Kama ninakuelewa vizuri, then the ishu hapa ni ile anayoisema Mzee Moshi kuwa as a nation hatuna priority ya elimu, ndio maana zinatolewa hela nyingi kwenye bajeti ya kununulia furniture za ofisi ya waziri mkuu, kuliko za elimu!

Nani wa kulaumiwa hapa, kama sio sisi wanachi tunaoendelea kuwachagua viongozi wetu bila ya kuwapa mandate?

kwa tanzania wanafunzi waliofanikiwa kufanya kazi ni wale wa degree za uzamili na kuendelea[masters],wao wanafanya EVENING PROGRAMMES unaweza kuingia darasani saa 12 jioni hadi saa 4 usiku..mchana kazi..au kama una ndururu unaenda ESAMI arusha unafanya executive ..kwa mwezi unafanya programme ya masomo kwa mfumo wa semina wiki moja kwa kila mwezi...na mnakutana esami au mnachagua hoteli sometimes .

so utagundua watu pekee tanzania wenye uwezo wa kufanya kazi na kusoma hapa ni wale wenye pesa za kutosha na sio hawa tunaowaongelea
 
Kuna watu bado wanasisitiza kwamba wanafunzi kugoma ni kuvunja sheria za nchi. Sheria zipi za nchi? Kugoma kwa mwanafunzi ni kukataa kwenda darasani; kuna sheria ya nchi inayolazimisha mtu kwenda darasani?

Kitu kimoja cha msingi ambacho hakijapewa jibu ni ukweli kwamba kiasi cha fedha ambacho Waziri Msolla alitangaza kimetolewa kwa ajili ya mikopo ya wanafunzi (111.3bn/-) kinaweza kutosha kuwapa mikopo kwa asilimia 100 wanafunzi husika wote. Zimekwenda wapi hizo fedha? Mzee ES, kwa vile wewe uko huko jikoni, naomba ufuatilie mambo mawili:

(1) Ni kweli serikali ilitoa hizo 111.3bn/- kwa ajili ya mikopo ya wanafunzi au ni uongo wa kisiasa?

(2) Kama zimetolewa kweli mbona zinatosha kuwapa kama 3mil/- kila mwanafuzi?

Kwangu mimi, hilo swala la matumizi ya hizo 111.3bn/- ni muhimu.

Wanafunzi wanapogoma kwa haki (kama ilivyo sasa) wanastahili kuungwa mkono na sisi sote, na hasa na waalimu wao.

11. The right to work, education and other rights

(1) The governing Authority will spell out appropriate procedures for the purposes of ensuring the existence of individual rights to work, to education and the right to receive assistance from the society at old age, when sick and disabled, or whenever a situation arises that will render one disabled. Without undermining those rights, the governing Authority will spell out a procedure to ensure that every individual earns a living through his own sweat.

(2) Everyone has the right to educate himself, and every citizen will be free to earn an education in any field desired and reach any limits depending on his merit and capability.

(3) The Government will endeavor to ensure that all people get equal and enough opportunity to enable them to secure an education and technical training in all levels in schools and other institutions of learning.

30. Limitation to rights and freedom rights and responsibilities

(1) Human rights and freedom whose foundation has been outlined in this Constitution will not be used by one person in a way that will result in interference or curtailment of rights and freedom of others or interests of the public.

(2) Let it be understood that conditions contained in this Section of the Constitution, interpreting the rights, freedom and human responsibilities do not illegalize in any way the established law or prevent any law from being enacted or any legal action being taken in accordance with that law, so as:-

(a) to ensure that justice and freedom of others or interests of the public are not violated by misuse of freedom and individual rights;

(b) to ensure that security, safety of the society, peace of the community, good conduct in the community, community health, development programs in cities and villages, production and utilisation of minerals, or aimed at developing the well being of the public;

(c) to ensure the implementation of judgement decisions or court order reached on any matter of civil or criminal nature;

(d) to maintain the reputation, justice and freedom of the majority of the people or individual life of people involved in court decisions; to prevent conveyance of secret information; to maintain respect, authority and freedom of the court;

(e) to impose restrictions, administer and guard against the establishment, operation and matters of unions and private organisations in the country; or

(f) to allow any other activity to take place, activity which will help develop and preserve the interests of the nation in general.

(3) Anyone who claims that any condition in this part of the Chapter or in any law relating to his rights or his obligations has been violated by anyone anywhere in the Union can file suit in the High Court.

(4) Without jeopardising, any other condition contained in this Constitution, the High Court will have the Authority to hear for the first time and to offer judgement on any matter brought before the court by referring to this paragraph; and the Authority of the State may enact a law so as:-

(a) to administer the procedure of filing suit in accordance with this paragraph;

(b) to interprete the powers of the High Court in hearing the suit filed under this paragraph.

