On 15 October 2005, former Presidential Escort Commander Charles Kimurgor was driving a dark green sport utility vehicle (SUV) through Tassia Estate in Nairobi when he was ambushed by armed carjackers.

The attackers opened fire on the vehicle, fatally wounding him before fleeing the scene.

Although police recovered his pistol, which was still loaded with 11 rounds of ammunition, nothing was stolen from him, raising questions about the motive behind the attack. His killing triggered one of the largest police operations in Nairobi at the time.

Kimurgor was a retired police officer and former commander of President Daniel Araap Moi's Presidential Security Escort Unit.

An Israeli-trained commando, he was widely respected for his tactical expertise and is best remembered for leading the successful 17-hour operation that ended the hijacking of a Saudi airliner at Jomo Kenyatta International Airport in March 1994.

Following his death, former President Moi described the incident as a great tragedy and condemned the violent circumstances in which his former security chief had been killed.

Son of deceased security chief evicted by mother​

The son of former Presidential Escort Commandant Charles Kimurgor has been forced to live in a makeshift tent by the road after his mother evicted him from the family house.

This is after police officers led by Kapsoya Police Post OCS Albert Kipchumba raided the home on Friday morning and threw Ibrahim Hussein Kimurgor's belongings out of his house, citing a directive by the High Court that had issued an eviction order.

Ibrahim and his mother Hellen Cherono have been embroiled in a long battle of succession regarding the family property valued at over Sh50 million since Mr Kimurgor's death in 2005.


"I was in the UK for eight years and shortly after returning, my father passed on. That was when they began selling the family property impulsively, which I opposed," said Ibrahim, leaning on a fridge that had been removed from his house along the Eldoret-Elgeyo border road.

In a sworn affidavit seen by The Standard, Mrs Cherono filed an application in the High Court in 2006, seeking to have Ibrahim prohibited from taking possession of or having control over, or meddling in the estate of her deceased husband.

However, the legal document showed the prayers by the petitioner (Cherono) excluded the prohibition of Ibrahim from the family homestead and even access and usage of machinery on Parcel No. Uasin Gishu/Illula/3.

Cherono also sought to have Ibrahim barred from developing the property and visiting her homestead as long as she was alive, unless accompanied by an older family member.

Final orders

When the matter was presented to court on December 4, 2013, it was directed by Justice William Musyoka that the respondent be restricted from visiting the applicant's homestead until the matter was heard and determined. On December 18, 2013, final orders on visiting the petitioner's matrimonial home were issued.

In a different application, Cherono sought an eviction order to kick her son out of her matrimonial home in an affidavit sworn on September 1, 2014. According to documents, the application was presented in the High Court on October 3, 2014, and the court granted the orders of eviction on December 18, 2014.

The court further directed Ibrahim's eviction by auctioneers, giving Kapsoya Police Post or OCS to provide security or help effect the order.

However, Ibrahim said the legal documents issued to him were fabricated by his mother because they never attended any court session. He added the documents had numerous irregularities and accused his mother of colluding with bailiffs and the police to chase him from their home.

"I went to court to clarify the first orders prohibiting my access to the homestead and was told they were non-existent. That is why she came up with the second application, which has clear irregularities," said Ibrahim.

The court orders seen by The Standard raised queries over their validity. For instance, one ruled on December 18, 2014, and used to evict Ibrahim, had no official court stamp or seal.

Efforts to reach Cherono for comment were fruitlless as security personnel at the gate of her homestead barred access, saying she did not want to speak to the Press

The son of former presidential escort commandant Charles Kimurgor has been forced to live in a makeshift tent along Eldoret-Elgeyo -border road after his mother reportedly evicted him from the family house.

Reports indicate that police raided the home of Ibrahim Hussein Kimurgor and threw his belongings out, citing an eviction order by the high court.

Hellen Cherono and his son are said to be embroiled in a long battle of succession of the family’s property valued at over 50 million shillings since the death of Kimurgor in 2005

Anti-riot police on Friday night dispersed boda boda operators in Eldoret who were protesting the murder of their chairman in the town.

