THE country’s anti-graft watchdog, the Prevention and Combating of Corruption Bureau (PCCB), Katavi Region, has arraigned four senior officials of Mpanda District Council and a local civic contractor for allegedly embezzling over 186m /-, property of the government, between 01 Dec, 2011 and 02 January , 2012.'
The accused officials include Mpanda District Council Engineer, Engineer Godfrey Majuto being the first accused, Ms Naomi Nnko, former Mpanda Acting District Council Director who is now a Magu District Council Director (second accused ) and District Civil Engineer, Eng Petro Mwanoni (third accused).
Others on the list are Civil Engineer, Engineer Beatus Bisesa and a civil contractor (fourth accused ), Chiyando Mtoke of M/S Matoke Construction Professionals and General Enterprises Ltd being the firth accused.
However, the third and fourth accused respectively did not appear before the Mpanda District Magistrate’s Court presided by a trial magistrate Mr Chiganga Ntengwa on Thursday.
Trial magistrate Mr Ntengwa told the court that the Director of Public Prosecution (DPP) allowed the Mpanda District Court to try the case because the lower court had no such mandate owing to the amount of 10m/- involved in the case10m – being colossal caused by accused are tried by higher court .
Prosecuting , PCCB ‘s lawyers Mr Bahati Haule assisted by Mr Simon Buchwa told the court that being the economic crime case number one of 2016 the first, second third and fourth accused faced charge of first count, committed the crime on January 02, 2012 at Mpanda District in Katavi region.
It was further alleged that on that material date the accused being employees of Mpanda District Council with intent of defraud or deceive its employer, knowingly used interim certificate no 1 , dated January 02, 2012 containing false particulars purporting to show that the periodical maintenance of a section of the road that linked Nsemulwa –Mtapenda and Kasokola villages was completed’.
That the contractor , Chiyando Mtoke of M/S Matoke Construction Professionals and General Enterprises Ltd deserved the payments of 64,376,152- Similarly , according to the prosecution side the same accused also faced second charge count of abuse of office contrary to section of prevention and combating of corruption act, no 11 of 2007.
That on January 02, 2012 the accused intentionally abused their power of office by authorizing payment of 64,376,152/- to M/S Matoke Construction Professionals and General Enterprises Ltd via interim certificate no 1 dated January 02, 2012 and saying that the firm had completed periodic rehabilitation on the section of Nsemulwa – Mtapenda – Kasokola road.
It was further alleged that all five accused facing the third count of organized crime, between December 01, 2011 and January 02, 2012 together and jointly by their unruly acts caused the Mpanda District Council to suffer fiscal loss of 61,157,344.40/-