(c) to ensure proper application of the powers of the High Court, protection and reinforcement of justice, freedom and obligations in accordance with this Constitution.


Nimejaribu kuangalia sheria inayokataza migomo TZ, so far sijapata. what came to mind ni sheria ya kazi, na haiwezi ku-apply hapa kwani wanafunzi sio wafanyakazi/wajiriwa.
Ninaamini kuwa hakuna sheria inayokataza migomo vyuoni ndio maana kila mara migomo ilipotokea UD DARUSO walikimbilia mahakamani na hata kabla kesi haijaanza kutajwa wanafunzi walirudishwa madarasani. Haipo hiyo sheria, thats why serikali/chuo hawajawahi kuitumia kuwashitaki waendesha migomo, sana sana viongozi wa migomo waliishia kufukuzwa/kusimamishwa masomo kama kina Mbatia,, no criminal proceedings were ever instituted against them.

Vipengele hivi vya Katiba nimevipata kwenye web so sijui kama vimejumuisha mabadiliko yanayotokea kila kukicha au vipi. Cha msingi; hivi ndivyo haki ya elimu ilivyo nadani ya Katiba, na haki hiyo kama zilivyo haki nyingine sio absolute.

Nilisema huko nyuma na ninarudia kusema hivi, Jukumu la kuwapatia Elimu Raia wa Nchi yeyote ni la serikali.kwa kupitia njia gani?Hapa ndiyo huwa kuna tofauti za mifumo kutoka nchi hadi nchi,sisi kwasasa tumechagua mikopo basi na tuwakopeshe watu waondoe adui ujinga na waliokopeshwa na kuhitimu na warudishe mikopo ili kutanua wigo endelevu la kuiwezesha serikali kuendelea kutekeleza jukumu lake hilo vyema kwa manufaa ya TAIFA KWA UJUMLA.Katiba mbona inaeleza wazi haki hiyo ya elimu kujengewa mazingira na serikali ya kuipata kwa mwenye kuitafuta kwa kadiri ya uwezo wake.

Hii ndiyo narrow minded view ambayo watanzania wengi wanayo, na ndiyo inayofanya serikali iwe na kiburi cha kufanya kila itakalo hata kama siyo kwa masilahi ya nchi ikiwa ni pamoja na uingiaji wa mikataba bomu ambayo wanjua watu wenye narrow minded view hawatahoji. Bado kuna watanzania wengi wanoadhani kuwa serikali inawafanyia fadhila kwa kuwapa nafasi za masomo ya juu badala ya kutambua kuwa ni wajibu wa serikali kuwafanyia hivyo.

Hii narrow minded view inatokana zaidi na dhiki ambayo serikali imewafanyia wanachi wake kiasi kuwa wanachi wanaamanini kuwa dhiki ni haki yao. Kwa hiyo ikitokea kuwa serikali inapunguza dhikli hiyo hata kwa chembe tu kama mkopo wa silimia 60, basi wanatakiwa washukuru badala ya kuidai serikali ifanye zaidi; wala hawana hata ya kujua hiyo asilimia 40 ilifikiwaje.


Bado tuna safari ndefu sana!! Inaelekewa wengine tutapiga kelele hapa hadi vichwa vituume. Mungu tusaidie kikombe hiki kitutoke.
 
Kichuguu mimi nadhani somo la uraia lifundishwe kuanzia primary hadi university, makanisani na misikitini hata uwanja wa Janjwani ugeuzwe uwe darasa la uraia. Nasema haya kwa sababu wananchi wengi hawa jui haki zao, hawajui nini matumizi ya kodi zao, hawajui ni kwanini wanawachagua viongozi na hawajui majukumu ya serikali. Wengi wanajua kuwa hata kujengewa bara bara, kupatiwa afya, elimu ni kama nafasi za upendeleo. Sasa hili ni tatizo maana hata wengi tulioenda shule kidogo hata hiyo katiba hatuijui wala hatujawahi kuishika. Kutokana na hili watu ndio maana wanaitetea serikali hata ikifanya uozo gani wanaitetea. Okay hivi kama kweli wasichana walijiuza kwasababu walifukuzwa chuo kama walipata magonjwa yatakayogharimu maisha yao si ni serikali imeua watu wake? Je ni hasara kiasi gani serikali imeingia kwa kufunga chuo? Nadhani watu wapate elimu kuhusu haki zao na wajibu wa serikali.
 
Kweli,

Elimu ya uraia kwa raia wetu ni sifuri kabisa. Nadhani kuwa kufutwa kwa miiko ya uongozi kwenye Azimio la Zanzibar kweli lilikuwa tatizo kubwa sana kwa nchi yetu.

