Kuna siku niliwahi kusimamishwa na polisi wa defender wasio na uniform na kuitaka niwaoneshe leseni yangu. Nikawaonesha ila bado wakaniambia kuwa pamoja na kwamba nina leseni niwaachie hela kidogo wana kiu. Sikufanya hivyo wakaniacha nikaenda. Swali ni je sheria ya usalama barabarani ya mwaka 1973 inawaruhusu hawa kufanya kazi hiyo?. Nimejaribu kusoma na kukutya kuwa polisi mwenye uniform ndiyo anaruhusiwa kukusimamisha kwa kosa lolote la barabara na hasa katika kutaka kuthibitisha kuwa wewe unaendesha ukiwa na leseni halali.

Kumekuwa na tabia kwa baadhi ya polisi wengi sana hata wale wenye uniform kuwasimamisha madereva na kuomba vitu kama leseni au kadi ya gari n.k. Kama umevisahau wanakuambia kuwa umetenda kosa na kutumia mwanya huo kukudai rushwa. Nimesoma sheria inaweka wazi kuwa ni kweli unatakiwa kutembea na document hizo ila kama umesahau unatakiwa kuthibitisha kwa polisi ndani ya siku tatu. Kwa maana hiyo Polisi wachukue namba ya gari na kukutaka ukawaoneshe hivyo vitu ndani ya siku tatu.

Swali ni je kuna uhalali wa polisi kung'ang'ania watu hata kama wana documents na wamezisahau?, japo nisingependa tuwe tunasahau.

Nimetoa section 77 ya sheria ili tuijadili kwa wale wanaokumbana na matatizo ya Police wenye hulka za KI-MANUMBA, wanapindisha sheria na kudidimiza integrity of the Police Force Tanzania.

ENFORCEMENT



77.-(1) Every person driving a motor vehicle or trailer on a road shall carry his driving licence and, on being so required by a police officer, produce it for examination:

Provided that a person shall not be convicted of an offence under this section by reason only of failure to carry or produce his driving licence, if he produces it to the police within the following three days at such police station within Tanganyika as may be specified by the police officer at the time its production was required


-(2)Notwithstanding the provisions of subsection (1) of this section, any person intending to drive a motor vehicle or trailer over the Tanganyika border shall carry his driving licence, the certificate of registration and the insurance certificate in respect of such motor vehicle of trailer and shall produce the same on demand to a POLICE OFFICER IN UNIFORM or customs officer before he is permitted to drive his motor vehicle, or trailer across the Tanganyika border.

-(3) The provisions of subsection (2) of this section shall not construed so as to limit the authority of a customs officer or any other officer to require the production of any other documents required to be produced by any other written law at any customs post or any other post of exit from Tanganyika.

Mkuu ukisoma section ndogo utaona kuwa inaweka wazi. Huwezi kuwa convicted kwa kuendesha unlicenced kama tu utathibitisha kuwa una licence ndani ya siku tatu toka ulipotakiwa na polisi kuthibitisha. Maana yake ni kwamba utakuwa na kosa la kukutia hatiani kwa kuendesha ukiwa unlicenced mahakamani kama polisi wakikupeleka baada ya kukusubiri siku tatu kuwahakikishia kuwa una licence ila uliisahau nyumbani.

Hawa polisi wetu hawakupi mwanya huo. Wakikuuliza na bahati mbaya umesahau leseni nyumbani bsi hapohapo wanakwambia umetenda kosa na kukutaka uwape rushwa ili wasikupeleke mahakamani ambapo utakutwa na hatia. Tukizijua sheria polisi hawana mwanya wa kutubana kuomba rushwa katika hili. Unless uwe kweli hauna leseni.

Mkuu kuhusu fixed penalty charges ni kweli unatakiwa kulipa Fixed sum of TZS 40?(1973) withinn 28 days. Ila polisi wetu wanataka on spot kwa kuwa ni makusanyo yao ya siku. Wakikuandikia notice chukua endelea na safari utalipa ukipata ndani ya siku 28. Police wetu huwa wanatumia tactic ya kukuchelewesha na kukupotezea muda ili uwapatie hela uende zako. Nafikiri wanatakiwa kufanya kazi kisayansi sasa.

Kwa maana hiyo Polisi wachukue namba ya gari na kukutaka ukawaoneshe hivyo vitu ndani ya siku tatu.

Sheria hiyo ya mwaka 1973 ilifanyiwa marekebisho mwaka 1990, kwa hiyo unapoisoma ni lazima uisome pamoja na marekebisho yake.

Ndugu Hofstede nakushuru sana, kumbe hii ni janja ya polisi kufanya ufisadi dagaa, wanajifanya hata kanuni za natural justice hawazijui wakati sheria imejaribu kuziweka wazi.


Nashauri tuendelee kuipekua hii sheria tunaweza kuwalazimisha waishi kwa kutegemea mishahara yao na si rushwa kama ilivyo sasa.