The body of Ibrahim Murgor was found in a maize farm near Illula Primary School, a few yards from his home.


Murgor is the son of former presidential escort Charles Kimurgor who served during late President Daniel Moi's regime.


He was a well-known rights crusader in the town.

The body was found with deep cuts all over with the eyes gouged out. His motorcycle was found near the body and nothing was stolen from him.

The boda boda operators took the body and refused to allow police to take it to the morgue.

But anti-riot police fired in the air and used tear gas to disperse the hundreds of riders.

All businesses were shut down during the scuffle.

The riders were forced to flee, leaving the body to be taken to the Moi Teaching and Referral Hospital.

"We want to know who killed our leader and why. They have killed him brutally and we now fear for our lives," the riders' spokesman Paul Korir said.


Korir said it seems the killers just wanted to kill their leader because nothing was stolen from him

Uasin Gishu county commander Abdirizack Jaldesa said they are investigating the incident.

"We, however, ask the operators to remain calm and avoid incidents of lawlessness as we investigate the incident," Jaldesa said.

RULING


  1. The application dated 29th November 2013 seeks conservatory orders against Ibrahim Hussein Kimurgor. It also seeks orders that all pending applications in the matter be lumped together and be heard on a day- to-day basis. Alternatively, that the court do appoint any of the beneficiaries co-administrators with the petitioner herein.
  2. The application is founded on the grounds set out on the face of the application as well as the facts deposed in the affidavit of the applicant Helen Cherono Kimurgor. Essentially, the respondent, the said Ibrahim Hussein Kimurgor, is the biological son of the applicant and a step son of the deceased. He lives abroad. At the time of the filing of the application, he had just come back to the country. He is accused of engaging in acts of destruction at the applicants’ homestead where he has taken up residence. He is said to be in bad terms with the applicant as well as his siblings. He said misconduct is well documented in the affidavit in support of the application.
  3. The matter was placed before me on 9th December 2013, under a certificate of urgency dated 4th December 2013. I directed the applicant to all the parties affected and come back for hearing on 10th December 2013 at 2.30P.M. On 10th December 2013, Mr. Nyamunga appeared for the applicant, Mr. Munyola held brief for Miss. Yano for the respondent, while Mr. Katwa Kigeni appeared for the other children of the deceased. The parties addressed me on the matter. No papers were filed in reply to the application. I reserved my ruling.
  4. Mr. Katwa supported the application. He proposed the applicant, but as she so signed, he suggested that she should be assessed by others. He took the view that the respondent was not suitable given that he was suspicious of the applicant and his sisters. Mr. Nyamunga was of similar opinion. He suggested that the applicant should be assisted by one biological daughter of the deceased and one daughter of the deceased. Mr. Munyoka took the view that the applicant should be appointed administration but the sisters of the respondent.
  5. The applicant and the respondent both personally addressed the court. She explained her problem with the respondent, and indicated that he was not a person that she could work and live with. The respondent on the other hand accused the applicant and his sisters of conspiring against him.
  6. There is clear consensus that an administrator be appointed to take charge of the estate of the deceased. There is unanimity about the appointment of the applicant, Hellen Cherono Kimurgor. It is suggested by the majority that she should be assisted, given her age, by other persons. No serious objections have been raised to these proposals.
  7. I have taken note of the bad blood between the applicant and the respondent, as well as that been the respondent and his sisters. I have also noted that that the respondent is resident abroad. The estate of the deceased comprises of assets in Kenya. It would be prudent to have a resident administrator.
  8. Taking everything into account, I hereby appoint Hellen Cherono Kimurgor, Caroline Chebet Murgor and Matilda Chemeli Kimurgor administrators of the estate of Charles Chemimoi Kimurgor. A grant of letters of administration intestate shall issue to them accordingly. In the meantime, the orders made on 10th December 2013 barring the respondent, Ibrahim Hussein Murgor, from the matrimonial home of the applicant, Hellen Cherono Murgor, shall remain in force until further orders by this court.
