Maromboso primary court Arusha have thrown out a suit filed by one Hilda Kleruu,who oppesed the previous magistrate ruling over the right excuter of the will left behind by Miss Betty Luzuka ,a veteran journalist.
Ms Kleruu who was looking after the estate and the property of the late Ms Luzuka since August 2013,has been accused by deccased"s brother ,Mr Sarongo Luzuka,of misusing money from the bank accountsof his late sister and is accused of trying to sell off some of the decceased" properties.
Issuing the judgement over the court case number 222 of 2013 filed there by Ms,Kleruu has proven to be irresponsible in handling Ms Luzuka"s estate by withdrawing money from the decceased"s accounts unlawfully,the plaintiff is no longer qualified to manage the deceassed"s property.
The latest ruling complemented an initial court decision by Magistrate Prince Gideon filed earlier by Mr Sarongo Luzuka, contesting his sister"s will of having Mrs Kleruu manage the deceased"s property after his family realised that she is disloyal,Mr Luzuka won the case ,but Ms Kleruu immediately contested the ruling and as it has turned out ,she lost for the second time.
The late Ms Luzuka ,worked with the first East African Community(EAC) in Arusha before it folded up in 1978 ,then moved on to work as Media and communication officer at the Arusha International Confrence Centre (AICC) an eventually served with the African court for the people and Human Rights, before she passed away while undergoing treatment at Shree hindu Mandal Hospital in Arusha.
Unmarried and without children, Ms Luzuka left her properties including houses ,estates and bank accounts under supervision of Ms Kleruu but later on ,relatives of the deceased accused Hilda of misusing the deceased"s properties.
