Kenya’s naval forces are likely to be in action this week, as the next phase of the military operation targeting the Al-Shabaab militants in Somalia gets under way. The Navy has largely been missing in action for the two-weeks of the incursion as the Army and Air force pounded Al-Shabaab strongholds.

They have since taken control of areas deemed strategic in the quest to capture Kismayu — the main Al-Shabaab base.

Military sources in Kiunga and Lamu said the anticipated attack on Kismayu, a sea port and an Al-Shabaab bastion will definitely involve the Navy. A senior officer at Department of Defence also said the Navy has been keeping vigil on the seas as part of the strategy within the ‘Operation Linda Nchi’.

“Our ships are at their bases near the operation zone and are ready for deployment whenever they are needed,” the senior officer told the Nation in an interview.

LEGAL PITFALLS IN PURSUING AL SHABAAB ACROSS BORDER:

Even in declaring war, the Kibaki administration has a dysfunctional trait unique in the community of nations.

Our men and women in uniform are sent to Somalia on a short notice and the commander-in-chief remains mum. He neither informs Kenyans, much less justify, the mission.


We hear the declaration of the war from the Minister in charge of police and administration police!


The legal basis upon which Kenya has invaded Somalia has not been elucidated by either the Foreign Affairs ministry or the Attorney-General. Kenyans, out of a nationalistic duty, rally behind our soldiers.


Still, the government needs to explain to Kenyans the legal justification and security rationalisation behind the invasion of Somalia. War has a huge propaganda component and the government must realise that.


In an era when both the International Criminal Court and the International Court of Justice can assume jurisdiction in relation to the acts of governments, Kenya must act very cautiously and engage the international community urgently.


The Minister for Internal Security has cited Article 51 of the United Nations Charter as the legal justification for the war.

A closer scrutiny shows that no such justification exits both under customary international law and even upon a liberal interpretation of Article 51.

The conflicting signals from Somalia further complicate our position. Only an unequivocal statement form Somalia requesting the assistance of Kenya in eradicating the Al-Shabaab menace will do.


It must be remembered that when Ethiopian forces crushed the Union of Islamic Courts in Somalia, the same was upon an express request by Somalia.



If no formal request is forthcoming from Somalia, Kenya can try to hinge its decisions on two concepts of international law. The first is the right to self- defence.


The second is the right of hot pursuit in international law. In both cases, Kenya must set a specific reasonable time frame for its incursion.


An open ended intrusion into Somalia, no matter how noble the pursuit, will be a clear violation of international law.


It will also establish both state and individual responsibilities for specific Kenyan officials in the chain of command.


One of the difficulties facing Kenya is that self-defence under Article 51 of the UN Charter is always subject to a supervisory control by the Security Council.

Instability in kenya will affect us here in tanzania and I have no clue why we are not all supporting the kenyans. They are our brothers more than any other country. The TDF has seen combat that is true but they have not fought crazy people like alshabaab.The fall of Alshaaab would benefit everyone on the Indian ocean coast.
A southafrican couple sailed from the Dar Yatch club one year ago and were kinapped off the tanzanian coast and they have not been released. Should Alshabbab come here and take our guests and we say nothing?They are a tough enemy to beat and we should commend the Kenyans for being brave enough to fight this unconventional miraa chewing mad men.

Hundreds of Somali nationals living in Minneapolis, Minnesota in the US held a demonstration over the*weekend in support of Kenyan troops that are currently deep inside Somalia hunting down Al Shabaab militia.

Gange said Shariff does not represent the interests of all Somalis. He said the President knows very well that the safety of peace loving Somalis and even his own is at stake with the marauding Al Shabaab controlling big swaths of the country.

"He is being driven around in an armored Amisom tanks from the airport to the presidential palace for fear of being attacked by Al Shabaab but he is not ready to get help from a friendly neighbor who is ready to assist us crush this group" he added.

Speaking at the same event, Ugaas Mohamud Unshur said he had not expected President Shariif to say those words adding that the President should apologize to the Kenyan government for that diplomatic embarrassment. He urged President Sharrif to change tact and work with Kenyans to root out the Al Shabaab.

He appealed to Kenyan troops to remain in Somalia until they liberate the volatile southern part of the country and restore peace for innocent civilians who have never known peace under Al Shabaab occupation.

"Let us be honest with each other, Kenya has no intention of occupying our land. Kenya is only there to defend itself against foreign aggressors that have constantly attacked and taken hostages and aid workers thus threatening peace and the its tourism industry. Whoever does not support Kenyan troops that are on a mission to flush out these terrorists is an enemy of our people" Unshur added.

