Federal judge warns Trump campaign on voter intimidation in Ohio

Washington (CNN)A federal judge Friday warned Donald Trump's campaign and Republican operative Roger Stone against any "voter intimidation" activity in Ohio, the result of one of several cases brought by Democrats before Election Day.

The Ohio case was filed by lawyers for state Democratic parties against the Trump campaign and Republicans, seeking early restraining orders or limits to ballot security or voter questioning efforts.

Judge James Gwin of the US District Court for the Northern District of Ohio ruled after a hearing Friday morning, mostly siding with Democrats against Trump and Stone's group "Stop the Steal" and issuing a temporary restraining order.
The Trump campaign late Friday appealed the ruling to the 6th US Circuit Court of Appeals.
Among actions prohibited under Gwin's order: "Hindering or delaying a voter or prospective voter from reaching or leaving the polling place," participating in "unauthorized 'poll watching'" activities, including "challenging or questioning voters or prospective voters about their eligibility to vote, or training, organizing, or directing others to do the same" and "interrogating, admonishing, interfering with, or verbally harassing voters or prospective voters."

Campaigns and individuals are also barred from questioning voters "under the guise of the purported 'exit polling' or 'citizen journalist' operations organized and encouraged by Defendants Stone and Stop the Steal."
Gwin's order applies to Hillary Clinton's campaign as well.
The Trump campaign denies it is participating in any illegal activity.

"Intimidating voters is illegal, and the campaign does not remotely condone such conduct," Trump campaign lawyer Chad A. Readler of Jones Day wrote in a 15-page legal filing in Ohio earlier this week.
"This case is one of four coordinated attacks across the country that are clearly long-planned efforts to sow chaos in the Defendants' political efforts, while garnering maximum publicity for Plaintiff's unsubstantiated, inflammatory claims on the eve of the Presidential Election," Readler added.
Ohio Democratic Party Chairman David Pepper said the legal action is necessary to limit any questionable activity that prevents voters from casting their ballots.
"The concern has been if people were to act upon what Trump and what Roger Stone have been encouraging people to do that you'd have true intimidation and harassment that might scare voters off," Pepper said after the hearing. "I don't want voters to be at all worried about voting on Election Day."
"We think Democrats and Republicans have every right to hand out leaflets at polls and everything else but what we don't want is harassment or intimidation and the judge is obviously trying to balance that," Pepper added.
Gwin rejected a request for a restraining order against the state Republican Party.

North Carolina counties must restore voters to rolls, judge rules

(CNN)A federal judge in North Carolina granted a preliminary injunction to the NAACP on Friday, holding that residents whose voter registrations were canceled in recent months because of a so-called "individual challenge law" must have their registration restored.
The ruling could affect thousands of voters.




"The court concludes that the balance of the equities and public interest factors weigh decidedly in favor of protecting eligible voters who are being removed from the voter rolls," wrote Loretta Biggs of the US District Court for the Middle District of North Carolina.

Kim Westbrook Strach, the executive director of the North Carolina State Board of Elections, issued a statement Friday afternoon saying her office "is working quickly to establish the procedures necessary to comply with the court order between now and Election Day."
Civil Rights groups praised the ruling that comes in a the key swing state just four days before Election Day.


"The judge's order today ensures that voters improperly challenged in three North Carolina counties will be restored to the voter rolls before Election Day," said Allison Riggs, Senior Attorney for the Southern Coalition for Social Justice.
Lawyers for the civil rights group argued that boards of elections in Beaufort, Moore and Cumberland counties had canceled thousands of voter registrations after a small number of individuals challenged the registration of approximately 4,500 voters based "exclusively on mass mailings that were returned as undeliverable."

They argued the "en masse" cancellation was done in violation of the National Voter Registration Act that prohibits systemic voter removal programs within 90 days of a federal election and that it disproportionately targeted African-American voters.
"The court finds that a narrowly tailored injunction is warranted to ensure that eligible voters are not deprived of their right to participate in the upcoming election due to a flawed process engaged in by the State and County Boards," Biggs wrote.

One plaintiff, James Edward Arthur Sr., said that he had planned to vote but recently learned that his voter registration was canceled, "as a result of a third-party challenge brought under North Carolina's voter challenge statute." Grace Bell Hardison, a 100-year-old African-American woman living in Beaufort County is another plaintiff. In court papers the NAACP argued that she has voted in nearly every election for the last 12 years but recently learned that her registration was challenged based on an alleged change of residence -- even though she hasn't moved since 2011. Her nephew was "ultimately successful" in presenting evidence of her residence.
The NAACP alleged the purge was done after first-class mail to the voter at the address listed on the voter registration card was returned.

