A glimpse into Makau Mutua’s thick CV submitted to panelists

Law professor Makau Mutua Judicial Service Commission did not open controversial law Professor and Chief Justice applicant Makau Mutua’s comprehensive resumé.

In the 84-page CV, the bit that touched on his education was barely few paragraphs. The rest of it was swallowed up by his academic work— publications, papers, articles, books and seminars.

Although Mutua enrolled at the University of Nairobi in 1979, the CV shows, the only qualifications he attained at the university were being a finalist of the moot court competition in 1990 and serving as Secretary General of the students union in 1981. It is in the neighbouring Tanzania (University of Dar es Salaam) where Mutua eventually got his bachelor of laws (honours) in 1983 before enrolling for a masters degree in 1984 at the same university.

He moved on to Harvard Law School for another master of laws (LLM) in 1985 and doctor of juridical science (SJD) in 1987. From the CV, his teaching career began at University of Dar es Salaam where he taught international trade in 1983 and 1984.

He went on to teach at the State University of New York, University of Deusto Bilbao, Spain, United Nations University for Peace Costa Rica, University of Puerto Rico School of Law San Juan, University of Iowa College of Law and Harvard Law School.

To vouch for his legal experience, Mutua lists his experience as International Human Rights Law Group Ferguson Fellow for the year 1985, legal advisor for Litvin, Blumberg, Matusow & Young Philadelphia, associate at White & Case New York, director of African project for Lawyers Committee for Human Rights New York (1989-1991) and his current job as Human Rights Advisor for the World Bank in Washington DC. Three pages of the CV are consumed by the awards and honours he has received in the course of his life. Mutua also attached with his CV four of his publications— Human Rights Standards: Hegemony, Law, and Politics, Albany, New York: SUNY Press (2016), Human Rights NGOs in East Africa: Political and Normative Tensions [editor], Kenya’s Quest for Democracy: Taming Leviathan, Boulder and Human Rights: A Political and Cultural Critique.

Articles, book chapters and reviews devoured seven pages of the CV while reports and policy documents knocked off two other pages.

But it was “newspapers and magazines” articles which took the best of the CV’s pages—39 pages! Without flinching, Mutua listed all newspaper articles he has written while working as a columnist for the Sunday Nation and The Standard on Sunday.

Among the controversial articles he listed are “Attorney General has been misused and should resign,” “Obama’s visit served to endorse an undeserving regime,” “There are warning signs Jubilee team could be sent home in 2017,” and “Why I won’t refer to Uhuru Kenyatta as the President.” Others are “Four reasons why Kenya can’t be ruled from The Hague,” “Gay and Lesbian Kenyans are a social reality,” ”Why the Uhuru-Ruto alliance is a ticket to nowhere,” “I am convinced that Uhuru is his own worst enemy,” “Why Eldoret North MP should not dine with reformers,” “What if Ocampo were to indict Uhuru?” and “Ruto has taken a path to political oblivion.”

Smokin Wanjala is a Kenyan lawyer and an Associate justice of the Supreme Court of Kenya. He holds a Ph.D in Law from University of Ghent, Belgium . He also holds a Master of Laws degree from the Columbia University in the United States of America and a Bachelor of Laws (LLB) Degree from the University of Nairobi. Dr. Wanjala lectured at the University of Nairobi for 15 years where he taught International Law, International Human Rights Law, Land Law and Criminal Law. While still lecturing at the University of Nairobi, he was appointed by President Kibaki to serve as the Joint Secretary to the Commission on Illegally and Irregularly acquired Public Land (the Ndung’u Commission) in 2003. He is credited with having overseen the compilation and writing of what has become popularly known as the Ndung’u Report. Justice Wanjala was the first Chairman of the Public Complaints Committee on the Environment (PCC), which is one of the Compliance Committees of the National Environment and Management Authority-NEMA.

He has many publications to his credit including books and articles in the fields of Law, Human Rights and Governance. He has published locally and internationally. Apart from his accomplishments in academia as a Law Teacher and Author, Justice Wanjala has participated in major research projects leading to the compilation and production of seminal reports such as The Anatomy of Corruption in Kenya, the Governance, Justice, Law and Order for Kenya (GJLOS 2) and the Policy and Governance Framework for the Republic of Malawi.

Justice Wanjala was actively involved in the struggle for Constitutional Reform in Kenya especially during his time in Civil Society in the 1990’s. He was one of the four founder members of the Centre for Law and Research International (CLARION) where they pioneered Civic Education in the country. He is a member of the
International Commission of Jurists, ICJ-Kenya Chapter and the Kenya National Academy of Sciences. He has recently delivered lectures at the International Anti-Corruption Academy (IACA) during the Institution’s Summer Lecture Series.

Smokin Wanjala kwa maoni yangu is the best option for the CJ job.
Lakini nakusupport Geza kwa hili, Makau Mutua was among the top choices for me too given his qualifications, sijui mbona he didn't make to the 6. I guess Kenya has many learned friends nowadays mpaka umdhaniye ndiye siye.

UDSM was and still is the best law school in Africa. Kuna wakenya weeengi mno huku, Ugandans, Nigerians, South Africans e.t.c.

Makau has a very partisan outlook and very obvious loyalties judging from his press articles . I love his articles, not only for their boldness, but he doesn't give a damn about how people react to them. Being the Dean of a law school, his academic nous is not in question, as are the others, so it boils down to some finer details which i suspect may be character related.
I must confess siwajui kitabia (i. e courtroom behaviour ) ,so this is for the legal brethren to guide us. What am sure about is the next CJ will not be wearing earrings!!

There are many law schools in Africa. UDSM has one. On what basis do you say UDSM has the best law school??
 
Like is said, law schools zipo nyingi ukitaka top 10 chagua yoyote : EAC imewakilishwa na UoN na UDSM. List hapa: Ranking Of Top Ten Best Law Universities In Africa
Cha muhimu kukumbuka ni kuwa hizi top schools kwa desturi yao hupata wanafunzi wengi top performers wa nchi mbali mbali. Sio ajabu kukutana nao kwenye nyadhifa za juu sekta za umma/binafsi

It is a well known fact. Back in the days of the University of East Africa the Tanzanian branch handled law. Many of wazee wa enzi zile walisoma hapa. We've produced so many senior high calibre judicial officers for EAC and SADC countries!

The Constitution states that for one to be a CJ in kenya you should've been a magistrate unfortunately for mutua this is not the casy
