While the arrest of General Karenzi Karake continues to make headlines in the Media Worldwide, the Rwandan government is somehow surprised by the detention of General Karenzi Karake; however, it is not just doing something about that, rather! It has sent the people on the street to protest: workers were forced to leave their jobs, students and pupils were forced to leave their school and some of the people have placed their mattresses in front of the UK embassy determined to leave there when "KK" is released!

I can therefore, not miss to say that we have learned that some of those who have refused to join others to protest were charged a 2.000 Rwandan francs fine; no one knows whether is a way of collecting money to pay KK bail or
Mrs Blair and the KK's defense team. Infos from Rwanda claim that now people are being asked to raise money (1,2 billion Rwandan francs to cover KARENZI KARAKE bail) 12o million has already been pledged by the Private Sector (PSF) through "Agaciro Kacu Campaign" .

Meanwhile General James Kabarebe, Rwandan Minister of Defence, also concerned by an international arrest warrant from the Spanish justice cancels his trip to Germany and Turkey that was scheduled July 19-22, 2015!

Beside collecting the more than 1 milliard Rwandan francs for Karake's bail that granted him a house detention in UK, now there is an ongoing spin strategic plan of high category.

The Rwandan have learned, from former soldiers who were in the FAR and/or FDLR that DMI is looking for those who might be trained for the Karake's alleged war crimes so that they can appear in front of Media be in Rwanda or Worldwide claiming that they are the ones who killed and/or they were among the attackers that killed those three Spanish nationals whom Karake is allegedly accused of killing; or claim that they know what really happened at that time.

We are still doing our investigation on those who are planning this spin strategy; meanwhile, do not be surprised in case you see General Rwarakabije or one of the soldiers who came with him appearing in the Media claiming that he knows someone among them who killed those Spanish nationals.

Meanwhile, I would remind you that those Spanish nationals who were killed in Ruhengeri; were working for a non-profit organization Medicus Del Mundo. They were killed after taking pictures of bodies and remains of people who were killed by soldiers in what was Nyakinama municipality, some of those soldiers came from EGENA led by Evariste Kabalisa, Firmin Gatera and other high ranking soldiers.

After finding out that those Spanish nationals took picture of what they saw; a meeting to invent the DMI's drama to killed them and pin it to rebels at the then time was organized; the informations we have is that the attack was led by Justus Majyambere, Evariste Kabalisa and other soldiers. I would as well like to remind you that at that time, DMI was led by Lt Gen Karenzi Karake.

Something else that people should know is that those three Spanish nationals were along with their American national colleague who were not killed maybe because those who received the order, were ordered not to kill that American for fearing US. For some unknown reasons, the US has been avoiding to get involved in this or raise the issue, maybe the US made some kind of deal with the Kagame regime.

For those of you who know how the Rwandan government operates; you do know very well that no one; be in the RPF or RDF that could have engaged in killing those three Spanish nationals and leave an American behind and get away with it, if it was not blessed by Kagame.

The Head of the National Intelligence and Security Services was barred from leaving the UK after a week-long official visit. General Karenzi Karake has traveled to London on several occasions without any trouble, but last Saturday, UK immigration officials prevented him from boarding a flight to Kigali, claiming there was an indictment issued by a Spanish Judge. The incident left many wondering why a flawed 2008 indictment that is highly politicised and was recently suspended by the Spanish High Court is being honoured today. A closer look at the indictment and those involved shows a deep-rooted link to the genocidaires and their sympathisers.

