Chief Justice Martha Koome has listed nine issues the Supreme Court will address in the Presidential petition during the pre-trial conference on Tuesday, August 30.
The issues listed by Koome were as follows;
Whether the technology deployed by IEBC for the 2022 General Election met the standards of integrity, verifiability, security and transparency to guarantee accurate and verifiable results
Whether there was interference with uploading and transmission of Forms 34A from polling station to IEBC public portal.
Whether there was a difference between Forms 34A uploaded on IEBC public portal and Forms34 A received at the national tallying centre and Forms 34 A issued to agents at polling stations.
Whether the postponement of gubernatorial elections in Kakamega and Mombasa Counties, parliamentary elections in Kitui Rural, Kacheliba Rongai and Pokot South Constituencies and electoral wards in Nyaki West in North Imenti Constituency and Kwa Njenga in Embakasi South Constituency resulted in voter suppression to the detriment of Azimio la Umoja Presidential candidate Raila Odinga and his running mate, Martha Karua.
Whether there were discrepancies between votes casts for presidential candidates and other elective positions
Whether IEBC carried out verification tallying and declaration of results in accordance with the provisions of Article 138 (3c) and Article 138 (10) of the Constitution.
Whether Ruto, the declared president-elect attained 50 per cent +1 in accordance with Article 138 (4) of the Constitution.
Whether there were irregularities of such magnitude as to affect the final results of the presidential election.
Other reliefs and orders the court can issue.
The apex will base its ruling on the nine issues when delivering its verdict on Monday September 5.
During the hearing, only four lawyers representing each party in the presidential petition will be allowed into the court chambers.
At the same time, the Supreme Court consolidated seven petitions challenging Ruto's win. Defending her move, Koome noted that the seven petitions sought to overturn IEBC's decision to declare Ruto President-elect.

4. Iwapo kuahirishwa kwa Uchaguzi wa Ugavana na Ubunge kwa baadhi ya maeneo kulisababisha wapiga Kura kuikandamiza Azimio, Mgombea Urais Raila Odinga na Mgombea Mwenza Martha Karua.
5. Iwapo kulikuwa na tofauti kati ya Kura zilizopigwa kwa Wagombea Urais na nafasi nyingine za Uchaguzi.
6. Iwapo IEBC ilitekeleza Uthibitishaji wa Kujumlisha na Kutangaza Matokeo kwa mujibu wa masharti ya Kifungu cha 138 (3c) na Kifungu cha 138 (10) cha Katiba.
7. Iwapo Ruto, Rais Mteule aliyetangazwa alipata 50% +1 kwa mujibu wa Kifungu cha 138 (4) cha Katiba.
8. Iwapo kulikuwa na dosari za ukubwa wa kuathiri matokeo ya mwisho ya Uchaguzi wa Urais.
9. Pamoja na Msaada mwingine wowote na Maagizo ambayo Mahakama inaweza kutoa Jumatatu ya Septemba 5,2022.
