Eldoret North MP William Ruto has said the initial agreement to hand Musalia Mudavadi the Jubilee Alliance presidential ticket was untenable.
Mr Ruto said the secret pact that would have seen Uhuru Kenyatta cede his presidential bid in favour of Mr Mudavadi did not work because there was a "constituency which did not make things happen".
"There was a challenge following the agreement," said Mr Ruto on Wednesday during Citizen TV's morning show Cheche.
The United Republican Party (URP) leader said Mr Kenyatta had good intentions when he co-opted Mr Mudavadi into the Jubilee Alliance and wanted things to work deep down in his heart.
"He (Mr Kenyatta) had good intentions but it looks like those other people did not," said Mr Ruto without elaborating.
Following the impasse, Mr Ruto said Mr Kenyatta and himself had to ponder available options of consensus and nomination through a national delegate systems.
He said Mr Kenyatta and Mr Mudavadi will now have to slug it out through a nomination process with the winner flying the Alliance's flag.
On Tuesday, Mr Mudavadi said Mr Kenyatta had agreed to step down for him.
However, Mr Kenyatta, while conceding that there was such an agreement, said The National Alliance (TNA) delegates had rejected it outright.
Mr Kenyatta claimed that he was forced to sign the agreement with Mr Mudavadi after being blackmailed by "dark forces" whose identities he did not reveal.
"Yes, I signed the agreement after being compelled to do so by dark forces who claimed that a Kikuyu can't be elected and that foreigners will suspend aid to Kenya," he said.
On Wednesday, Mr Ruto said Mr Kenyatta was a human being and could have been persuaded to sign the deal.
The Eldoret North MP defended the decision to vie for elective posts despite facing crimes against humanity charges at International Criminal Court (ICC).
He said Mr Kenyatta and himself could not subordinate their constitutional rights for mere allegations and falsehoods.
"If we had participated in a coup to make ourselves get into government it would be untenable.
"But if we participated in a democratic process and we are elected, who are you to tell millions of Kenyans that you cannot elect Uhuru Kenyatta and Willliam Ruto?" he posed.

Msingi wa yote ni mudavadi hataweza kuikaidi kauli wanachama watakaoipitisha jumamosi ijayo. Atajaribu lakini kwa aibu yake mwenyewe. Ikiwezekana, awarai wanachama kwa mazungumzo na sio kuwalazimisha kwa mikataba. Ikumbukwe pia wanachama wana haki ya kumchagua kiongozi wanaomtaka bila ya kuwekewa vikwazo vya mikataba. Ingekuwa busara kwa mudavadi kuwasiliana na mwanasiasa wa kabila lake kama Eugene Wamalwa ili kutengeneza pa kuepukia mapema kabla ya aibu kumpata. Hafadhali apeleke kuuza kura zake za ubunge kwa CORD maana watakubali consensus, akitaka uokozi wa wadhifa wake.
Ikatokea kuwa Mudavadi ataondoka kutoka kwa chama cha Jubillee, atakuwa anapata funzo kamili, ya umuhimu wa kujenga chama cha kudumu na sera madhubuti kama ODM na TNA walivofanya. Kalonzo na wiper wakaona haya mapema kwa kuingia kwenye ODM, na huku ndio kutaongeza kutanga tanga kwake mudavadi akitafuta pa kujiweka. Au pia ikiwezekana, aende kwake peter kenneth na Tuju kujaribu kuwakalia kule kwa mikataba!
Japo hata mudavadi ataamua kuondoka TNA, yeye na chama chake ndio watapata hasara licha ya kuwa hawakutia juhudi katika kampeini zezote za jubilee. Ninatazamia siku za hivi karibuni mudavadi kuweza kujenga chama chake na kuikampeinia kutumia rasilimali zake na tajiriba yake ya kisiasa. Kwa sasa anatazamia kuchuma pale ambapo hakupanda.
Niulize pia kwa nini masaibu ya uhuru na tuhuma za ukabila yanakua vigezo katika majadiliano hapa? Namuona mfianchi vile debate zake zinaegemea. Hawezi waondoa akina musalia makosa, bila kukemea uhuru na swali la ukabila. Yaonekana watanzania wamechoshwa ubongo na siasa zao za chama kimoja. Wanapendezwa na sarakasi ndani ya siasa za Kenya. Karibuni. Lakini napenda siasa za kenya kwa kuwa, the will of the people will always prevail. Huyu mudavadi anataka vya ubwete, ambayo ni hatari. Nilisema Uhuru kumwachia Mudavadi kama mfano tu,wala sikusema ndicho hatua jubilee itachukua. Kumbuka mimi sitazami tabia ya kabila fulani, natazama tabia ya mtu binafsi..maana ni rahisi mtu mfedhuli kutumia tabia ya wakikuyu kama kivuli cha kupata umaarufu. Kila mwanadamu ana madoadoa yake......... naamini.
On your earlier inference I agree that mudavadi is and will always be a flop but the legal consequences will affect Uhuru as an individual, not jubilee. Such is the politics mudavadi inherited from ODM of signing deals
. If mudavadi is looking to muscle his way to the top through legal cases, then he is compromising his own chances and credibility as a coalition partner and without question, the coordinating committee will be forced to take a decisive course of action against these errant partners. Looking at it critically, there is going to be an election, and the biggest question will be what mudavadi will be bringing on the table finally.
If he decides to go out, the playfield will be unpredictable. And it sets the stage for a more volatile and charged political atmosphere than 2007/08. Some are already anticipating wins despite the odds challenging their coalitions. So now the question remains will the loser agree to have lost the election?
I dont like the sounding of it since it implies that we as Kenyans, we will be a society full of anxiety for some 5-6 months from now but theres no other easy way out either. Without delving into much, al leave it at that.
About Uhuru/Mudavadi dance with the devil, am of the opinion they pretty made their bed on 4th Dec. Whether they go full throttle on each others throats its a jubilee affair, however it speaks volumes of the character and integrity of one "Uhuru Muigai Kenyatta" and his antiques to ascending to power. Just wondering what if Raila did the same what would have happened, no need speculating. Holding the peace and act together.
