Sheria inasema nini kuhusu Kujumlisha kura za wagombea Uraisi na Kutangaza matokeo.
Wakuu,
Nimetonywa na chanzo kinachoaminika kuwa M-Kiti wa Tume ya Uchaguzi akisha pata jumla ya kura walizopigiwa wagombea Urais, anaichukua jumla hii na kuipeleka kwa Rais kupata kibali chake kabla hajatangaza mshindi. Huu unaelekea kuwa ndiyo utamaduni umekuwa ukitumika lakini ijulikane kuwa ni utamaduni mbaya sana kwani Rais mwenyewe ni mdau mkuu katika hicho kinyanganyiro na zaidi ya hayo NI KINYUME NA SHERIA.
Sheria ya Uchaguzi The National Elections Act inaweka bayana kabisa mambo haya:
(i) Kwamba kura zote za wagombea Urais zinajumlishwa katika vituo vya kupigia kura na kutangazwa hadharani.
(ii) Taarifa zote za matokeo ya kura kituo kwa kituo zinapelekwa kwa msimamizi wa Uchaguzi wa jimbo naye
(iii) Anajumlisha kura za vituo vyote na kuweka matokeo hayo hadharani (display such results at a conspicuous place)
(iv) Kisha anatuma matokeo ya Jimbo lake kwa Tume ya Uchaguzi na kuwapa wawakilishi wote wa wagombea nakala yao.
(v) Baada ya Tume kujumlisha matokeo ya uchaguzi kutoka majimbo yote itatangaza matokeo ya Uchaguzi kwa nchi nzima
(vi) Yule atakayetangazwa kuwa Rais mchaguliwa ni Yule atakayekuwa amepata kura nyingi zaidi ya wengine
Kwa hiyo,
(i) MATOKEO YA KURA ZOTE HADHARANI, ZA VITUO VITUONI, ZA MAJIMBO MAJIMBONI AMBAZO ZINAJUMLISHWA NA KUTANGAZWA HADHARANI KAMA MATOKEO YA KURA KITAIFA.
(ii) HAKUNA POPOTE KWENYE SHERIA YA UCHAGUZI KUNAPOMKATAZA MTU YEYOTE KUJUMLISHA MATOKEO YA VITUO KUPATA YA JIMBO, AU YA MAJIMBO KUPATA YA TAIFA.
(iii) HAKUNA NAFASI KATIKA SHERIA YA UCHAGUZI INAYOMTAKA WALA KUMRUHUSU M/KITI WA TUME YA UCHAGUZI KUPELEKA MATOKEO KWANZA KWA RAIS ALIYEKO MADARAKANI AU KUOMBA KIBALI CHAKE KABLA YA KUTANGAZA MATOKEO.
(iv) TUME INALAZIMISHWA NA SEHERIA KUMTANGAZA MSHINDI YULE TU ALIYEPATA KURA NYINGI KULIKO WENZAKE NA SIYO MWINGINE.

Sec. 45. Addition of Presidential votes
[Acts Nos. 18 of 1995 Sch; 4 of 2000 Sch.]
(1) After all the reports of the results and the ballot boxes containing the ballot papers relating to Presidential election, have been received from all the polling stations in the constituency, the Returning Officer shall, after determining the validity of any disputed votes, add together the figures of
(a) all the votes cast in the constituency;
(b) the votes in favour of each candidate;
(c) the rejected ballot papers.
(2) The Returning Officer shall, after compiling the Presidential results in the constituency, display such results at a conspicuous place.
(3) The Returning Officer shall prepare and submit to the Commission a report of the partial results of the Presidential election in the constituency.
(4) The Commission may direct that the Returning Officer shall, after preparing the report of the results under subsection (2) of this section, display a copy of the report in some conspicuous public place.
(5) The Returning Officer shall certify and give a copy of the report to each of the polling agents or if present, to the Presidential candidates.
(6) The Commission may, where there is any doubt as to the accuracy in the addition of Presidential votes in any constituency, require the repetition of the addition of the figures from the partial results from some or all of the polling stations in the constituency.
(7) Subject to subsection (2), the Commission shall, after adding together all the respective totals submitted to it by each Returning Officer in accordance with subsection (2), declare the results of the Presidential election in the country.
(8) A Presidential candidate shall be declared to have been elected President if he receives the greatest number of all the valid votes cast.