Indictment linked to FDLR militia

The Spanish judge, who indicted 40 former and current senior Rwandan government officials over alleged war crimes and genocide, built his case based on information from NGOs that enjoy strong links to FDLR, a terrorist group that comprises elements responsible for 1994 Genocide against the Tutsi, that left over one million dead.
According to a 2009 UN Panel of Experts report on DR Congo, Judge Fernando Andreu Merelles received support to work on the indictment from the same NGOs that had extended support to FDLR genocidaires.
Fundaciò S’Olivar and Inshuti, both Spanish charitable organisations, received nearly €200,000 in grants from the local government of the Balearic Islands (Mallorca) to help prepare the indictments against RPF, the experts wrote in their report.
“On the basis of testimonies, original email correspondence, audio recordings of conversations, phone logs analysis and receipts of money transfers, as well as other documents, the Group established that FDLR has received regular financial, logistical and political support from individuals belonging to the above charitable institutions which, in turn, were funded directly or indirectly by the government of Islas Baleares, a provincial authority in Spain,” the Group of Experts said in its November 23, 2009 report to the UN Security Council.
FDLR, which has since defied several international and regional ultimatums to disarm, was blacklisted by the US as a terrorist organisation.
The Group of Experts added: “An FDLR liaison officer who had been part of a weapons transfer between the FNL (then Burundi rebels) and FDLR in December 2008, stated to the Group that he had been in touch with Joan Casoliva, a Spanish citizen in contact with the government of Islas Baleares in Spain, and who had promised to FDLR liaison officer that he would raise up to two hundred thousand dollars for FDLR.”
Casoliva, the UN panel said, was listed in 1999 as the president of Inshuti, which runs a Barcelona-based website posting articles alleging war crimes committed by top officials by the Rwandan government and military, as well as hosting a link to the FDLR website.
Documents show that Fundaciò S’Olivar received Euro 198,000 between 2001 and 2008 from the Fons Mallorquì de Solidaritat i Cooperaciò, a trust established by various mayoral offices in the Islas Baleares, to sustain the prosecution of RPF officials through Spanish courts, the UN panel said. “Casoliva reportedly worked on and off for Fundaciò S’Olivar in this same period of time.”
American cable
To further understand how sinister the indictment is, one can refer to the leaked US cables dated April, 2008 classified by the US ambassador at the time Michael R. Arietti who described the indictment as “outrageous and inaccurate.”
“The Spanish Indictment of 40 Rwandan military officers offers an unrecorgnisable version of some of the most painful and violent episodes in Rwanda’s history, distorting the established record, inventing mass killings,” the cable reads in part.
In further questioning the indictment, the cable points to the inaccurate and repugnant description by the Spanish judge on the origins of the Genocide.
“At no point in the judge’s narrative is the Habyarimana regime or extremist elements within that government at fault – there is no planning of Genocide, no carrying out of prepared massacres, nary a mention of the insidious and all-encompassing psychological preparation of mass killings by the media outlets controlled by extremist elements,” the cable adds.
The judge’s account of what happened in Rwanda is synonymous to Genocide denial and has prompted researchers to look into why he would get involved in a fanciful account of what happened.
Tom Ndahiro, an expert in Genocide studies, in his article, “Merelles: The Indictable Spanish Judge,” published in February 2011, argued that in analysing the indictment, it is substantially clear that either for his own ideological motives Judge Merelles consciously manipulated and misrepresented historical facts.
This, Ndahiro wrote, enabled him to portray genocidaires in an intolerably positive way, hiding their clear responsibility for the planning and commission of the Genocide against the Tutsi in Rwanda.
Strong reactions
Meanwhile, the arrest of Gen Karenzi has sparked strong reactions from different sections. Andrew Mitchell, a senior British parliamentarian, described the arrest as an abuse of justice.
“It’s a misuse of the European Arrest Warrant system,” Mitchell, an MP from the ruling Conservative Party said.
“It’s being used by the supporters of the genocidal regime against those who stopped the Genocide,” he said, adding that the junior Spanish judge’s warrants had been suspended by the Spanish High Court in March 2014.
“The indictment is being used for political reasons, and not judicial ones,” Mitchell told the British media, yesterday.
Rwanda’s Foreign Affairs minister Louise Mushikiwabo blasted what she termed as “western solidarity in demeaning Africans” which she said was “unacceptable”
“It is an outrage to arrest a Rwandan official based on pro-genocidaires lunacy!” she wrote on her Twitter account.
The minister said, “The UN in 2009 amply documented support of Spanish NGOs behind the preposterous “valid European arrest warrant” to genocidal militia FDLR!”
Egide Nkuranga, the vice president of Ibuka, the umbrella of Genocide survivors’ associations, said that it does not make sense that Gen Karake could be arrested unless those who arrested him were in support of those who committed the Genocide against the Tutsi.
“Those who committed the Genocide are roaming free but a man who contributed in stopping it is being arrested, it’s a shame,” Nkuranga told The New Times.

