Mkulo: Only President can end TICTS contract

Finance and Economic Affairs minister Mustafa MkuloSensitivity of the Tanzania International Container Terminal Services (TICTS) contract makes it difficult for any minister or ministry to just terminate it without involving the head of state, a House Committee heard yesterday.

Responding to questions after briefing the Parliamentary Finance and Economy Committee, Finance and Economic Affairs minister Mustafa Mkulo said he saw no way his office or any other ministry could terminate the contract.

Mkulo who took questions after briefing the committee members on the state of the economy for the current financial year and the 2009/10 - 2011/12 mid-term plan, appealed for MPs’ patience as the government worked to resolve the matter.

However, he said TICTS issues did not fall under his docket, but under the Infrastructure Development ministry. Mkulo explained that they work closely with Tanzania Revenue Authority (TRA) and not Tanzania Ports Authority (TPA). He said that after TPA has done its work, his ministry through TRA intervenes to collect revenues.

“You cannot blame us for TICTS poor performance…we are not handling containers at the Dar es Salaam port, our job is to collect revenues,” said the minister.

Last week members of the same committee queried why the government was yet to terminate the contract with TICTS, but got no clear response.

A specific question about TICTS contract was raised by Mvomero MP, Sadiki Murad, who had wanted to know why the delay and when the government will terminate the contract.

Mkulo promised members of the House committee that he would communicate with his Infrastructure Development counterpart Dr Shukuru Kawambwa before the commencement of next week’s long budget meeting so that they could together chart the way forward.

Minister Mkulo said the idea was for the two to forward recommendations about the TICTS contract to President Jakaya Kikwete before a final decision could be made.

The National Assembly last year formally endorsed the abrogation of the controversial 15-year extension of the 10-year contract given to the TICTS.

The extension is closely linked to a series of corruption scandal allegations facing a number of senior officials in immediate former president Benjamin Mkapa’s third-phase government, among them cabinet ministers.

The resolution by the legislature, endorsed in the April meeting last year, followed long hours of heated debate on a private motion tabled by Godfrey Zambi (Mbozi East - CCM) on the legality of the extension and the cargo handling firm’s efficiency.

The motion contained detailed information, including confidential signed letters, written pieces of evidence and various other documents, most centering on gross violations of procedures, regulations and the 2004 Public Procurement Act, in respect of the extension of the contract.

Official records show the former president, former Finance minister (under him) Basil Mramba, and his entire cabinet as having had a hand in making the extension possible.

In a September 6, 2005 letter (reference Number TYC/R/160/32) to the Tanzania Revenue Authority (TRA) commissioner general, Mramba states: “I would like to inform you that the President (Benjamin Mkapa) has directed the Ministry of Communication and Transport, specifically the Tanzania Ports Authority (TPA), to extend TICTS contract to 25 years.”

The letter said President Mkapa had also directed that the ministry allow TICTS to use Berth No. 8 at the Dar es Salaam port, the land in the neighbourhood, and the Ubungo Container Depot in the city to store containers, then lying at the hugely congested port.

According to Zambi the contract was corruptly extended after Mkapa had dissolved the cabinet.

Here's free advice to you;

If TICTS does not perform according to the contract, you don't need the @#$%&% president to terminate the contract. It is in the contract, BLACK and WHITE.

If RITES group does not perform according to the contract, you don't need the *&^%$#@ president to terminate the contract. It is in the contract, BLACK and WHITE.

And the list goes on -----!

This make me sick when I hear comments like this!
 

What then is the use for you to be Minister if you can't act except shift responsibility to the President to act on matters falling under your ministry? Mbona Magufuli hasubiri Rais amfanyie maamuzi?

Jamani basi someni mpaka mwisho kabla ya kumlaumu Mkulo. Hama sivyo Mkulo ataonekana anafanya vizuri kuliko nyinyi.

Kwanza Bandari hiko chini ya wizara ya mawasiliano na sio Fedha. Pili ni agizo la rais Mkapa lililotoa mamlaka ya hao jamaa kupata hiyo tenda.

Nchi haina utamaduni wa kuchagua viongozi kwa merit, viongozi wanachaguliwa kwa kujifaragua na kujipendekeza, ndiyo maana Kikwete kachaguliwa lakini ukiuliza alifanya nini cha maana kilicho m distinguish apate urais, hakuna!

Katika style hiyo hiyo Kikwete naye kaenda kuchagua mawaziri kulingana na alliances na uswahiba kuliko merit, ndiyo maana jitu zuzu kama Mkullo, ambalo halioni hata kwamba kwa kusema lilichosema linampakazia rais Kikwete, kwa kumuonyesha kama ndiye mtu pekee mwenye uwezo wa kumaliza mkataba huu lakini anasua sua, limenda kupewa wizara nyeti kama fedha, watu kama kina Sofia Simba wanapewa wizara so central, watu ambao wana a relatively convincing track record (Magufuli) na usomi unaokubalika angalau (Mwakyusa) wanaenda kupewa wizara za periphery huko za uvuvi na mazingira.