Kweli kabisa na sijui hili tatizo litamalizikaje. Juzi nimesafiri toka Dodoma kuja dar pale Misugusugu kuna kibao cha speed limit ya Km 50 na wamekaa na camera na mie napajua vizuri sana . Nimepunguza mwendo mpaka hiyo hamsini lakini wanadai kwa vile kuna watoto wa shule maeneo hayo natakiwa nipite na 35km kwa saa. Nimebishana nao sana na wanasisitiza tusaidiane karibu robo saa nzima. Hawa ni majambazi na hizo camera ni miradi mikubwa ya kuwapatia pesa na chanzo kikubwa cha Rushwa na kadri wanavyozoea ndiyo wanakuwa na uchu sana wa rushwa. Hii haipunguzi ajali bali ni usumbufu kwa waendesha magari.
Hebu siku moja IGP aondoe camera barabarani halafu tuone ajali ngapi zitatokea kwa kuendesha mwendo kasi kwa sababu bado ajali zinaendelea kutokea na rushwa na usumbufu unashamili tu na diyo maana wengine wanasema wakuu wa polisi wanapata % ya hizo pesa zinazoporwa barabarani na hawa traffic polisi. PCCB nao wako katika usingizi mzito. Kilimanjaro jana madereva wamegoma kudai pesa kumezidi imezidi mno kupita maelezo na bado sehemu zingine mtasikia hivi karibuni . madereva wanateseka jamani.

mKUU UNANAICHEKESHA,hiyo act imeandikwa kingereza na ni traffic wangapi wanao jua kingereza?

Nafikiri BADILI yupo sahihi kabisa, kinachowapatia polisi nguvu za kukusimamisha ni hii sheria, kama utaitumia pia sheria hii hii kuwaonesha kuwa wanaivunja hawatakuwa na cha kukufanya maana mwisho wa siku watatakiwa kukupeleka mahakamani kukushitaki kwa sheria hii. Sema labla kama wataamua kuwa majambazi na kukudhuru kwa silaha walizokabidhiwa.

Akikusimamisha na kutaka leseni ukagundua umeisahau hawatakiwi kukutia hatiani on spot, wanatakiwa kukupatia siku tatu ukawaoneshe. Na hili unaweza kulifanya katika kituo chochote cha polisi Tanganyika. Ukijua sheria za msingi polisi hawawezi kukuonea, japo kwa Tanzania ya leo polisi wamekuwa wakivunja sheria bila kuwajibishwa. Tunatakiwa kuwa na Independent Police Complaints Commission (IPCC): Reviewing all complaints against police kutoka kwa raia. Siyo kuwa rais anaunda Tume kama ile ya kuchunguza vifo vya kina CHIGUMBI.

Katiba mpya inatakiwa kuweka wazi uwepo wa Tume huru inayofanya kazi permanent yenye uwezo wa kisheria itakayokuwa inaangalia ukatili na maovu yanayofanywa na POLICE. Yaani police wakishindwa kufanya kazi yao pia ni makosa na wakionea watu pia ni makosa. Tatizo ni kwamba POLICE imechukua role mpya ya kuwa 'Armed wing of political party'
 
Wakuu angalia tusiingizane mjini hapa. Kwa leseni ya kuendesha unaweza kuwapelekea ndani ya siku ya tatu lakini hakuna excuse kwa kutokuwa na registration kadi!!!

Mkuu Tiba soma Section 77(2). Kama unaendesha gari kutoka katika mipaka ya Tanganyika, unatakiwa kuwa na Leseni, Kadi ya gari, Cheti cha Bima ya gari. Section 77(1) imeweka wazi kuwa unapoendesha unatakiwa kubeba nini. Lengo la Cheti cha gari ni kuangalia ownership na kuzuia wizi wa magari.

Kadi ya gari pia si lazima uwe nayo. Hii ni miongoni mwa loopholes za kuombea rushwa. Kawaida kama gari imeibiwa namba Reg itakuwa polisi baada ya owner kuripoti. Mara nyingi dereva si mwenye gari.

Ila kitu ambacho naweza kubaliana na wewe ni kuwa dereva unatakiwa kuwa insured kwa jina lako kuwa kwenye insurance policy. Ukienda kukata insurance huwa unaulizwa nani na nani wataendesha. Maana yake ni kwamba mtu asiyekuwa insured akiendesha Insurance haiwezi kulipa kama mtu huyo anapata ajali na gari. Hili watu wengi hawalijui lakini polisi wanaweza kupatia ulaji hapa kama wataanza kufuatilia uendeshaji wa magari ya kuazamana yasiyo 'hire car'.
 
Wakikusimamisha usishuke akifika piga english utaona anakuambia don't do it next time then unaendelea utamsikia sir move the road.

Hili watu wengi hawalijui lakini polisi wanaweza kupatia ulaji hapa kama wataanza kufuatilia.

Mkuu, kilichosemwa kwamba unapewa siku tatu kumwonyesha polisi ni driving licence, hivyo vingine vilivyotajwa kwenye hiyo section unyoisema with exception of driving licence inabidi uwe navyo on the spot, no excuse unless uelewa wangu wa lugha za kisheria ni mdogo.

Kwenye hili nako ikoje, hawa police inaonekana kama wameifuta hiki kifungu, hawakubali uondoke hadi ulipe faini, kwa mnaojua sheria mtusaidie
