MPs adjourn sitting after court stops release of Sh34bn CDF cash
Parliament adjourned its sitting Tuesday evening following reports that the High Court had stopped disbursement of Sh34 billion meant for the Constituency Development Fund (CDF) on grounds that the Act is unconstitutional.
The MPs forced Deputy Speaker Joyce Laboso to adjourn to allow them to hold a Kamukunji after Kisumu Town East MP Shakeel Shabir alerted them of the court order stopping the funds.
The MPs turned chaotic on learning that two civil society groups led by The Institute of Social Accountability (TISA) had returned to court to stop the funds.
TISA is seeking to block MPs from having any role in the management of the CDF. It wants the money channelled to counties to be managed by governors.
The case has since been joined by the Council of Governors who argue that the fund interferes with the counties’ equitable share.
TISA is seeking nullification of the Act on grounds that it gives MPs powers to appoint and approve persons to sit on the fund’s board at the constituency level.
They also contend that there is no clear separation between the roles of national and county governments on the management of CDF.
TISA last year secured a court order declaring that CDF was unconstitutional. The MPs were forced to amend the CDF Act to create the NGCDF but civil society groups have returned to argue the Act is still unconstitutional.
Mr Shabir informed MPs that the case will come up on Monday and therefore the House needed to engage its lawyers.