Watu wanadhani mtu kuwa kiongozi ni haki yake badala ya kuchukulia kuwa hiyo ni dhamana ya raia. Wakati ninakua miaka ya sitini na sabini tulikuwa tunafundishwa kabisa kuwa "Cheo ni dhamana, sitakitumia cheo changu.... dada dadadadadadaa..... " sikumbuki tena.. Nadhani Mkandara kama angekuwa karibu angeweza kunikumbusha

THERE has been a positive response among parents and guardians in paying tuition fees for students at the now closed University of Dar es Salaam (UDSM).

The Deputy Vice-Chancellor for Planning, Finance and Administration, Prof Yunus Mgaya, said yesterday that they have been forced to increase manpower to collect and screen the letters as more and more students are responding positively.

However, Prof Mgaya could not reveal the exact number of students, who have responded to the university’s demands and conditions for their return. He said all applicants have attached medical capitation fee receipts.

“As of yesterday, about five parents came to my office to seek advice on the best form of payment. It appears many parents are willing to pay,” he said.

As part of the condition for their return after being suspended following a strike, first year students are required to pay 40 per cent of the tuition fees and medical capitation worth 100,000

Uongozi wa Chuo Kikuu cha Dar es Salaam, umesisitiza kuwa, wanafunzi wa Shahada ya Kwanza watakaopokelewa chuoni hapo Mei 14, mwaka huu, ni wale tu waliotimiza masharti tisa yaliyotolewa na uongozi huo.

Kati ya masharti hayo, ni pamoja na kuhakikishwa kwamba kila mwanafunzi analipa asilimia 40 ya ada na Sh. 100,000 kwa ajili ya matibabu.

Masharti hayo yaliwekwa hivi karibuni na uongozi wa Chuo Kikuu cha Dar es Salaam kufuatia mgomo wa wanafunzi wa Shahada ya Kwanza na vishiriki vyake.

Kwa mujibu wa taarifa iliyotolewa na Ofisi ya Uhusiano ya chuo hicho kwa vyombo vya habari Jijini Dar es Salaam jana, wanafunzi wataanza mitihani yao Mei 21, mwaka huu.

Ilisema mwisho wa masomo wa mwaka huu utakuwa ni Juni 8, mwaka huu.

``Tunachukua fursa hii kuwakumbusha wanafunzi waliosimamishwa, wazazi na walezi wao kwamba, kwa kuzingatia maslahi ya kila mmoja, chuo kitafunguliwa katika tarehe iliyopangwa.

Idadi nzuri ya wanafunzi wametekeleza masharti yaliyowekwa,`` ilisema sehemu ya taarifa hiyo.

Aidha, taarifa hiyo iliwataka wale ambao hawajatekeleza masharti hayo kufanya hivyo kabla ya tarehe ya mwisho ambayo ni Mei 4, mwaka huu.

Hata hivyo, taarifa hiyo ilikanusha uvumi ulioenezwa na vyombo vya habari kwamba chuo hicho kimelegeza masharti ya wanafunzi kurejea chuoni kufuatia mgomo wao uliofanyika Aprili 16 na 17, mwaka huu.

``Tunataka kusisititiza kuwa, masharti yote tisa yaliyotangazwa kwenye taarifa zetu kuhusu suala hili lazima yatekelezwe kikamilifu na wanafunzi wote wanaotaka kurejea chuoni?Haya masharti yakiwemo ya kulipa asilimia 40 ya ada kwa wanafunzi wa mwaka wa kwanza na nyingine100,000 ya matibabu kwa wanafunzi wote,`` ilisisitiza taarifa hiyo.

Aidha, menejimenti ya chuo hicho iliwatangazia umma kwamba maamuzi yaliyofanywa kuhusiana na mgomo wa wanafunzi hao yalizingatia sheria zilizoanzisha Chuo Kikuu cha Dar es Salaam.

Kutokana na hali hiyo, taarifa hiyo ilikanusha madai ya kwamba serikali imetoa shinikizo kwa menejimenti ya chuo kuweka masharti hayo.

Kadhalika, taarifa hiyo ilikanusha uvumi ulioenezwa kwamba kuna mazungumzo ya siri ya usuluhishi baina ya uongozi wa Serikali ya Wanafunzi (DARUSO) na menejimenti ya Chuo yenye lengo la kulegeza masharti ya kuwarejesha wanafunzi waliosimamishwa.

Aidha, taarifa ilisema kiasi cha malipo ya asilimia 40 ya ada kwa mwaka wa kwanza kinaanzia kati ya Sh. 240,000 hadi 400,000 kutegemeana na programu ambayo mwanafunzi amejisajili.

Ilisema zaidi ya asilimia 50 ya wanafunzi wanaangukia ada ya Sh. 240,000.

Kadhalika, mwanafunzi anatakiwa kuchangia ada ya matibabu ya Sh. 100,000.
