Lets see how many from the list of shame were involved in the Valambhia case, which by the way is still continuing as a
special project of fewTZ officials and friends. In the Valambhia case, the court at one time had issued an arrest warrant for the gov. of the Bank, Mr.
Daudi Balali, for not obeying a court order. The Valambhia case continued like a "drug" addiction during the previous President,
Mr. Mkapa's regime, and still languishes in the court today during the current regime,
President Kikwete.
Even though the case itself has been final/conclusively determined by the Highest court of the land, the court of appeals in 2003.
The role of the former AG in the Valambhia case needs to be examined very closely. Besides, blocking and denying Mr. Valambhia his rightful, legal entitlement,
Mr. Chenge, in October 2003, after the Final/Conclusive judgement from the Court of Appeals, dragged Mr. Valambhia back into the courts on a matter already decided by the highest court of the land. He placed the case in front of someone who had already represented Mr. Valambhia's former business partner on the same case years ago.
Why? To continue a res judicata case of course. Why continue a case till the whole decretal amount is exhausted? And who got paid Mr. Valambhia's decretal amount? Not Mr. Valambhia for he died in complete financial destitution. Why continue to steal another person's rights? Why blatantly disregard the law? And of course, the lawyer representing the Bank of Tanzania, was none other than their attorney on retainer,
Mr. Mkono.
Who benefitted? & Who continues to benefit today from the open draft at the BoT on the Valambhia case?
A daylite robbery in progress and as in the words of one Senior BoT official,
"No one cares to stop it, because it is their cash generating machine."
Justice denied is Big Business for the few&mighty whose greedy hands, eyes, are clutching this matter close to their chests, (pockets).
One of the most important point to be noted here. First when Mr. Valambhia was shouting at the top of his lungs that his lawful, legal entitlement was being stolen, he used to refer to it as Daylite robbery, he was right. Like an unstoppable train, the daylite robbery still continues today in full force costing the TZ taxpayer continuing to cost the TZ taxpayer over $70M.
In 1991, when Mr. Valambhia's court order was sitting on the desk of every minister in TZ gvt., his money was being released through the back door to his partner. Also, keep in mind, the case was a civil case between two business partners, and when the TZ gvt. intervened (kind of playing the role of attorney to his business partner) the case gave birth to 14 other cases. Mr Valambhia and his lawyer, Mr. Maira emerged triumphant in all those cases.
Over 15 years the TZ media reported extensively on this case. Now today any article on this matter is suppressed. The last article on this issue was published in June 2009 by Richard Mgamba, titled "REVEALED: The most expensive case in Dar's history".