"In many cases, voters purged by defendants still reside at the address where they are registered to vote, or have moved within the county and remain eligible to vote there," NAACP lawyers argued. "Nonetheless, a single item of returned mail has resulted in their ultimate removal from the voter rolls."
The Justice Department had weighed in on the case, telling the judge in court briefs that if the allegations made by the plaintiffs were true "safeguards" were absent and federal law was violated.

Kimberly Westbrook Strach, executive director of the North Carolina State Board of Elections, says that the challenges at issue were not initiated with the counties, but by private individuals.
Under North Carolina law any voter in a county can challenge the eligibility of any other county voter up to 25 days before the election. The challenge can include a residency challenge.

Strach addressed the controversy in a letter sent last week to Dr. William J. Barber II, president of the North Carolina State Conference of the NAACP. "A challenge validly entered will trigger a preliminary hearing, written notice to the affected voter and a full hearing on the merits before the appointed members of the county board of elections."
She said that in all the cases "county officials indicate that their respective boards of elections held preliminary hearings, notified the challenged voters by mail, and held hearings on the merits."
In the letter Strach emphasized that while the federal law prohibits a state from "conducting systematic list maintenance within 90 days of a federal election," the challenges involved in the case come from private citizens and were resolved through a "statutory process that ensures notice and an opportunity to be heard before the appropriate body within the county."

In a statement after the lawsuit was filed she said, "the statutes at issue are decades old and are common across the country and widely regarded as compatible with the National Voter Registration Act. If the plaintiffs are right, then most states are wrong."
After the hearing, and even before the opinion was released, Strach issued a statement saying that, "As the independent agency that administers elections in North Carolina, we will comply with any court order."

The way this year's election has been nasty, waiting on these few days feels like watching a horror movie, while in suspense that something scary may pop up anytime before the end of the movie. Tuesday. 😀

Giuliani changes story on FBI - CNNPolitics.com

Washington (CNN)Former New York City Mayor Rudy Giuliani now denies that he was told by former FBI agents that the bureau was reviewing newly discovered emails potentially related to Hillary Clinton's use of a private server before the review was publicly revealed.

Giuliani, a top Donald Trump surrogate and adviser, told CNN's Wolf Blitzer on "The Situation Room" Friday that the FBI's announcement "came as a complete surprise, except to the extent that maybe it wasn't as much of a surprise."

"I got it all from former FBI agents. Tremendous anger within the FBI about the way, number one, Jim Comey's conclusion (to not recommend criminal charges in July) and, number two, the way they believed they were being obstructed by what they regard as a pretty corrupt Obama Justice Department," Giuliani said. "Cutting off a grand jury investigation, cutting off subpoenas."
Earlier Friday, Giuliani, a former federal prosecutor, said he had "heard about" a forthcoming FBI announcement before it became public.
"This has been boiling up in the FBI. I did nothing to get it out. I had no role in it. Did I hear about it? Darn right I heard about it," Giuliani said on "Fox and Friends." He continued, "I can't even repeat the language I heard from the former FBI agents."

Giuliani insisted to Blitzer that he did not receive a tip from someone currently in the FBI.
"In my case, it's real simple: I've talked to no FBI agent, I've talked to no Justice Department official. I have no idea about who's leaking information."
The former mayor added that everyone he does talk to in the FBI is a former agent.
Blitzer reminded Giuliani that in an October 28 interview on "The Lars Larson Show," the former mayor said he was in contact with former agents "and a few active agents, who obviously don't want to identify themselves."
"Well, the information I've been getting is from former FBI agents," Giuliani told Blitzer. "If I did say that, that was wrong."
Clinton campaign press secretary Brian Fallon suggested earlier Friday that an inspector general could have grounds to look into the possible leaking of information to Giuliani.
"This sure seems like adequate grounds for an Inspector General review," he tweeted.


Soon after Fallon's tweet, Reps. Elijah Cummings and John Conyers, Jr., the ranking members of the House Oversight and Judiciary committees, called on the Inspector General of the Justice Department to "conduct an immediate investigation to determine the source of multiple unauthorized—and often inaccurate—leaks from within the FBI to benefit the presidential campaign of Donald Trump."

Speaking to Blitzer Friday, Cummings said, "Giuliani made it clear, Wolf, that he was getting information from former FBI agents. Now, Mr. Giuliani knows better. He was a former federal prosecutor. You don't use the former prosecutors to launder information coming in from the FBI. That's basically what he said. That's not right."
Cummings said the continuous leaks from this investigation are a "threat to our democracy," noting, "normally when you ask the FBI whether there this is an investigation, 99.99% of the time, they say, 'No comment.'
Blitzer asked Cummings if he had confidence in Comey.
"Yes. I do. I believe the FBI director is an honorable man. But he made a mistake here," Cummings replied.
