I would look at what likely GUIDED the thinking of UNIMISS military analysts for there cautious approach on calls to intervene on a distress call that should have been addressed to the government in Juba .. We all know that alot of countries pulled out its nationals out of Sudan, and the same was for aid-workers, the difficult ones chose to stay, while knowing the dangers involved.

Please note that South Sudan is in the middle of a vicious civil war that is fast shaping up into a tribal conflict. We all know that Sudanese population is heavily militarized, which makes it difficult to tell civilians and combatants, worse it part of the world where child-soldiers are tolerated.

This is not say that those who were victimized by Sudanese military were combatants, caution requires one to appreciate that rivals often plant spies and embed them within the operational functions of Humanitarian agencies.

Before the Kenyan General is condemned for alleged inaction, It would be better to look at the cost of intervening to protect 50 plus people against the threat of getting into a fire -fight with a hateful soldiers backed with there tribes men and women running amok in the heart of conflict ravaged South Sudan.

This what is likely to have happened if that scenario would have developed, a firefight with the 100 soldiers would have attracted a mixture of opportunists and warlords in the conflict. Both rivals would have come FULL force for the UNIMISS soldiers. The Machar group in an attempt to force a full scale with UNIMIS, purposely to provoke force a full-scale UNIMISS operation.

The Salva Kiir group would have sought to protect its positions, aware that an expanding, meddling by UNIMISS will disadvantaged the President Salva Kiir group that prefers a military solution. In between in the even of the killing of the UNIMISS soldiers, in the hands of poorly disciplined South Sudanese soldiers, would have likely lead to the debate for arrest of the Generals and mostly likely President Salva Kiir. Such a scenario would have complicated further the South Sudanese theater, pushing it beyond repair.

Many of the contributing countries that are silent while Kenya is selected out for criticism, would have blamed the Kenyan General when body-bags starts pilling up.

I read the Kenyan General decision, as one avoiding the temptation of falling to traps of black hawk down scenario, which
refers to the Battle of Mogadishu (1993), a battle between forces of the United States and Somali militia fighters which ended badly for the Americans.

We must also appreciate that Kenya is still healing from the El-Ade attack, where a heavily Al-Shabaab terrorists launched a coordinated assault on a Kenyan base in the town of El-Ade.

If we compare South Sudanese assets with that of the Al-Shabaab, one quickly picks that Sudanese theater is one that the threat is both conventional and unconventional with a likelihood of seriously disrupting regional peace.

To appreciate the THREAT involved, one needs to follow comments made in the UN security on the 10th of July, 2016 - which addressed a similar threat environment that ended badly for UNIMISS soldiers ..

“The members of the Council condemned in the strongest terms all attacks and provocations against civilians and the United Nations. They emphasized the need for United Nations [civilian protection] sites and United Nations personnel to remain secure,” said the Council President, expressing sympathies and condolences to the families of Chinese and Rwandan peacekeepers who were killed or injured in the attacks.

It is truly disrespectful and disturbing for UN Secretary-General Ban Ki-moon to jump his mouth to pick on Kenya's General's, whose restrain saved a lot of lives, one then wonders why the Chinese -a super power with assets in the theater were not included in the criticism ..

I have already made an obvious indictment of UNMISS peacekeeping colossal failures in its operations in South Sudan on this live TV interview : . I don’t want to any more indulge about it in this piece. Since the peacekeepers in South Sudan cannot be able to protect themselves, one wonders how they are even mandated to protect civilians. So, for the world body to scapegoating a decorated Kenyan commanding officer, Gen. Johnson Mogoa Kimani Ondieki for the peacekeeping failures, one can conclude that the Kenya government responds to disengage from such unsuccessful operations is appropriate measures. Kenya as a neighbor of South Sudan is in a better place to deal with South Sudan on bilateral terms than getting entangle in international conspiracy against the region.

Since this is my take, in this case, the focus of this piece is on the issue of deportation from Kenya to South Sudan and subsequent arrest of James Gatdet Dak. James Gatdet Dak took up arms to violently remove the government of South Sudan and since then he has became a mouthpiece of violence, operating from foreign lands on behalf of the armed opposition loyal to the South Sudan rebel leader, Dr. Riek Machar. Such treasonous act provides millions of justifiable legal reasons against James Gatdet Dak, but one incident alone if pursued under a competent court can put the fellow out for good.

On July 8th, 2016, just minutes when the firefight ensued at the Presidential Place in Juba, between the bodyguards of President Salva Kiir and those of First Vice President Riek Machar, in an apparent palace coup, James Gatdet Dak posted on his Face Book account an incited and incendiary message, which was quickly shared around and greatly contributed to the fateful events that saw Juba rocked in fire, with much destruction and unnecessary death. The scripted inciting message was posted as follows:

Fighting erupted inside J1, President Salva Kiir PLACE in national capital, Juba. The President and his commanders attempted to arrest the First Vice President, Dr. Riek Machar Teny. This came after the President called for the meeting of Presidency in his office with Dr. Machar and Vice President James Wani Igga. This turned out to be a setup to arrest and possibly harm Dr. Machar. Fortunately, Dr. Machar bodyguards have managed to fight vigorously and rescued Dr. Machar. He is now safe! Meanwhile, fighting has continued.