1. Naona umeanza kwanza kwa kujihami eti " ila usianze ubishi", sasa ndugu yangu kama siruhusiwi kubisha what's the point ya kuwa na mjadala? Huo utakuwa mjadala wa kinyarwanda ambao kagame akisema jambo huruhusiwi kubisha, halafu mwisho wa siku anadai dictation ile ilikuwa "debate". hahaha. Anyway twende kazi, za kwako za red, zangu za black.

1. The incident left many wondering why a flawed 2008 indictment that is highly politicised and was recently suspended by the Spanish High Court is being honoured today: Waingereza walisema kwenye PR yao: "We can confirm that General Emmanuel Karenzi Karake was arrested by the Metropolitan Police on 20 June on behalf of the authorities in Spain. This was a legal obligation, following the issue of a valid European Arrest Warrant". Warrant inakuja kutokana na legal indictment. Do you really think waingereza wanaweza kumkamata mtu mwenye cheo cha Karake based on a "suspended indictment"? For such a warrant to be acted upon inabidi vikae vitengo at least scotland yard, National crime agency, interpol na upande wa pili wa vyombo vya sheria vya Spain. Vyoote hivyo vifanye uzembe wa kutoona kuwa the indictment was after all suspended? Inashangaza why newtimes inamtetea karake kwa staili hii wakati mawakili wake mwenyewe (wakiongozwa na mke wa Tony blair) hawajatumia utetezi huu AT ALL. Wao wametaka Karake aachiwe kwa sababu
1. Ni "kigogo" sawa sawa na Director wa CIA or something 2. Heshima ya Rwanda duniani, you know the usual 'roads, economy, gorillas.....':A S wink: Mbona mwenye kesi mwenyewe hajasema the indictment is suspended? Mi nadhani umshauri Karake amfukuze kazi mama blair na badala yake awaajiri Newtimes. If the indictment is suspended me thinks the judge would have thrown away the arrest warrant.

2. The Spanish judge, who indicted 40 former and current senior Rwandan government officials over alleged war crimes and genocide, built his case based on information from NGOs that enjoy strong links to FDLR, a terrorist group that comprises elements responsible for 1994 Genocide against the Tutsi, that left over one million dead: Kwanza tukumbushane kuwa mashtaka ya hao watu 40 including Karake mengi ni juu ya makosa ya mauaji aliyofanya mwaka 1994. Hata hao waspanish waliouawa, waliuawa mwaka 1997. FDLR imeanzishwa mwaka 2000. All the facts kuhusu mashtaka mengi zina predate FDLR. Sioni kabisa how involvement ya FDLR. inaweza kubadili chochote katika facts kuhusu hiyo kesi. After all kama FDLR is who newtimes define as, basi hakuna tabu, Karake ataachiwa huru kwa sababu FDLR watabainika kuwa ni waongo at the end of the day not so? Kwa nini kesi itupwe kwa vile tu aliyekushtaki humpendi? mwache abainike uongo wake mahakamani.
Pili, i want to remind you kwamba HAKUNA KESI HATA MOJA DHIDI YA FDLR MEMBER YOYOTE YULE ON GENOCIDE! Mahakama inayohusika ni ICTR na mpaka sasa HAKUNA KESI YA GENOCIDE DHIDI YA FDLR MEMBER YOYOTE YULE! So hakuna ubaya wowote kwa NGO yoyote ile kushirikiana na FDLR (except in rwanda), ndio maana Kikwete boldly suggested talks.

