Habari ya mda huu wadau. Mm ni mfanyakazi katika kampuni moja hapa dar es salaam. Kampuni ninayofanya kazi inafungwa si kwa sababu imefilisika ila ni kutokana na garama za uendeshaji na kodi kua juu.

Kampuni imetoa notice ya mwezi mmoja. Yani tarehe 25/6/2019 walituita wafanyakazi wote wakatuambia kampuni itafungwa tarehe 31/7/2019.

Naomba msaada wa kisheria ni haki zipi nastahili kuzipata. Ukiangalia kua hatukupewa mikataba mipya tangu mkataba ulipoisha April 2018. Aina ya mkataba tuliokua tunapewa ni ya mwaka mmoja mmoja Then tumekuja kupewa mkataba mpya June 2019 ambao si wa mwaka mmoja bali wameandika mkataba unaanza April 2018 till lawfully termination.

Muajiri kafanya kitu tunaita termination by retrenchment or operation requirements ambayo inapatikana section 38 in employment and labour relation act 2004 kwa kwaida utaratibu wake upo hivi ambao nitahusisha na ulivyoandika na sheria inaongoza vipi

muajiri anatakiwa atoe notisi kwa kiasi cha wiki mbili haya nakuja kwako sasa "Kampuni imetoa notice ya mwezi mmoja. Yani tarehe 25/6/2019 walituita wafanyakazi wote wakatuambia kampuni itafungwa tarehe 31/7/2019." hapa muajiri yupo sahihi

muajiri anatkiwa kusema wazi sababu za kufanya termination by operation requirement nakuja kwako sasa " Kampuni ninayofanya kazi inafungwa si kwa sababu imefilisika ila ni kutokana na garama za uendeshaji na kodi kua juu" hapa muajiri pia yupo sahihi kwa mujibu wa sheria

Naomba msaada wa kisheria ni haki zipi nastahili kuzipata

Kiinua mgongo hii ni 50/50 japo sheria inasema operation requirment hamna kiinua mgongo kiinua mgongo kipo endapo muajiri ndo awe amesitisha mkatba na wewe ila kukiwa na mutual agreement anaweza akailipa na kama akilipa itakuwa hiv mshahara wako wa siku utazidishwa mara saba alafu watazidisha mara miaka uliyokaa kwenye iyo kamopuni
