ICC-International Criminal Court, International !!! Je Marekani na Uingereza sio wanaojiita "International Community"? Kwanini tuwe na ICC wakati hao wanaojiita "Intrernational Community" hawataki ku-sign. Wanajificha katika kipengele kwamba wao sio "signatories" wa ICC na kwahiyo wafanye uhalifu watakavyo.

Kwa ufupi ni kwamba hawa washenzi wana double-crime

1. "KITENDO CHAO CHA KUKWEPA KWA MAKUSUDI KU-SIGN MKATABA WA ICC" ni crime namba moja na ndio major crime, unless labda kama wewe hulioni hili. Hapa ndipo ulipo upumbavu wa Joyce Banda na wengineo wanaomuunga mkono kwa kulipuuza hili. Unless mtueleze sababu mnayoifahamu nyinyi isiyokuwa ni makusudi tu wanafanya hivi. Hii katika wakati huu wa ulimwengu ni UNACCEPTABLE isipokuwa kwa wale wenye mtindio wa akili. Na kama ulimwengu hauwezi kulibadilisha hili basi nini maana ya chombo hiki ICC na anapata wapi Joyce Banda haki ya kumkamata AlBashir?
2. Crime No 2 ambayo ni minor ndio inayokusanya UHALIFU woooooote ambao viongozi wa nchi hizo wanaufanya dhidi ya nchi nyengine. Uhalifu huu labda asiyeuona ni wewe na huyo Banda na ni kutokana na uhalifu wanaoufanya wao ndio ulimwengu umeingia katika cycle na recycle ya vitendo vya state-sponsored -crimes. Kama ukiangalia "chanzo halisi" cha uhalifu popote pale ulimwenguni "hot spots" basi ni vigumu sana wasihusike kwa namna moja au nyengine.

2.Lakini swali la msingi la kujiuliza ni Kwa nini Marekani,Uingereza,n.k. wasiweke sign ICC?Ndugu wachangiaji hii mimi ninaona ni kama kiini macho,Bush na Blair waliua watu wengi sana huko Iraq lakini kwa sababu sio member wa ICC then wao wanakuwa na impunity.Waliouwawa Iraq ni wanyama?Hata kama ni wanyama basi nao wana haki inayowalinda.ICC inatakiwa iende step moja mbele kuangalia hili.Huu ni uonevu wa hali ya juu sana,tutakapofanikiwa kushinikiza hizi nchi zenye nguvu sana UN(USA,UK in particular) kuwa member wa ICC then hapo ndio tungeweza kuona haki inatendeka kwa viongozi wote wanafanya uhalifu dhidi ya binadamu duniani.

Nyie wakenya acheni kuifanya africanism kuwa sawa na kutetea maovu. Mtu anafanya mauaji ya watu, akitaka kukamatwa nyie mnasema hiyo ni anti-africanism. ..... Granted there is collated interest between the Kenya Cases and the Bashir Summons to the ICC, that cannot be denied. But it is the selective application of the Rome Statutes Principle and the very evidently skewed interpretation of International Jurisprudence on the Rome Statutes in its present form of enforcement that is objectionable. By all indications today, an international crime is declared by the Political System (race) of the perpetrator.

We all know that the Victors in Conflict get to write the History of the Conflict, and this in effect is the revisionist philosophy that underlies the present definition of International Crimes - are we to believe that no one is responsible for the recent genocide perpetrated by the NATO Countries in Libya in the full glare of international Media? Has any mention been made about possible investigations and prosecution for this Genocide? Tony Blair and George Bush and cousins slaughtered over half-a-million non-combatant Iraqis in just ten years of murderous occupation of Iraq - has any mention be made anywhere of possible investigations and prosecution of these two white or their subsidiaries? The Apartheid Regime was buried in history, both its definition and the horrible crimes against humanity committed in its defense - what retribution was exacted for these 100 years of licensed de-humanization of the Africans by the whites in South Africa? Are we likely to see Obama, George Bush, Cameroun, Sarkozy interrogated in a process to press for prosecution for the ongoing genocide in Pakistan and Afghanistan?

In Kenya, after 70 of their genocidal colonial mis-rule, the white man transferred ( The British Government now have declared in a court of law in London!!) both the political self-rule and the political responsibility for their genocidal misrule to the incoming African Government, and even today shamelessly insists the British Government has no responsibility, and will not acknowledge the huge historical inhuman injustices the white man perpetuated in Kenya over the Colonial mis-rule. The list of murderous, genocidal white political systems is endless in history, even recent history. But for the Bosnia and Serb conflict, the ICC and International Justice Systems have shamelessly remained silent on White culpability in crimes against humanity, while their sanctimonious accusations against similar crimes against humanity committed by African and Arab political systems are today a mantra in all international public fora.

Like Mwalimu Nyerere has been quoted here as having said, a crime is a crime regardless of the color and tribe of the perpetrator. That unfortunately does not hold today in the enforcement of International Jurisprudence on Crimes against Humanity.

africa ina hasara kubwa sana maana hata wanaume walio kwenye uongozi ni wachache sana ambao sisi kama wananchi tunaweza kujivunia, kuna nchi leo hii duniani zinaweza kusema zimeongozwa na wanaume lakini kwa waafrika wengi wetu hatuwezi jivunia after 50 yrs ya uhuru bado tu maskini na ombaomba na tunaongozwa na wanaume mi naona hata aibu kusema tunaongozwa na wanaume heri tunyamaze huyo mama hana tofauti na hao wanaume wote sawa tu.