3. ...was blacklisted by the US as a terrorist organisation. : FDLR ilishaondolewa kwenye orodha ya US ya terrorist groups ZAMANI SANA. Funny how newtimes likes to simply write "it was" ili kumuingiza mkenge mwenye akili ndogo kudhani kuwa FDLR mpaka leo imesajiliwa kama hivyo. Shame!
Why would Rwanda keep silent muda wote huo? Na hata sasa kwa nini Rwanda isiende UN kutaka Spain ichukuliwe hatua kwa kushirikiana na kikundi cha kihalifu kama FDLR? Kwa nini Rwanda isi raise issues na ujerumani, ufaransa, marekani, south africa,....AND ALL THOSE COUNTRIES ambazo FDLR senior members wanakaa? Hii ingewezekana if and only if Boko haram wasingekuwa kundi la ugaidi, otherwise wangekamatwa kokote kule. Its only in Rwanda where FDLR is defined tofauti na nchi nyingine hivyo mambo mengi kwenye huu "upande wa pili" hayana msingi kwangu mimi nisiye mnyarwanda.

4.
American Cable: At no point in the judge's narrative is the Habyarimana regime or extremist elements within that government at fault – there is no planning of Genocide, no carrying out of prepared massacres, nary a mention of the insidious and all-encompassing psychological preparation of mass killings by the media outlets controlled by extremist elements," the cable adds.: FACT: Hukumu ya ICTR imethibitisha kuwa HAKUKUWA NA CONSPIRACY TO GENOCIDE. Hivyo hakimu wa Spain yuko SAWA KABISA na jopo la mahakimu wa ICTR! Genocide haikupangwa na ICTR imethibitisha hilo! That's two separate free and fair courts and at least 2 judges versus who?...anayesema genocide ilipangwa?

5. Andrew Mitchell, a senior British parliamentarian, described the arrest as an abuse of justice. Kuhusu huyu bwana kwa kuwa ametoa argument za kisheria namuachia Dr charles Kambanda (Phd) ajibizane naye.

No country executes a foreign arrest warrant before a court with jurisdiction determines that their was probable cause for the arrest warrants to issue in the first case.

I hope Andrew Mitchell knows or should know that in extradition procedures, Court must be satisfied that the case is not political. Andrew Mitchell should know the standards we use to determine whether or not the allegations are political. I see no inditications of that and the type of crimes alleged are not those crimes we call political crimes.

Again, Andrew Mitchell probably needs to sound learned. In any case, does Andrew Mitchell reasonably believe that the world has forgotten his financial scandal in favor of Kagame shortly before he was kicked out of office? Doesn't he care that he sounds so ridiculous?

