    Huu ni mwezi wa tano sasa umepita, mpangaji wangu hataki kunilipa,nimempa notice, lakini bado anaendelea kukaa,nimejaribu kufatilia sheria inasemaje, kuna watu wameniambia niende mahakamani, kuna wengine wameniambia sitakiwi kwenda mahakamani, naweza kumtoa kwa nguvu, au kutumia madalali tu. msaada wenu wana jf, kama kuna watu wana jibu sahihi watuelimishe

    Nadhani hujajibu swali la MH Hafif kutokana na swali lako la msingi. Issue hapa ni kwamba umempa notice lakini bado hajatoka.

    Sasa unaweza kujibu swali la HM Hafif kuwa mkataba wenu unaseaje? (kama mpangaji akipewa notice)

    Je, ulimpa notice ya muda gani? Je Notice muda wake umepita?

    Kama notice muda wake umepita, basi shauri lako inabidi ulifikishe kwa mwnasheria wako ili mpangaji wako umshughulikie kwa mujibu wa sheria za madai.
    Huna haja tena ya kufanya naye maongezi ni wakati muafaka kwa sheria kuchukua mkondo wake.

    kuna sheria mpya ambayo inatumika sikuhizi..mpangaji ni mtu anayeingia mkataba wa kukaa kwenye nyumba kwa malipo na muda unaofahamika...sheria sikuhizi inatambua nyumba kama biashara na ndio maana wapangaji wa NHC walipandishiwa kodi na kutolewa kwenye nyumba walizoshindwa kulipa kodi...mkataba unapoisha sikuhizi hakuna notice..naona umekuwa mstaarabu sana kwa kutumia mkataba wa miaka mi-3 nyuma wakati huo magufuli akiwa waziri wa nyumba na makazi...

    HITIMISHO....mtoe huyo mpangaji wako kwa nguvu na mpeleke mahakamani kwa kukaa kwenye nyumba yako bila kulipia kodi kwa kipindi chote mkataba ulipoisha ,...na unaweza pia kuzuia vyombo vyake mpaka atapolipa kodi...na hutakiwi tena kutoa notice za kizamani za mieziu mi3...mkataba ni mkataba kama mingine habari za notice zilikuwa za kijima enzi za nyerere...sahivi sie mabepari....mpige nje then yeye ndio aende polisi na mahakamani kushtaki

    Labda kwa kuanzia nenda kwenye ofisi ya mtendaji uulizie jinsi gani unaweza kutatua tatizo hilo....! Nakumbuka notisi huwa ni miezi mitatu na mhusika kama akijitetea vizuri muda wote huo atakaa bure. Nilishawahi kushuhudia incidence kama hiyo long time uswazi.....! Ni vizuri ukatumia busara za viongozi wa serikali ya mtaaa na kata, ukienda mahakamani ni kupoteza muda tu......!

    Hapa sina cha kukushauri,sababu mimi mwenyewe nilimfanyia mwenye nyumba wangu hivyo hivyo,nilipoamua kuondoka nikafungia vitu vyangu ndani ya nyumba yake miezi miwli ndio nikavifuata!!

    Jamani kuna umuhimu wa MaGT kusoma sheria mbalimbali na kuzielewa hasa zile zinazotukubili kila siku.

    Gambler, kwanza sheria inasema kuwa huwezi kumfukuza mpangaji kinguvu nguvu bila kufuata taratibu za sheria. EVICTION IS ILLEAGAL. Hii ni bahati mbaya kwa kuanzia.

    Mpangaji akivunja makubaliano, umamwandikia notice ya siku 30 na unaikopi kwa mahakama ya nyumba.

    Siku 30 zikiisha , unakwenda mahakamani kuomba eviction order, kielelezo kikiwa ni hiyo kopi ya notisi. Mahakama itakupa order ambayo pia huwezi kuitumia mwenyewe kufanya eviction hiyo. Unakwenda kwa Auction agent aliyteuliwa na mahakama ambao ndio watafanya evivtion . Hii sio kitu ya mara moja . Inaweza kuchukuwa ages . Si mnajua tena habari za mahakama? Hamnaga haraka kule.

    Ukifanya tofauti unaweza kushtakiwa na huyo mpangaji ukapoteza. Be carefull na uelewe kuwa mahakamani anaweza kutoa sababu zilizomfanya akashidwa kulipa kodi kwa muda uliotaka na akakubaliwa. Worse ni pale ambapo kodi yenyewe ni advance rent yaani miezi sita au mwaka kabla hajakaa. Hii inaweza isiwe defaulted rent kama ile ambayo ameshakaa -arrears.

