1. Aquisition of land by dverse posession doese not apply to public land. The land on which Kibera slum is located is not private land, but still public land.

2. As such, the Government can reclaim it's land without consulting anyone. A proper notice to vacate is all it needs to give to anyone currently on the land in question.

3. Even if the land was privately owned, the state can aquire the land under what is termed as "COMPULSORY AQUISITION" . This occurs where the Government compulsorily takes the private land for Public Use. For instance the way it aquired the land for construction of the SGR. All it is required to do (as it did) is buy the land from the owner at market value, factoring in the loss of income if the land owner used it for income generation.

The government should have compensated these people. A government that does not care about it's poor people does not deserve any respect. Whether it was government land or not, whether notice was given or not; these people should have been compensated out of goodwill. On this one this government imeniangusha vibaya sana. I feel for those poor people. I can only pray for them.
