Tangu Rais Magufuli aingie madarakani amepata au kukumbana na upinzani kwa maneno na vitendo. Aidha anashutumiwa na viongozi wa vyama vya siasa vya upinzani kuwa anawanyima uhuru wao wa kuendesha siasa.
Isitoshe Serikali yake inashtumiwa kwa kupanga na kutekeleza utekaji na mauaji ya raia wake.
Wazo langu la wiki hii ni Je, ni njia halali zinazotumiwa na viongozi wa vyama vya siasa, hasa upinzani, kufikisha malalamiko hayo, kwa wananchi, kupitia vyombo vya habari na mitandao ya kijamii, na wakati mwingine kwa maneno ya kejeli, dharau, na uchochezi dhidi ya Rais na Serikali?
Naamini wanaofanya vile wanajua au hawajui kuwa kuna sheria dhidi ya maneno na vitendo vyenye kuashiria uasi (Sedition) na uhaini (Treason). Nanukuu baadhi ya vifungu hivyo vya sheria:
1) CAP 16: The Penal Code - CHAPTER VII Treason and Other Offences Against the Republic, Treason Act 1.970 No.2 that reads:-39.—(2) Any person who, being under allegiance to the United Republic, in the United Republic or elsewhere, forms an intention to effect or to cause to be effected, or forms an intention to instigate, persuade, counsel or advise any person or group of persons to effect or to cause to be effected, any of the following acts, deeds or purposes, that is to say-r-(a) the death, maiming or wounding, of the imprisonment or restraint, of the President; or(b) the deposing by unlawful means of the President from his position as President or from the style, honour and name of Head of State and Commander-in-Chief of the Defence Forces of the United Republic; or(c) the overthrow by' unlawful means of the Government of the United Republic; or(d) the intimidation, of the Executive, the Legislature or the Judiciary of the United 'Republic,
and manifests such intention by publishing any writing or printing or by any overt act or deed whatsoever shall be guilty of treason and shall be liable on conviction to suffer death.
2) CHAPTER 229: The Newspaper Act, Seditious offences Act No. 10 of 1994 that reads:
32.-(1) Any person who–(a) does or attempts to do, or makes any preparation to do, or conspires, with any person to do, any act with a seditious intention;(b) utters any words with a seditious intention;(c) prints, publishes, sells, offers for sale, distributes or reproduces any seditious publication;(d) imports any seditious publication, unless he has no reason to believe that it is seditious
commits an offence and shall be liable upon conviction for the first offence to a fine not exceeding ten hundred thousand shillings or to imprisonment for a term not exceeding two years or to both; and for a subsequent offence to a fine not exceeding fifteen hundred thousand shillings or to imprisonment for a term not exceeding three years or to both; and such publication shall be forfeited to the Government.
