Besigye detained under colonial law



Police yesterday invoked the Criminal Procedure Code, a colonial era and rarely applied law, to stop Dr Kizza Besigye from leaving his Kasangati home in Wakiso District.

The opposition politician, however, is not under ‘house arrest', the Force's spokesperson Judith Nabakooba, said in a statement.

Preventive arrest
She said Dr Besigye's declaration of resuming the walk-to-work demonstration against high fuel and commodity prices – after a two-week lull due to ill-health following his violent arrest by security forces on April 28 - without involving them constituted an "illegal act".

"In the execution of its constitutional mandate of prevention and detection of crime, and in exercise of the powers conferred upon the Police by Section 26 of the Criminal Procedure Code, the Police arrested Dr Kizza Besigye [on] the Nangabo-Kasangati Road," the statement read in part
That provision allows a police officer who becomes aware of a design to commit an offence to arrest, without a magistrate's orders or warrant, the person so designing, if the officer discerns that the commission of the offence cannot otherwise be prevented.

Dr Besigye yesterday said: "I am back here to consult my lawyers on this concept of preventive detention because I don't know [about] it. I think court will listen to me and restrain these oppressors from infringing on my rights."

"What they are doing is typical of [former presidents] Amin, Obote times. And I think this government is trying to bring back such obnoxious laws like President Museveni has repeatedly stated, and funny enough they have started applying one even before enacting it," he said.

There is a difference of legal opinion on the legality of the police action. Some lawyers contacted by this newspaper said while the police cited a right law to confine Besigye to his home, arresting him was illegal.

City attorney Caleb Alaka said it is "unconstitutional".
"The Code cited by police provides for procedures of how one does certain things. So, for somebody to commit a crime, the law under which the person is arrested must define that crime and the punishment it attracts," said Mr Alaka, adding that the Criminal Procedure Code Act is not one of the substantive penal laws in Uganda.
