A FORMER Cabinet Minister, Mr Anthony Diallo, has filed a suit at the Kisutu Resident Magistrate's Court in Dar es Salaam against activist Kainerugaba Msemakweli, demanding among others, payments of 200m/- as damages for publishing a booklet containing allegedly defamatory statements against him.
In the suit, which has been set for mention before Resident Magistrate Aniseta Wambura on March 24, Mr Diallo is further asking the court to issue a permanent injunction, retraining Msemakweli and his agents from publishing materials containing such defamatory statements.
He is also seeking orders of collection and destruction of all booklets titled "orodha ya mafisadi wa elimu, toleo la kwanza," meaning, "A list of shoddy degree and diploma holders, first edition," published and exhibited for sale in Dar es Salaam and other parts of the country.
Mr Diallo, who is also a Member of Parliament (MP) for Ilemela Constituency (CCM) in Mwanza Region, is seeking orders requiring Msemakweli to publish a retraction of the malicious publications and unconditional apology on the front page of any newspaper.
Through his advocate Mafuru Mafuru, the MP also lodged an application under certificate of urgency before the court on March 11, this year, claiming that his reputation stands to suffer irreparably if further publications of the booklet would not be barred.
In his affidavit to support the application, Dr Diallo stated that he is a businessman and politician, who served the government in different capacities for 12 years in the third and fourth phase governments, as deputy minister and full minister in four different ministries.
They include Ministry of Industry and Trade and Ministry of Water Resources and Livestock Development. He was deputy minister in the Ministry of Natural Resources and Tourism and Livestock Development as full
minister.
As a businessman, he claimed, he is a qualified person in service of marketing, business administration and management specialist and having 20 years experience of management in the field of manufacturing.
Academically, Dr Diallo stated that he hold several qualifications. They include Certificate in Business Administration (Newcastle 2001), Diploma in Technology Management (Netherlands -- 1992), Advanced Management Programme (Harvard Business School USA-1994) and Master of Business Administration (Newcastle University 2004-2005).
He also holds a Bachelor of Science degree in Business (Phoenix
University), Master of International Management (Phoenix University 2006-2007), Doctor of Business Administration (University of Newcastle 2005-2008 and Master of Aviation Management at the same university in 2009.
According to him, in September last year, at his own instance and sheer move and without truth and justification, Msemakweli published the booklet for sale covering different personalities containing defamatory statements at its pages 34 to 39, showing he holds fake certificates.
The published statement, he stated, clearly indicated a premeditated and well orchestrated campaign aimed at portraying directly an innuendo and position that he is a fraudster, forger, dishonest businessman and politician, guilty of dishonourable conduct and not fit to hold any post.
Due to such defamation, he stated, he has been seriously lowered in the estimation of right thinking members of the society, impeached to the injury of his business and political career, subjected to mental anguish, public odium, contempt, ridicule and social embarrassments.
Furthermore, Dr Diallo stated that the publication was calculated to bring into hatred and excite dissatisfaction to his voters and shun away from him for the general elections scheduled for October, this year. From such gross libel, he stated, he was entitled to the damages.
