The Law Society of Kenya (LSK) has rejected proposals to postpone the next Ol Kalou parliamentary by-election due to purported campaign irregularities, contending that voters shouldn't be penalised for the behaviour of political players or candidates.
LSK claims that depriving voters of their constitutional right to choose a representative due to candidates' election misconduct and acts of violence amounts to a violation of their rights.
Additionally, LSK demanded that all reported electoral offences be looked into by the Directorate of Criminal Investigations (DCI), the Office of the Director of Public Prosecutions (ODPP), the Ethics and Anti-Corruption Commission (EACC), the Public Service Commission (PSC), and the National Police Service. If violations are found, appropriate legal action should be taken.
The group contends that electoral violations are criminal acts that jeopardise constitutional governance and public trust in democratic processes, rather than just being political disputes.
The attorneys' organization asked political leaders, candidates, public officials, and voters to reject electoral fraud and promote peaceful, lawful, and issue-based campaigns, stating that respect for the Constitution and the rule of law is critical to preserving the country's democracy.