The apparent support of Kenyan incursion into Somalia by the Somali Diaspora especially those living in Minnesota is a game changer in because the Minnesota Somalis have been accused of being the source of Al Shabaab funding.

It is believed that some of the Minnesota Somali youth have been recruited and are fighting alongside Al Shabaab. In fact only last week, two Somali women were charged in Minneapolis court with fundraising money for the Al Shabaab and are waiting to be sentenced. The US government announced last year that it had charged 14 people as participants in "a deadly pipeline" to Somalia that routed money and fighters from the United States to the terrorist group Al-Shabaab.

At least seven of the 14 people charged were US citizens and 10, all from Minnesota, allegedly left the United States to join Al-Shabaab. Seven of the 10 had been charged previously in the probe.

Minnesota is home to about 70,000 Somalis who were resettled there after the collapse of President Siad Barre’s government in 1991. A group of young Somali men are believed to have left Minnesota to go and fight alongside the Union of Somali Courts in 2007 when Ethiopian troops invaded Somalia to help the transitional government of Abdullahi Yusuf.

We have discussed about this (pot calling kettle black) issue numerous times in the past, unfortunately when new guys arrive they don't dig past threads so it start all over again....:lol:

Nevertheless, most people here do support the Kenyan course of action in this war.

Somali rebels on Monday vowed to avenge a deadly Kenyan air raid as the two countries' prime ministers met over the controversial military assault launched by Nairobi two weeks ago.

While both Kenya and the Somali government are battling the al-Qaeda-linked al-Shabaab insurgents, Nairobi's decision to send troops and warplanes across the border had caused unease in Mogadishu.

A raid on a southern Somali town on Sunday killed at least five civilians, including three children. Kenya insists it hit an al-Shabaab target but witnesses and aid sources said one bomb ploughed into a camp of displaced civilians.

"Kenya has brutally massacred civilians already displaced by hardship ... We will ensure that Kenya mourns more than we did," a regional al-Shabaab official Sheikh Abukar Ali Ada told reporters.

"They cowardly killed around 15 civilians. We will similarly target them and take revenge," Ada said.

Doctors Without Borders said at least five civilians were killed in the air raid, which struck a camp hosting 9 000 internally-displaced Somalis in Jilib.

"We would like to minimise any collateral damage that happens, but incidents can happen," said Abdiweli Mohamed Ali, the prime minister of Somalia's Western-backed Transitional Federal Government (TFG).

"Any loss of life of a Somali is a tragic loss to all of us," Ali told reporters in Nairobi, after meeting with his Kenyan counterpart Raila Odinga.

51 Al-Shabaab Youth Fighters Surrender to TFG
Surrendered Al-Shabaab Youths

Somalia's security agency on Monday displayed more than 50 al-Shabaab fighters, mainly youths between 18 and 20 years old, who surrendered to Somali forces in Mogadishu.

Ibrahim Omar Aden, the spokesman of Somali security agency (CID), confirmed the young men surrendered to the government within the last three days and that they will be taken to a rehabilitation center.

"In the last three days we have received 51 young boys who were al-Shabaab fighters. We welcomed them with open arms because they are our generation," Ibrami said.

The fighters complained of lack of food and forced marriages during their time with the Islamic militants.

"We belonged to al-Shabaab for three years. I joined in 2008 as part of the the particular group of assassination (Amniyad). I operated in many parts of the country, but recently I was in Mogadishu," said Mohamed Ali Id, one of the youths who surrendered."

"We decided to give up because we have experienced many problems. Our leaders of al-Shabaab want us each to marry at least four women. Also, we didn't get any food when we were at the frontlines," he added.

This is the largest number of al-Shabaab fighters to surrender to the Somali government within a week.

Prime Minister Raila Odinga with his Somalia counterpart Abdiweli Mohamed Ali (today) Monday issued a joint communiqué on the combined military engagement by the two countries to eliminate the Al Shabaab.

Prime Minister Raila Odinga allayed fears that Kenya had intentions of curving off some parts of Somalia.

The ten point statement read by assistant Minister for Foreign Affairs Richard Onyonka to the press today explained that Kenya’s security operation inside Somalia aims at eliminating the threat posed by the Al Shabaab.

The communique clarified that the incursion is based on the legitimate right to self-defence under Article 51 of the UN charter.

The statement added that the attack is being led by the Transitional Federal Government (TFG) of Somalia forces with the support of the Kenyan defence Forces in pursuit of legitimate Al Shabaab targets.

It spelt out the agreement that Al Shabaab constitutes a threat to both Somalia and Kenya and is therefore a common enemy for the entire region and the world.
