US fines Microsoft $20 million for violating child data regulations

Microsoft has agreed to pay a $20 million fine following allegations by the Federal Trade Commission (FTC) that it collected personal information from children without obtaining parental consent.

The FTC claimed that between 2015 and 2020, Microsoft gathered data from children under the age of 13 who signed up for its Xbox gaming system without their parents' authorization, and retained this information. In order to create an account, users were required to provide their first and last names, email addresses, and dates of birth.

The FTC accused Microsoft of breaching the Children's Online Privacy Protection Act (COPPA). Samuel Levine, the head of the FTC's Bureau of Consumer Protection, stated that the proposed settlement would facilitate parental control over their children's privacy on Xbox and restrict the type of information Microsoft can collect and retain regarding kids.

Levine emphasized that COPPA applies to children's avatars, biometric data, and health information as well. The court's approval is still necessary before the decision can be enforced.

According to the terms of the settlement, Microsoft will be obligated to implement several measures aimed at enhancing privacy protections for child users of its Xbox system.

As per COPPA, online services and websites targeting children under the age of 13 must inform parents about the personal information they gather and acquire verifiable parental consent before collecting and using any personal data from children. At the time of reporting, Microsoft had not responded to a request for comment from AFP