Katika system ambayo rais anaogopa kuwa overshadowed kuliko anavyotaka ku perform unategemea nini? Katika system ambayo merit na track record si kigezo cha kupata appointment unategemea nini? Katika nchi ambayo kujikomba, propaganda na kujifaragua kama mtu wa watu ndiko kumempeleka rais wa sasa hivi kuwa hapo alipo, unategemea nini?

Si ndio maana tuna wizara tofauti. Kama wizara ya mawasiliano inaona mkataba ni mswanu, kwanini waziri wa fedha aingilie?

Mkullo amevunja kanuni ya collective responsibility. Amemtupia mpira wa kuwajibika rais wakati wote wako katika serikali moja, kwa watu wenye kuchambua mambo hili pia linaweza kuchukuliwa kama insubordination.

Collective responsibility inataka serikali nzima kuongea kwa sauti moja, kama huwezi ku present a united front unaomba muda ku consult wenzako, kama hukubaliani na wenzako unajiuzulu.Hapa inaonekana kama Mkullo anataka kutoa picha kwamba angetaka kuuvunja mkataba lakini hana mamlaka, na mtu mwenye mamlaka ambaye ni rais, hajafanya hivyo kwa kutotaka au uzembe.In any case Mkullo na rais wanaonekana hawako pamoja kama inavyotakiwa katika "collective responsibility".

This is what I call "writing the obvious". Ningetegemea u comment kama utamaduni wa kuchagua watu kwa merit ungekuwa na mapungufu.
 
Nadhani watu bado hawajajua kuwa tanzania haina uongozi! Nadhani bado watu wana ndoto kuwa viongozi waliopo siku moja watabadilika. Nadhani watu hawajui kuwa system yetu ya uongozi bado ni mbovu!

Siku watu watakapotambua hivyo hata hizi kauli zinazotolewa na hawa tunaowaita viongozi hatutashangaa! Tutajua tatizo ni nini.

Labda niseme hivi hatuna viongozi wanaoweza kufanya maamuzi kwa manufaa ya taifa hili. Labda kitu kingine cha kujiuliza, je hawa watu wanaojiita viongozi wanajua kuwa Tanzania inatakiwa ielekee wapi kimaendeleo! Hilo nalo ni gumu sana! Kama wangelijua hizi kauli zisingetolewa na mtu anayeitwa Waziri!

Wakuu kazi kubwa ni kuhakikisha tunapata viongozi wanaojua cha kufanya otherwise hizi nyimbo zitaimbwa sana hapa!

It's not about who's the minister of what? The issue is the statement this guy made. If you are the minister or PS or President or MP it does not matter.

What matters is what's in the contract? If there is "MADUDU" in that contract, send the issue to AG (kesi ya nyani mpe ngedere!) so that he/she can weigh in legal issue according to the law.

These so called leaders do not want to go by the rule of law. They just want to run the country on the basis of FRIENDSHIP and CONNECTION.

It is a shame!
 
Neither Mkullo nor Kikwete is serious in economic issues. Kikwete alipokuwa bandarini alisema ana majina ya watumishi wa TRA ambao wanashirikiana na wafanyabiashara kuhujumu mapato ya taifa; mpaka leo hakuna kilichofanyika. Kama anayo majina basi na yeye anashirikiana nao and he is benefitting from their evil activities otherwise wwangekuwa wameshatimuliwa.

Mkullo alishawahi kutamka fedha za EPA sio mali ya Serikali; shame on him kwa sababu Serikali hiyo hiyo imeishia kujikanyaga kanyaga kuhusu suala la EPA bila kutoa maelezo yanayoeleweka. Leo anakuja na jingine kuwa JK ndiye anaweza kuvunja mkataba wa TICTS, hii sio bla bla iliyozoeleka kutoka kwao! Huyu ni kiongozi kweli ama mcheza Sangura?

Kikwete alipoingia madarakani alitamka wazi kuwa anayo majina ya wale wanaojishughulisha na biashara ya madawa ya kulevya; leo ni takribani miaka minne, nothing has happened, we can conclude kuwa naye ni mshirika kwenye biashara hiyo, if not why is he afraid of taking action on them.
 

Mkullo kwenye hili yupo right kabisa maana kama tunakumbuka hata mkataba wenyewe uliongezwa kabla hata mkataba wa zamani haujaisha na mbaya zaidi ulipata baraka zote kutoka kwa Baraza la Mawaziri la Utawala wa Awamu ya Tatu, kweli nchi yangu Tanzania imeozaaaaaaaaaaa
