More than 50,000 Kenyan retirees and former employees of East Africa Community want the Government to pay them Sh70 billion in benefits.
The amount demanded by those who worked with the community between 1967 and 1977, includes interest for the last 23 years.
The workers also demand that the Government provides evidence that it has paid them as alleged by some officers from the Ministry of Finance.
Documents in our possession indicate that Crown Agency, on behalf of the UK Government, paid cheques worth Sh2.5 billion ($20,592,450 dollars) to former presidents Milton Obote (Uganda), Julius Nyerere (Tanzania) and Daniel arap Moi.
Kenya was to get 42 per cent of the amount, Tanzania 32 and Uganda 26.
Cheque lying at Central Bank of Kenya
The retirees claim that their East Africa Community "Workers of Kenya Cheque" paid by the UK Government, has been lying at the Central Bank of Kenya in the custody of Central Bank of Kenya Governor since 1984 awaiting payments and instructions from the Finance Minister or most probably a Presidential Decree.
They say payment of retirees who worked from 1978 should not be confused with their mediation payment.
The payment they are demanding is in conformity with Article 17 of the EAC mediation agreement of 1984 duly signed by the three East African Heads of States -Daniel Moi, the late Milton Obote and the late Julius Nyerere. Kibaki was then a Finance Minister.
Uganda and Tanzania have paid
They further claim that their colleagues in Uganda and Tanzania were paid through a presidential decree ordered and signed by Uganda's President Yoweri Museveni and Tanzania's Jakaya Kikwete in 2005 and 2006.
The payment and list of beneficiaries for their Tanzanian colleagues were published in Tanzania's newspapers - Tanzania Daima of Sunday October 23, 2005 and Nipashe of Sunday, December 3, 2006.
The notices are signed by the Permanent Secretary, Ministry of Finance, Tanzania, Gray S Mgoja and has a Government seal and letterhead.
Speaking in Mombasa on Sunday, more than 3,000 Kenyans representing 50,000 ex-workers countrywide narrated to The Standard their sufferings for the last 20 years.
Ignorant on rights
They said they believed that since most of them were not well educated and were poorly versed on their legal rights, the Government had taken advantage of their ignorance to deny them their dues.
The defunct EAC state corporations include EA Post and Telecommunication, EA Railways, EA Cargo Handling Services, EA harbours, EA Extelecommunications and EA Custom and Excise.
Among former employees affected are some current ministers in the Government like Heritage minister, Mr Suleiman Shakombo and Changamwe MP, Mr Seif Kajembe. Shakombo worked with Customs while Kajembe was with Cargo.
Secretary General of Ex East Africa Community Association, Mr Omar Kombo said their efforts to reach President Kibaki during his recent visits to Mombasa to table the documents, had been frustrated by the local Provincial administration.
He said the office of the AG had also frustrated their effort to register their organisation and pursue their payments as a team, since October 31, last year.
Kombo informed The Standard of the organisation's frequent trips to Nairobi.
"We were told to pick our certificates after two weeks in October. On November 16, we sent a reminder but were told to go back in January. On February 21, we went to Sheria House and followed the file for four days. We went to the deputy registrar who told us that organisation looked like a Trade Union.
The deputy registrar told us to hold on as they awaited information from National Security Intelligence services," says Khadija Mohamed, committee member and EEACWA co-ordinator.
Impeccable sources told The Standard that, Finance minister, Mr Amos Kimunya, had sent the deputy director for pensions to Arusha late last year for one month.
Sources said he was studying how others were paid and questioned those who had been paid.
The matter then died, until February 25, when EEACWA officials appeared in Mandhari ya Wiki on KTN to publicise their plight.
None of the officials from the ministry of Finance invited for the show, showed up.
