Nitangulie kusema kuwa,sina shida na hatua zinazochukuliwa na Serikali dhidi ya wale Wanaohodhi Ardhi kubwa bila kuiendeleza kwa Makusudi yaliyowekwa. Ni vema watu wakaacha ujanjaujanja wa kujilimbikizia Ardhi!

Nimeona kwenye taarifa ya Habari usiku huu Waziri Mkuu akiwa mkoani Kagera Akifuta Hati za Mashamba kadhaa. Sina shida na kufutiwa umiliki wa mashamba hayo kwa waliokuwa wanayahodhi bila kuendeleza.

Napata Ukakasi juu ya NANI HASWA MWENYE MAMLAKA YA KU REVOKE OWNERSHIP/KUFUTA UMILIKI/HATI ZA ARDHI?

Waziri Mkuu ana Mamlaka gani Kisheria kufuta Hati za Ardhi? Je, haingilii Mamlaka ya Boss wake? Kwa mujibu wa Sheria za Ardhi pamoja na Katiba ya nchi?

Anayefuta ni Rais, ila anachofanya Waziri mkuu (au hata waziri wa ardhi - juzi pia Lukuvi kafuta Hati za mashamba huko Manyara na kuamuru wapewe wananchi) ni kupendekeza kwa Rais kwamba Hati husika ifutwe au kama muda umeishia isiwe renewed na rais akiridhia basi yeye anatamka tuu.
 
Kimsingi hata hizo hati zilizofutwa ni kwamba hazikuwa zimetimiza vigezo vya kusheria mfano hazikuidhinishwa na Mkutano Mkuu wa Kijiji.

Pia kwa Mujibu wa Sheria ya Ardhi zaidi ya Ekari 50 inabidi kuidhinishwa na Mkutano wa Baraza la Madiwani ilibainika hizo zilizoitwa hati hazikuwa zimekidhi Matakwa ya Kisheria hivyo automatically haziwezi kuwa sahihi hivyo ni kama Mh. Waziri Mkuu ame bold taratibu za Kisheria (perhaps ametumia loophole hiyo kutamka amezifuta hizo hati fake).

Huo ndio uono wangu kuhusu tukio hili naweza kusahihishwa.
 
Hivi waziri mkuu anaweza pia kutangaza hali ya hatari pia kwa kupewa maelekezo na rais? Mimi nadhani kuna maamuzi flani lazima yafanyike kwa kinywa cha Rais wa JMT.
 
Mbona kaliweka wazi hayana hati na wameshindwa kuyaendeleza (neno kuyaendeleza ni kigezo cha mkataba ukishindwa jukumu hilo tayari una breach) nadhani ata serikari ya mitaa ingeweza kufuta umiliki kwa vigezo hivyo vya kutotomiza masharti ya umiliki wenyewe.

Mashamba hayo hayakuwa na hati hivyo ni kama hayana mmiliki lkn pia amepeleka ujumbe kutoka kwa JPM ili kuyafuta..kikubwa kwa sasa wapewe wananchi wayaendeleze tu
 
hiv unadhan tu mtu atajiamria kufuta umirik bila kuwa na mamlaka kisheria? unadhan hao waliofutiwa hawana wanasheria wa kuwaelewesha hiyo kitu si sawa? mim sio mwanasheria.. lakin kunamambo ni logic tu inakupa mwongozo.. hata haihitaji masters

LAND ACT NO 4 OF 1999
Action to enforce revocation
section 48.-
(i) Where the Commissioner is satisfied that:

(a) a notice served under section 47 has not been complied with- or the breach of condition is so serious and of far-reaching consequences that-
(i) it would not be practicable for the occupier to remedy that breach within a reasonable time- or
(ii) the occupier has demonstrated a clear unwillingness to comply with the conditions of the grant of the right of occupancy made to him. there has been an attempted disposition occupancy

(C) of a right of to a non-citizen contrary to this Act and any other law governing the disposition of a right of occupancy to a non-citizen; the land the subject of the right

(d) of has been occupancy abandoned for not less than two years; where the right of occupancy is of land of an area of not less than five hundred hectares, not less than eighty per centum of that area of land has been unused

(e) for the purpose for which the right of occupancy was granted for not less than five

(f) there has been a disposition or an attempt at a disposition which does not comply with the provision of this Act.

(g) any rent, taxes or other dues remain unpaid six months after a written notice in the prescribed form was served on the occupier, and subsection(8) of section 33 does not to the occupier, he shall-
(i) serve a notice of revocation in the prescribe form on the occupier;
(ii) cause a copy of that notice to be served on all persons having an interest in the land
(iii) notify the Registrar of the services of the notice which shall be recorded in the register

(2) A notice revocation shall, subject to the provision of this section, take effect ninety days after it has been served on the occupier

(3) As soon as do notice of revocation has come into effect,
the Commissioner shall recommend to the President to revoke right of occupancy.

49-(I) As soon as the President approves a revocation under section 48(3) of this Act, the commissioner shall cause it to be Revocation and its effects published in the Gazette and in one or more newspaper circulating in the area where the land subject of he revocation is suite a notification of that revocation Upon the approval of the revocation by The President-
(a) the right of occupancy to which it refers shall determine immediately and without further
action...............

Mkuu ushabiki fuata bendera sio mzuri, hapa tunajadili na swali limeulizwa kama unalo jibu ungetusaidia sio kumshambulia mleta mada.
