Serikali ya Jamhuri ya Muungano wa Tanzania Chini ya Rais JOHN POMBE JOSEPH MAGUFULI ilifikia kufanya Uamuzi mgumu wa kusitisha Mkataba wa Uwekezaji ulioingia na Nchi ya Netherland kuanzia tarehe 1 Aprili 2019.

Mkataba huo unajulikana kama Reciprocal Protection of Investimate Treaty.

My Take:
Kwa mimi ambaye nilibahatika kuupitia Mkataba huo, Hatuna budi Kumshukuru Rais MAGUFULI kwa nia yake ya Dhati kutetea Maslahi ya ya Wananchi wake na Taifa kwa ujumla kwani mojawapo ya Mapungufu ya Mkataba huo ilikua ni Mazingira ya Kutunyonya Sisi Watanzania.

Swala Unyonyaji linakuja tu pale ambapo Tanzania bado hatuna wawekezaji wa kutosha ambao wanaoweza kushindana na wawekezaji wa Netherland kwa Masharti ambayo ni nafuu na Rafiki kwa Nchi hizi Mbili.

"The Government of the United Republic of Tanzania notified the Government of the Kingdom of the Netherlands in September 2018 of its intention to end the existing reciprocal protection of investment treaty between Tanzania and the Netherlands. Despite efforts to seek a temporary extension of the existing treaty and/or a speedy start of negotiations for a new investment protection treaty no progress has been made so far.


The implication of this development is that as per 1 April 2019 new Netherlands’ investors in Tanzania (and new Tanzanian investors in the Netherlands) can no longer rely on the preferential protection that the treaty provided. This means for new investors that they will have to rely onnational legislation and regulations for protection of their investment. It also means that they will have to seek legal redress, if and when needed, through national courts. Access to international arbitration will no longer be possible, unless a new agreement is reached that will cover that option.


However, existing investors should take note of the fact that the treaty’s comprehensive protection for investments made before the date of termination (1 April 2019) continues to apply for a period of fifteen years (until 1 April 2034). In view of the time needed for negotiations and ratification of an eventual new treaty the Embassy expects that it can take up to 3 to 5 years before an eventual new investment protection treaty becomes effective. Potential investors are advised to take this recent development into consideration when preparing decisions on investment in Tanzania."

Mfano unatiliana mkataba na landlord kwa mwaka lakini kila mwezi utalipa million 1, kufika miezi 4 wewe unataka kusitisha mkataba?. Hapa lazima atakupeleka mahakamani na kudai malipo ya miezi 8 ilio bakia. Ndio ninavyoona juu ya huu mkataba aliosaini Magu.

Nimeusoma huo mkataba kuna kipengele sijakipenda, kipengele kinachotaka serikali ichukue hatua polepole kupunguza incentives kwa local industries zinazodeal na issues kama zile investors wanazofanya nchini. kwa nini serikali ipunguze incentives badala ya kuziongeza kwa local industries ikibidi?

Sasa hapo umevunjwa vipi? Kama umekodi duka kutoka 2015 mpaka 2025 lakini kufika 2019 unasema navunja mkataba. Lakini nitakuwepo mpaka 2025, ambayo hio 2025 ndio mwisho wa mkata kwanini wasinge subiri mpaka ifike muda wa ku renew mkataba nao ndio wakasema hatutofanya hivyo?