Dr Charles Kambanda

13 March 2014 Spain's right-wing Popular Party (PP) government has placed a ban on attempts to pursue justice for crimes under universal jurisdiction laws. PP spokesman Alfonso Alonso declared it was necessary to eliminate universal jurisdiction because it "only brings conflict."
Universal jurisdiction refers to the idea that a state may prosecute individuals who are not its citizens, who have committed serious crimes, including crimes against humanity, war crimes, genocide and torture outside its territory or against its nationals. Under the new law, prosecutions can only be brought if they involve a Spanish citizen, victims who had Spanish nationality at the time of the events, or if the person accused of the crime lives in Spanish territory.
The new law means an end to a dozen investigations including:
● The investigation of CIA rendition flights that landed in Spain after 9/11
● The murder of Spanish cameraman José Couso in Iraq by US troops in 2003
● The 2012 Israeli attack on the Freedom Flotilla delivering humanitarian aid to Gaza
● The kidnap, torture and murder of Spanish United Nations official Carmelo Soria in 1976 by the National Intelligence Directorate of Chilean dictator General Augusto Pinochet
● The prosecution of China for genocide, torture and crimes against humanity in Tibet
● The complaint against four former SS soldiers by a survivor and the families of five Spanish victims of the Nazi concentration camps
● The lawsuit involving the alleged killing by the military in 1989 of five Spanish Jesuits in the Central American University in El Salvador
● The investigation of several former top Guatemalan officials charged with genocide and torture committed against the Mayan population
● The investigation of former officials of the Rwandan government for the genocide of four million people and the murder of nine Spaniards in the 1990s
● The investigation into the attack by Iraqi special forces in 2011 against the Ashraf refugee camp, in which 35 people are said to have died and 337 injured
● The lawsuit into the alleged crimes of genocide, murder, torture and illegal detention of Sahwaris by the Moroccan authorities
● The alleged crimes of genocide and torture against followers of the Falun Gong in China
The universal jurisdiction concept is rooted in the 1949 Geneva Conventions. The signatory nations passed laws to "provide effective penal sanctions" for persons "committing, or ordering to be committed… grave breaches" of the Conventions. Article 129 demanded that each signatory "shall be under the obligation to search for persons alleged to have committed, or to have ordered to be committed, such grave breaches, and shall bring such persons, regardless of their nationality, before its own courts."
The United States and other major powers have always used the Conventions in a highly selective manner, seeking to prosecute international human rights violators deemed hostile to their strategic interests, while opposing universal jurisdiction proceedings brought against themselves and their allies.
Spain integrated the doctrine into its national legislation in 1985, empowering the High Court to prosecute criminal acts such as genocide, terrorism and piracy, as well as "any other which, according to international covenants and treaties, should be prosecuted in Spain."
The most famous case occurred when investigative judge Baltasar Garzón sought the extradition of Chilean dictator General Augusto Pinochet in 1998, while he was on a visit to the UK. Pinochet was charged with murder and the forced disappearance of more than 3,100 Chileans and foreigners during the military coup he led in 1973 and his subsequent 17-year dictatorship. Pinochet was eventually returned to Chile on the grounds that he was too old and ill to stand trial. The governments of Chile, Spain and Britain manoeuvred to ensure that he was not extradited to Spain to face trial.
In the aftermath of the Pinochet trial, the Spanish political establishment became increasingly uneasy about the application of universal jurisdiction and judges issuing arrest warrants without taking into account foreign diplomatic relations, especially with allied countries. The unease increased when the family of cameraman José Couso, shot by US troops while filming in Iraq, brought a High Court case in 2005 demanding the extradition of the US soldiers involved.
Shortly after, Garzón announced he was considering an investigation into the "criminal responsibility" of then US President George W. Bush, former Spanish Prime Minister José María Aznar and former British Prime Minister Tony Blair.
Behind the scenes the Socialist Party (PSOE) government, which was promoting a public image of independence from US imperialism, was busily working to prevent the prosecution of US officials. US Madrid embassy cables released by WikiLeaks revealed how PSOE officials and top judges collaborated with US officials to prevent any prosecutions taking place (see: "Spain's Socialist Party government colluded with US to conceal Iraq war crimes").
Eduardo Aguirre, US ambassador to Spain, commented, "while we are careful to show our respect for the tragic death of Couso and for the independence of the Spanish judicial system, behind the scenes we have fought tooth and nail to make the charges disappear."
Garzón was debarred from the Spanish courts in 2012 in an attempt to prevent him investigating the crimes of fascism in Spain.
The latest moves by the PP government came in response to the High Court issuing international arrest warrants for top Chinese Communist Party leaders, including former president Jiang Zemin, ex-Premier Li Peng and three other top Chinese officials for alleged torture and genocide in Tibet during the 1980s and 1990s. Chinese Foreign Ministry spokeswoman Hua Chunying declared, "China is extremely dissatisfied with and resolutely opposed to the wrong actions of the relevant Spanish [court]… Whether or not this issue can be appropriately dealt with is related to the healthy development of ties. We hope that the Spanish government can distinguish right from wrong."