    Inawezekana kuna kitu mmetofautiana na mpangaji wako au la ana matatizo yake binafsi makubwa lakini hapo issue ni kwenda mahakamani.. mahakama ipo kwaajili ya wavunja sheria, ukimtoa kwa nguvu inamaana hata iyo pesa yako ya miezi mitano unaweza kuikosa,wakati bado yupo hapohapo kwako mpeleke mahakamani mmalizane kabla hajahamisha vitu vyake,na itakuwa rahisi sana ku-manage asijetoroka

    Mfamaji angalau umepigia mstari maneno yangu kwa kufafanua zaidi!
    Kama ameshalamba mwezi wa tano na hajalipa............umeweza kuvumilia hayo yote, ni vizuri kupitia ngazi ya serikali ya mtaa ili kuona utatuzi unaenda vipi. Mimi naimani akiitwa kwenye baraza la ushauri la mtaa/kata atatoa maelezo mahsusi ambayo itakuwa ni hatua nzuri ya kuchukua hatua zaidi zinazofaa! Suala la mahakama kwa hatua hii ya awali mimi nakushauri kwa moyo mkunjufu achana nalo......!

    Kuna mtu kamkamata mwizi na upelelezi umekamilika lakini kesi zinapigwa danadana mahakamani haisikilizwi, sasa ije kuwa wewe mtu halipi kodi tu unategemea itasikilizwa lini? Mahakama zetu unazijua mkuu.....

    Blaza, Mkataba unatakiliwa kuwa wazi kwamba mwenyumba na mpangaji wana wajibu gani (terms and conditions) mojawapo ni kwamba iwapo mmoja wenu hatatimiza makubaliano nini kitafuata, pili mwenyenyumba atatoa notisi ya muda gani kabla ya mkataba kwisha na mpangaji atawajibika kuonyesha nia ya kuendelea au kutoendelea kwa kutekeleza kama mkataba unavyosema. Hakikisha una ushahidi wa hiyo notisi kabla ya kutumia misuli kwani itakula kwako.

    Mimi ninavyofanya kwa wapangaji wangu hapa Kariakoo ni kuwka nao mkataba wapangaji wangu wote. Ndani ya mkataba kunakuwa wazi kila kitu yaani siku inayoanza mkataba, na siku ya kumalizika mkataba, kiasi cha pesa alizotoa. vile vile kuna Haki na waji bu wa mpangaji na mpangishwaji kwa kipindi chote.

    Vile vile kinachosema wazi kuwa pande yoyote ile kama inataka kuongeza au kuvunja mkataba inatakiwa itoe taarifa kwa mwenzake siku 90 au miezi mitati kabla kumalizika kwa mkataba.

    Mkataba huu unakuwa na mashahidi 2 kwa kila pande yaani mpangaji 2 na anayepanga 2, kisha unasainiwa na mwanasheria au hata kiongozo wa serikali ya mtaa.

    Wote unawapa copy zao.

    sasa siku mkataba unapomalizika hakuna tena kumpa NOTICE bali ni kutoa taarifa serikali ya mtaa na chombo cha usalama kuja kushirikiana kuondoa vitu vyake wao wakiwa mashahidi.

    Hivyo ndivyo ninavyofanya mimi kwa wapangaji wangu. Labda wanasheria watasaidia zaidi.

    Kuna mambo ya kuangalia pia je mkataba huo unatambuliwa kisheria?? Nadhani unaelewa nikisema mkataba unatambulika kisheria i.e. mkataba husika una paid stamp duty? kuna shahidi aliyeshuudia utiaji sign mkataba huo? n.k.

    Asikurupuke kwenda mahakamani anaweza kushindwa pia na akaamuliwa amlipe fidia mpangaji. Mimi namshauri awe muungwana tu, ampe muda ili ajiandae ahame pengine ana matatizo ya kifamilia/kifedha. Na tukumbuke kwamba sisi bado ni watanzania kusaidiana ni sehemu ya maisha yetu na ni wachache ambao wameanza maisha bila kupanga nyumba.

    Lakini kama mpangaji ni mkorofi basi jaribu kutumia uongozi wa mtaa/kata ili mfikie muafaka.
