Nni Tofauti ya maneno haya? Contractor ama Constructor?

Samahani wanaJF, mimi huwa natatizwa na neno Contractor! Ninavyoelewa mimi ni kwamba, Contractor ni mtu aliyeingia mkataba(contract) na mtu mwingine ama taasisi ama kampuni kufanya kazi fulani! Sasa je na mjenzi wa mradi wa nyumba ama barabara kwa kimombo tunaambiwa ana-construct (anajenga), na kazi aifanyao ni construction, Sasa swali langu ni kwamba kwa nini basi huyu tusimwite Constructor badala ya Contractor kama ambavyo tumezoea wengi kuwaita? Isn't it grammatically right?
 
Contrator ni mtekeleza mkataba (contract executor).....
Imezoeleka zaidi kutumika kwenye ujenzi
contractor is a person who undertakes a contract to provide materials or (nadhani hapa sahihi ni and/or) labour for a job.

Constructor inatokana neno construct.....ni mjenzi! Sio lazima awe anatekeleza mkataba!
 
Shughuli za ujenzi zimegawanyika katika sehemu kuu mbili ( pre and post contract) ie kabla na baada ya mkandarasi kusaini mkataba. Huwezi kujenga bila kuwa na mkataba, kubwa anachofanya kwenye ujenzi ni kutekeleza aliyoya sign kwenye mkataba! Ie mkataba ndio unaomungoza!

Ndugu yangu Mfamaji kweli umekufa maji! Nafikiri hukuelewa msiongi wa hoja yangu! Dictionary ama thesaurus inaelezea vizuri maneno hayo! Hoja yangu kubwa ni kwa nini neno Contractor linatumika zaidi kwa mjenzi na si Constructor? Kwa nini Suppliers wa cartridges ama maji ya kunywa maofisini kama kisima water tusiwaite nao ma-contractors? Nimepitia Dictionary na thesaurus ndio maana nikaibuka na hoja hii! Isijekuwa tumezama kwenye mazoea tukafikiri ndo lugha sahihi!

If so, the person who undertakes a contract is called a contractor? Does is it mean the definition is so specific to some type of contracts? What if I enters into a contract to supply stationaries? Am I a contractor or a Supplier! For this case, a word "Contractor" is a general term, lakini swali langu ni kwa nini linatumika zaidi kwa wajenzi? Je, ni kweli kwamba kuna mmoja laifanya makosa badala ya kutamka Constructor akatamka contractor then tukaendelea nayo kama mzungu mmoja alivyoshindwa kutamka Nyanza akasema Mwanza na sisi tuka-copy na ku-paste? Contractor ana wajibu mpana katika mradi kuliko Constructor. Kwa mfn: Mradi wa barabara unahusisha makundi mbali mbali ya fani mpk ukamilike. Wamo ma-constructors, surveyors, evaluators, suppliers n.k. Kazi ya hapa ni kuwasimamia hawa wote ktk kuhakikisha mradi unasonga mbele, lkn kazi ya Constructor ni just kujenga portions atakazopangiwa kwa mujibu wa Contractor's Project Plan. Kwa hiyo Contractor ni yule mzabuni na vilevile Contractor zingatia kuwa anaweza kuweka ma-Sub Contractors ikiwa mradi ni mkubwa wenye majukumu mengi. In this case kutakuwa kuna Main Contractor ambaye ndiye atasimamia mradi wote na Sub Contractors watasimamia portions zao za mradi mradi kwa mujibu wa makubaliano.
 

Mkuu hizo definition zipo nyingi uki-google! Swali langu ni kwamba, why mostly using contractor instead of constructor! I did not ask for their definitions?

As long as nimeingia mkataba mi ndo Contractor, and so a constructor for that case! It is my company XYZ Construction Company Ltd that constructs, so am the Constructor though I may not show up at the site, only my team is executing the project!
 
Waliotangulia wametupa maukweli kwa maana tofauti hapa ni kwamba kisheria kuna mtu anatakiwa kusaini mkataba ili akabidhiwe kazi,huyu ndo contractor na si lazima contractor asimame mwenyewe site bali anaweza kuhire mtu mwingine atayemtaka ili aifanye ile kazi chini ya maelekezo ya contractor,sasa huyu mteule ndo kwa maana hyo atajenga mradi huo inamaana yeye ndo mjenzi ama constructor lakini mwenye nguvu kisheria madhani ni yule aliyesaini mkataba hata kama atahire mtu wake na ndivyo inavyokuwa mara nyingi

Sio kosa kusema ama kutumia neno Contractor, as such ni sahihi zaidi ya kutumia neno Constructor....

Mkandarasi (Contractor) ni Mjenzi (Constructor) anayetekeleza mkataba fulani.....hapa tunaongelea muktadha wa mkataba wa ujenzi.
Katika hatua za awali (pre contract), wajenzi (constructors) wanapoomba kazi huitwa wazabuni (tenderers/bidders)!

Neno Contractor limetawaliwa zaidi ya watekelezaji ujenzi kwa sababu utekelezaji wa miradi ya ujenzi huchukua sehemu kubwa sana ya mikataba mingi.....

Imekua ni mazoea, na mazoea ni kama sheria....

Hata CRB (kwa Tanzania) inaamaanisha Contractors Registration Board na sio Constructors Registration Board!
 

Safi sana, umenikumbusha - career call for kariakoo, caw way for kawe, many mangos for manerumango, musa hassan for msasani, zangueba for zanzibar, etc,etc.
