Kama kweli tuna uzalendo wa kweli na nchi yetu, kama tunathamini kodi zetu na tuanhitaji serikali iwajibike kwetu na muda wote iwe sikivu na kufanya kazi kwa maslahi ya umma, basi hatuna budi kujitolea kuingia barabarani kadri itakavyokuwa imeelekezwa na waandalizi wa maandamano hayo.
Tusiishie kuandika maneno mengi kwenye mitandao tukiwa tumejificha nyuma ya computer lakini tunapohitajika kuonyesha yale tunayoyasema kwenye mitandao kwa vitendo, tunapoteana.
Bila shaka kipimo cha uzalendo wetu ndio hiki, tuonyeshe uzalendo wetu, tupinge wizi wa mchana na zaidi tushinikize wale wote waliotuingiza kwenye huu mkenge washughulikiwe kikamilifu.

"Failure to do so, we shall call for a countrywide demonstration to protest against the move to pay Dowans," said, Mr John Mnyika, the Ubungo Chadema legislator on Saturday at a press conference in Dar es Salaam. International Commercial Court had in November last year awarded Dowans Holdings SA (Costa Rica) and Dowans Tanzania Limited $65.8 million for wrongful termination of a power generation contract in 2008. Tanesco was asking the court to set aside the award or remit it to ICC for reconsideration for, among other reasons, being against public policy and disregarding its evidence at the hearing. "Tanzanians should not be involved in compensating Dowans, if the government wants to respect the court order to pay Dowans, then the accused should liquidate their properties to pay up, their names were mentioned on September 15, 2007, we have no problem mentioning their names again," said the MP. He added that the money that the government will pay Dowans, should be used to reduce the hardships of the cost of living. He argued that it should also be used to pay teachers who the government owes more than 29 billion/-, pay East African retirees, or better yet provide loans for 14,000 students who are unable to go to university because the government has failed to give them loans. He said that if the government will not respond after one month, they will convene a nationwide protest, and if the government intends to pay the debt quickly and within a month, they will still demonstrate. Last month, the High Court allowed Dowans Tanzania Limited to be awarded 94 billion/- by the International Commercial Court (ICC) after Tanzania National Electric Supply Company (Tanesco) lost a petition seeking to block the payment. Judge Emilian Mushi also ordered Tanesco to pay all petition costs incurred by Dowans in its defence and told the petitioners (Tanesco) they have a right to appeal. The public utility company alleged that public procurement rules were grossly flawed in 2006 when the government directed Tanesco to award the contract to Richmond Development Company (RDVECO), which later passed the contract to Dowans. Tanesco argued that the tribunal did not consider its evidence that Richmond lacked capacity to honour the contract. The government was yesterday issued a two days ultimatum to suspend payment of 94bn/- compensation to Dowans Holdings as instructed by international court. The ultimatum was given by a coalition of activists who have threatened to stage peaceful demonstrations on Friday if the government does not respond positively to their demand. Speaking on behalf of the activist's coalition in Dar es Salaam, Executive Director of Sikika, Irenei Kiwia said the demonstration would involve ordinary citizens as part of honouring Father of the Nation, Mwalimu Julius Nyerere who was against misuse of public funds and resources. Kiwia called on Tanzanians to come out in big numbers for the demonstrations, clad in black attires and national flag scurf to symbolize patriotism and mourn the late Nyerere who died on October 14 twelve years ago. "It is our constitutional right, so lets us use it to ensure that Dowans is not going to receive any money from the government. We are entitled to protect the country's resources," he added. He said if Tanzania is forced to pay Dowans by international laws then such payments should be made through selling properties of people who led the country enter into the mess. "As taxpayers, we want the government not to pay Dowans using our money…however disciplinary measures should be taken aginst­ people behind the signing of such controversial contract", he noted. He said the government was responsible of issuing a statement to explain the reasons that made it ignore the legal advices give by Hunton & Williams LLP to breach the contract with Richmond Development Company since it was proved that the company was incapable of generating power. He named the activists organizations that have united against Dowans payments as Agenda 2000, Hakielimu, Tanzania Media Women Association (TAMWA), Tanzania Gender Networking Programme (TGNP), Human for Development Trust (HDT), Legal and Human Rights Center (LHRC) and Sikika. Meanwhile, Tanzania Media Women Association (TAMWA) Executive Director Ananilea Nkya said that it wasn't fair for the government to pay Dowans while teachers and ex EAC employees were struggling to get their payment arrears for years. "If Dowans will be paid, then teachers and ex-EAC workers should get their payments too", she said. For his part, Albanie Marcossy, LHRC Programme Officer and Parliament Watch said they had decided to take the matter to the people after the High Court had finally ruled that Dowans should be paid. Last month the High Court registered the hotly contested 94bn/- award settlement applied by Dowans Holding SA and Dowans Tanzania Ltd against Tanesco, bringing to the fore the issue of who pays the money. The High Court threw out an objection filed by Tanesco against registration of the award. It also ordered Tanesco to pay the cost of running the case incurred by Dowans. Judge Emilian Mushi said the court reached the decision on the basis of terms of the contract agreed by the interested parties (Tanesco and Dowans Holding SA and Dowans Ltd). According to the Judge, the parties had agreed that any dispute would be settled by the International Chamber of Commerce (ICC) for arbitration, and that the loser should not appeal to any other organ whereas the winner would be awarded immediately. Tanesco had in 2007 entered into a contract with Richmond Company for emergency power generation contract, which Richmond passed over to Dowans. Dowans was required to produce 100MW, but the deal turned sour and was terminated. The Legal and Human Rights Centre (LHRC) petitioned against registration of the award by High Court, but this was struck out by the court. Apart from the LHRC, other petitioners who attempted to block the award are Kahoho, Lawyers Environment Action Team (LEAT), and SIKIKA Company Limited. Meanwhile, Tanesco is today expected to file an application for leave of appeal against the ruling of the High Court in the Dowans saga. Speaking with the Guardian yesterday Tanesco Advocate Hawa Sinare said that she failed to file the application yesterday because they had not completed preparing the required affidavit. In its submission to the High Court, Tanesco had complained that the International Chamber of Commerce (ICC) arbitration was unfairly conducted, as the tribunal failed to consider part of evidence they had submitted. Tanesco had also complained that there were misconducts on the part of ICC tribunal in the arbitration, with a lot of legal facts missing, asking the High Court to dismiss the ICC ruling or set it aside. Tanesco argued that awarding 94bn/- to Dowans Ltd would go against public interest. However, Dowans's lawyer, Kennedy Fungamtama submitted that any attempt by the government to block the award would frustrate other would-be investors to come and invest in Tanzania.
