Muhammad Swazuri cancels title deeds issued by President Uhuru Kenyatta

Title deeds issued by President Uhuru Kenyatta three years ago for a settlement scheme in Kwale have been nullified.

National Land Commission (NLC) Chairman Muhammad Swazuri said the title deeds issued to Golini adjudication area were erroneously given to non-locals despite the fact that locals were occupying the land.

Mr Swazuri said the errors were discovered after the county government and NLC conducted a verification exercise.

Last year, the County Assembly Land Committee recommended the revocation, saying more people from ‘outside’ were issued with the documents than local squatters.

“We have a lot of issues in settlement schemes like Diani complex, Ukunda, Diani, Ramisi and Shimba hills,” said Swazuri.

NLC said that genuine locals will receive allotment letters before being issued with title deeds.

Addressing journalists when he toured Kwale, Swazuri said that the commission will consider current owners, locals and county government in either deciding to or not to renew expired land leases in the area.

Swazuri asked locals of Somali origin occupying Kuranze ranch in LungaLunga to allow the Maasai and the Duruma to graze and water their cattle pending determination of a land dispute.

DOWNPLAY FEARS

“We have a lot of issues in ranches across the country including Laikipia, Nyandarua, Kajiado, Samburu, Narok and Lamu. But the Community Land Act will address such issues through the county government,” he said.

Swazuri also took issue with Kwale County’s decision to construct a recreational facility at Baraza park before consulting Kaya elders.

The elders have opposed the project.

“If we allow this to go, people will bring their structures and make this park a market centre which is not good. We have moved to court after the county government refused to hear us out and so we ask NLC to help us stop the construction,” said Kaya Kwale Chairman Abdallah Kushinda

But Kwale County land executive Ali Mafimbo sought to downplay the elders’ fears.

“Baraza Park development was arrived at after public participation,” said Mafimbo.

This comes as Mombasa County demanded that the entire coastal region be represented in a Lands ministry task force to look into policy regulations.

Mombasa Land executive Antony Njaramba argued that CS Jacob Kaimenyi overlooked Coast counties in the formation of the task force.

He said Mombasa, Kwale and Kilifi, which host scores of squatters and face unique problems such as absentee landlords, should be part of the task force.

The Kenya Land Alliance (KLA) has also demanded to be included in the task force.

The task force members are drawn from the National Land Commission (NLC), Lands ministry, Kenya Law Reform Commission, State Law Office, Institute of Surveyors of Kenya, Nairobi county government and Law Society of Kenya.

The Lands ministry and the National Land Commission (NLC) are consulting with stakeholders to regularise nearly three million title deeds issued by the Jubilee administration since 2013.

Kwale, Kenya: Former Prime Minister Raila Odinga has dismissed as illegal the title deeds issued recently by President Uhuru Kenyatta to Coast residents.

Leading the CORD team with Bungoma senatorial candidate Moses Wetang’ula in campaigns for the coalition’s candidate for the Lunga Lunga parliamentary seat, Khatib Mwashetani, Sunday, Raila claimed Uhuru issued the deeds to woo voters in a region dominated by CORD in the last elections.

Speaking in Shimoni town, Raila described the issuing of the 60,000 deeds as propaganda by the Jubilee government.

“They are using the issue as an entrance to Coast politics. Be warned that those title deeds have no any legal basis as the work of issuing them was left with both the National Land Commission and the county government,” said Raila at a rally in Shimoni.

Also accompanying Raila was Machakos Senator Johnstone Muthama who claimed that Jubilee stole the last elections and urged local voters to “protect your votes” because there could be a snap election anytime, but he failed to elaborate.

Sunday, the CORD leaders toured Kikoneni, Mamba, Mwereni, Mwanguda and other parts in Lunga Lunga constituency.

They told voters during a stop in Shimoni town that CORD was confident of winning the Lunga Lunga seat through Mwashetani.

Land problems

Raila wondered how Jubilee could offer solutions yet he claimed some in the Government were behind the land problems at the Coast.

He said instead of Uhuru issuing the title deeds, he should have tried to solve the historical injustices that date back to 1912.

Siaya Senator and former Lands minister, James Orengo, said there was no goodwill from the Jubilee government to solve the land problem at the Coast.

“You have been given deeds that are not reflected in Nairobi. Most of the land here was given as presents to people from upcountry and if we want to fight this then do what is right for the Coastal people,” said Orengo.

The ongoing by-elections in various parts of the country saw some leaders claiming that there was a sinister motive by the Jubilee government to target CORD regions only.
