Maximum job probation period!

Wakuu naomba kujua kama kuna maximum probation period, na je mtu aliyekaa kwenye probation time zaidi ya miezi 20,job termination yake itakua sawa na yule aliekaa kwenye probation time for 6 months!!!
 
ok mkuu suala la probation kazini inabidi katika sehemu husika uliyo ajiliwa watakua wamekueleza ni kipindi gani utakua ktk probation.ieleweke kua hata kama kipindi utakachokua umeelezwa kua kimeisha hiyo haimaanishi wewe kua umemaliza probation period yako.yan sio kwamba unakua automatically confirmed,mpaka uwe umepata hiyo barua kukukomferm kua umemaliza probation period yako na kwa mameno ya kikazi wanasema kua wino umekauka.kwa kawaida probation si chini ya miezin sita
sasa basi wanaweza kukuterminate or dismissed baada mfano wa miaka 2 na huku probation yako walisema miezi sita ila ilipopita miezi sita hukupewa barua.wewe unaweza kua umekaa unajua ooh hapa ushakua confirmed na ukafungua kesi aisee imekula kwako.yani the fact muda umepita wa probation sio kigezo cha ww kusema umepitishwa ni mpaka upewe barua

okay!! nimekupata mkuu, ila vp inamaanisha kama job offer letter ilikua inasema probation ni miezi sita, baada ya kupita hiyo miezi sita muajiri hatakiwi kutoa notification yoyote kwa muajiriwa kwamba probation yake itakua extended kwa muda flan!!??, yaani kwamba mtu unaweza kukaa probation for three years without being informed the duration of your probation!!??, na je vp kama mtu amekaa under probation zaidi ya mwaka na hajawa confirmed anaruhusiwa kuchukua likizo!!??

okay nimekupata sawa sawa mkuu, sasa hii sheria ya kazi inaposema "the period of probation should be of reasonable length of not more than twelve months, having regard to factors such as the nature of the job, the standards required, the custom and practice in the sector na maelezo mengine yanayofuata" ni uyeyushaji tu!!!

Waheshimiwa mimi nina mawazo tofauti, ingawa pia nakubalina na vipengele mlivyoquote ni sawa kabisa. Ila tunachotakiwa kujua kwanza nini mantiki ya kuwa na probation period?? Dhumuni la probation period ni kwamba mwajiri na mwajiliwa wote wawili kuangalia kama wanaweze kuendelea na mahusiano yao kwa maana ya mmoja kumtumikia mwingine. Kwa hiyo hata mwajiriwa anaweza kuancha kazi kwa sababu hajalidhika na mwajiri wake wakiti akiwa kwenye probation period.

Kwa mujibu wa sheria kama ilivyoainishwa hapa juu kuwa "........ not more than twelve months" now that is the rule.... hii ndio sheria kwamba probation period haitakiwa kuzidi miezi kumi na miwili (mwaka mmoja). Kama mwajiri ataona kuwa huyo mfanyakazi hamfai na ameshafanya zaidi ya miezi sita kazini, basi anatakiwa kumwachisha kwa mujibu wa sheria kama ilivyoainishwa Rule 10 ya G.N.No 42. kufanya.

Lakini akisubiri mwaka uishe halafu anakuja na swala lakukuachisha kazi under probation ukweli hatokuwa sahihi katika hilo. Pia kama kwenye mkataba alisema probation ni miezi sita, mwajiliwa unatakiwa kumkumbusha mwajiri kwamba miezi sita imeesha. Kwa hiyo kwa kifupi ni kwamba kama muda umeisha wa probation na mwajiri amemwacha mwajiriwa afanye kazi bila kumwambia kuwa amekuwa confirmeed or not basi hiyo kisheri ni kwamba amemconfirm. The same knowledge za expection ya fixed term contract kuwa renewed pia kwenye probation inaingia the same way.

likizo unaweza kuchukua hata kama hujawa confirmed,ila ni lazima uwe umeshafanya kazi kwa consecutive 12 months,ndo unaweza kupata likizo
