Presidential candidates make lots of promises: to repeal unpopular laws, to overturn controversial Supreme Court rulings, to lower taxes, to eliminate debt. But what can a president actually accomplish?

There are stark limits to executive power. In fact, there's not very much a president can do without cooperation from Congress or the Supreme Court.

Here are a few common questions and misconceptions about what is – and isn't – within the president's power.

Can the president repeal a constitutional amendment, like the right to bear arms?

No. The president does not have the ability to repeal any amendment of the Constitution.

To repeal a constitutional amendment, another constitutional amendment has to be passed (like when the 21st Amendment was passed to repeal the 18th, which banned the manufacture and sale of alcohol). It's not a quick or easy process.

An amendment can be proposed by Congress (with a two-thirds vote from each chamber) and ratified by three-fourths of state legislatures, or it can be proposed by two-thirds of state legislatures calling on Congress to hold a constitutional convention and approved by ratifying conventions in each state.

The president can be a cheerleader for the cause, but doesn't get a vote.

Can the president repeal a law, like Obamacare?

No. The authority to do this lies with Congress, not the president.

Because the Patient Protection and Affordable Care Act, known more commonly as Obamacare, is a law, overturning it would have to be done by the passage of new law. Like any other law, legislation would have to introduced by a senator or a member of the House of Representatives and pass both chambers of Congress before the president gets to weigh in by signing or vetoing the bill. The president can clarify existing law by issuing an executive action, but executive action can not be used to create new laws.

Can the president start a war?

Yes and no. The president has the power to send troops into battle, but cannot formally declare war without authorization from Congress. The War Powers Act of 1973 gives the president a strict 90-day timeline to seek congressional approval – and the cash to pay for war – or the troops have to return home.

Can the president launch a nuclear strike?

Yes and no. The president alone has the authority to launch a nuclear strike, but except in certain situations – such as an imminent nuclear attack on the U.S. – the president must consult with top military brass first. Once the decision has been made, the order is authenticated using the nuclear code and the launch goes forward.

Can the president overturn a Supreme Court Decision like Roe v. Wade or Citizens United?

No. There are only two ways to overturn a Supreme Court decision: with a new Supreme Court decision, or by changing the law.

The court doesn't make laws, it interprets them and can rule on whether a law is being correctly applied. So in terms of Roe v. Wade, the seminal case that determined abortions are legal, and Citizens United, which defined political spending as protected speech, the court was measuring whether existing laws or regulations were constitutional. To overturn either case, a new constitutional amendment would be required or the court would need to take up a new case litigating the same issues.

Can the president decide which judges are on the Supreme Court?

Yes and no. The president can appoint justices to fill vacancies on the court, in the hopes those new justices would tip the balance of rulings on such issues like abortion or campaign finance. But those judges have to be confirmed by Congress in order to actually serve on the Supreme Court.

Can the president stop a company from moving its factory overseas?

No – at least, not directly.

The owner of a company is under no obligation to operate in the U.S. But the president (through regulations) and Congress (through the tax code) can try to pressure businesses to stay in the U.S. by hitting them where it hurts: their pocketbooks.
