Actress Kajala Masanja parted with 13m/- in fine as her husband Faraja Chambo was sentenced to 12 years imprisonment after being found guilty of money laundering case in a ruling made by the Kisutu Resident Magistrates Court in Dar es salaam yesterday.
Masanja had an option of either serving a seven-year jail sentence or pay a fine to the tune of 13m/-.
Her closest associate in film industry Wema Sepetu stepped in timely to dish out the collosol fine that relieved the actress as she escaped the jail sentence.
She was found guilty of conspiracy for transfer of a house ownership to Emiliana Rwegarura. Masanjas mother bursted into tears as her daughter s case came to and epic end yesterday.
However, all was not well for the actress as her husband Chambo who boarded the prison-destined bus to serve a 12-year sentence after failing to pay a heftyfine to the tune of 213m/-.
He was found guilty in three counts which he was charged with.
Resident Magistrate Sundi Fimbo read the verdict as Masanja bursted into tears throughout since the startof the judgment that began at 10:33 up at 11:49.
Sepetu came to the rescue of Masanja at 13:37. Magistrate Fimbo said the prosecution side through their six witnesses were able to prove without reasonable doubt that the accused committed the offence.
Magistrate Fimbo said Chambo was found guilty in the same counts as her wife and money laundering.
The Magistrate said Chambo was involved in the money laundering count as the court was ssatisfied that he received the money while while working at National Bank of Commerce (NBC).
There was a proof of people who sent him money to Chambo who eventuallly opened an account at Bank of Africa but later he denied the truth and sold the house using the said money.
On his mitigation the defense counsel Barnabas Lugua told the court to reduce the punishment to the accused.
He told the court that Masnja has been involved in the case as the wife of Chambo, so there was no need to punish her.
Before reading the verdict Magistrate Fimbo asked the prosecution side if they had anything to say according to the situation whereby prosecution led by Prevention and Combating of Corruption Bureau (PCCB) prosecutor Leonard Swai requested the court to give severe punishment as required by law so as to teach a lesson to others with similar habits.
He added that the accused Chambo has another case in the same court, and the offence which was found guilty is a serious one.
According to the charge sheet it was alleged that on unknown date and place the accused allegedly conspired, to commit an offence of transfer proceeds of corruption and money laundering.
Swai claimed to the court that in April 2010 the accused duo being husband and wife, respectively, conspired to commit an offence to transfer of the proceeds of corruption (selling a house situated at Kunduchi Salasala in Kinondoni Municipality) in contravention of the provisions of section 34 of PCCB Act 2007.
On the second count it was alleged that on April 14, 2010 the accused having been served with a notice under section 34(2), and 3 of the PCCB Act 2007 in contravention to the said notice, allegedly transferred the ownership of the said house to Emiliana Rwegarura.
It was further alleged that on the same date and place the accused transferred the ownership of the said house to Emiliana Rwegarura while they knew or ought to have known that the said house was the proceeds of corrupt practice for purposes of concealing its origin.