As the events unfolded and truth began to emerge, James Gatdet Dak ended up taking down his inciting posting from Face Book. Nevertheless, it was too little too late, because the damage was already done as the firefights continued for the next three following days, resulting into destruction, displacement, death, and Dr. Riek Machar tactically withdrawing away from Juba, with clear intent to launch attacks in taking over the capital. Now, under South Sudan Transitional Constitution 2011, James Gatdet Dak has committed treason. The article 4 (1) stipulates, “Any person or group of persons who attempts to overthrow the constitutional government, or suspend or abrogate this Constitution commits treason.” Therefore, James Gatdet Dak commitment of treason is beyond reasonable doubt.

Then, there is an issue of James Gatdet Dak being an American citizen and for that others argue that he must be rescued by the Americans. Being an American is actually a more legal liability to James Gatdet Dak. According to American law, cited as the Neutrality Act of 1794, it is illegal for an American to wage war against any country at peace with the United States. The Act evidently states in part, “If any person shall within the territory or jurisdiction of the United States begin or set on foot or provide or prepare the means for any military expedition or enterprise...against the territory or dominions of any foreign prince or state of whom the United States was at peace that person would be guilty...”
Since then, this Act has been amended several times, and the relevant applicable precedent occurred in 2015, when an attempted coup in the tiney African country of Gambia was thwarted and the co-conspirators of the coup who were either duel USA citizens or residence ended up being charged for violating the Neutrality Act of 1794 through American courts.

So, if James Gatdet Dak survives the legal scrutiny in accordance with South Sudan penal code, one wonders if he could survive the one of his adoptive country, the USA. Perhaps, it is advisable for the South Sudan government to pursue such legal matters with the USA so as to indict all those South Sudanese Americans who are waging arms war to violently remove the government of South Sudan.

but what was the mandate given to KDF by UN?
The stated UNMISS Mandate includes:
  • Support for peace consolidation and thereby fostering longer-term statebuilding and economic development
  • Support the Government of the Republic of South Sudan in exercising its responsibilities for conflict prevention, mitigation and resolution and protect civilians
  • Support the government of the Republic of South Sudan in developing its capacity to provide security, to establish rule of law, and to strengthen the security and justice sectors.

The unprofessional and indiscipline South Sudan government Using tanks and helicopter gunships was the one that was shooting indiscriminately and killing Civilians in the cities, the opposition which is made up of former military men also had tanks and anti-aircraft guns, alot of people were killed in the crossfire.......

The commander of the mission could not simply order his troops to be bogged down in this crossfire as alot more lives would have been losts as this would have meant engaged directly with the south Sudan government (against the mandate).. Infact ordering troops to engage would have been the easiest choice, holding back that order was actually more difficult... But as a distinguished commander he knew what his troops were up against, and he made a judgement call from the ground, the UN failed to provide UNMISS with enough firepower

UNMISS has 17,000 from 30 countries including India,Brazil,Germany,Korea,Jordan,Belarus,South Africa,Egypt,China,UK,Russia,USA basically all the world powers have troops in South Sudan, each country has its own contigent commander who recieves oders from the force commander...But there are what we call UNPK standing orders which the contigent comanders dont necesarily have to wait for orders like when you are on patrol and some civilians ask for help because they are under attack, or when your camp is attacked by whoever, you have to fire back.... non of these world powers did anything........ (Because the mission itself did not provide the necessary tools from HQ, and the mandet itself was flawed)......

DAR ES SALAAM, Nov 3 (AFP) — Tanzania said Wednesday it would only make good a pledge to send troops to the African Union mission in Sudan’s troubled Darfur region if it received a guarantee they will not be targetted.

Tanzania is among several African countries that have expressed willingness to contribute to the AU force monitoring a shaky ceasefire and providing limited protection to civilians in Darfur, where a rebel war broke out in February 2003.

Since then, tens of thousands of people are thought to have died as a result of the conflict, while 1.5 million people have been displaced.

The AU is in the process of increasing the size its mission in Darfur sevenfold, to over 3,000 personnel.

Tanzania earlier agreed to contribute 100 troops to the mission.

When seven Tanzanian peacekeepers in Darfur, western Sudan, were killed and 17 seriously wounded in an ambush by gunmen, the incident sent shockwaves throughout the country. For the first time public was made aware that all was not well with their men and women deployed in the war-torn Sudan as part of the UN peacekeeping forces.

The deadly attack on 13 July this year occurred when the soldiers were in a convoy searching for their vehicles that were reportedly stolen by a rebel group. The Tanzanian soldiers sustained heavy fire from machine guns and possibly rocket-propelled grenades. Among the wounded were two female police officers. No group immediately claimed responsibility. But a UN report in February said that some armed opposition groups are angry about the presence of peacekeepers and have called the force ‘a legitimate target.’

In the Tanzanian official circles scanty information was released, but some local journalists contacted the peace-keepers in Darfur.
