Tatizo kubwa kwa taasisi hizi ni kwamba hazina maamuzi ya mwisho, na zinafanya kazi kwa kufuata matakwa ya wakuu wao na si sheria kama wanavyo sema wao.

Wao ni figure tu, na wanafuata yale wanayoelekezwa na waliowaweka. Waache tu walumbane kwani kulumbana kwao kutafichua siri nyingi zilizofichwa.

Director of Public Prosecution Eliezer Feleshi has reacted strongly against Prevention of Corruption Bureau (PCCB) director general's pronouncement that his office is sitting on files of convictable perpetrators of grand graft.

Speaking in Dar es Salaam yesterday, Mr Feleshi queried the basis of PCCB boss Edward Hoseah's charges that his office is doing nothing on case files that the corruption watchdog has handed over to his office, ostensibly for further action.

Dr Hoseah told reporters on Thursday that PCCB has so far handed over to the DPP files on 60 grand corruption suspects.

"We have completed our investigations and have passed on the files to the DPP for further action," said Dr Hoseah.

In his rejoinder yesterday, Mr Feleshi said his office handles a huge number of case files each day from various organs and no one has so far accused him of delay.

"My office receives files from the Police, Immigration, PCCB and other investigating agencies and what we normally do is look at each case's legal perspectives and decide whether to take the matter to court or return it to the investigating agency concerned for further input," he said.

Vividly disturbed by the PCCB boss's accusation, Mr Feleshi said: "Now I will need to have a dialogue with the PCCB director general so that we put things in perspective... instead of each of us being interviewed separately; let the two of us meet before journalists and tell them the real situation so that they can have the correct picture of what has been going on."

He reminded Dr Hoseah of the consequences of rushing cases, especially serious ones like those on grand corruption.

Reacting on the purported 60 files, Mr Feleshi said he was even not even aware there were 60 case files at his office sent by the PCCB.

"I don't know if the said 60 files are indeed in my office; but, anyway, we receive many files daily and we work on them diligently, then advise the Government on whether to take a case to court if there is enough evidence," he said.

He said it was not fair to blame his office for delaying cases without first acknowledging his responsibilities in handling sensitive issues.

He stressed that it would be imprudent to handle PCCB files in a rush.

"If someone wants us to do things that way, then the nation should prepare to pay a lot of money in damages and that would be a huge burden to our country as we will definitely lose many cases," he warned.

"I don't see why we should send an immature case to court... it won�t make sense charging someone while you don�t have a watertight evidence to convict him," he said.

But he hastily admitted that there is a 'tug-of-war'between his office and the PCCB, adding that his request is that the anti-graft agency should strive to work on the comments and suggestions he makes on the cases that he returns to them.

Dr Hoseah had told journalists that PCCB should not be blamed for the delay to prosecute grand corruption suspects.

In a way, albeit in an indirect way, he shifted the blame on lack of action against corruption to the DPP�s office which, he said, should tell the public what it is doing about some 60 files sent his office sent to them.

Dr Hoseah said the files he has delivered to the DPP contain evidence that is ample enough to facilitate convictions. �My hands are tied since it is the DPP who has the final say as regards the decision to prosecute,� he said.

Meanwhile, the Ministry of Constitutional Affairs and Justice spokesperson Mr Omega Ngole told this paper on Thursday that according the law, the DPP is given up to 60 days to scrutinise a file presented to his office and make a decision on it.

He said: "I don't think there is any file in the DPP�s office that has overstayed."

Dr Hoseah has put the public in suspense for months following his public announcement that his agency was working on at least ten major corruption scandal cases.
