After years of legal battles and public scrutiny, a Kenyan court has acquitted former National Land Commission (NLC) chairman Mohammed Abdalla Swazuri alongside 16 co-accused in the KSh 221 million land compensation case linked to Kenya Railways.

The case, which began in 2018, alleged that the accused had fraudulently facilitated compensation for land believed to be public property belonging to Kenya Railways. They faced charges including abuse of office, conspiracy to defraud, and money laundering, making the trial a key test of Kenya’s anti-corruption efforts.

However, the court ruled that the prosecution failed to prove its case beyond reasonable doubt. A major issue was the ownership of the land in question. While prosecutors claimed it was public land, the court found that this was not sufficiently established, with evidence suggesting it could have been private or township land.

Additionally, the land titles used to justify the compensation had not been legally revoked, meaning the payments could not automatically be considered unlawful. The court also noted the absence of clear proof that the accused knowingly engaged in fraud.

The ruling highlights challenges in prosecuting corruption cases, particularly those involving land disputes, where ownership is often complex and documentation unclear.

While the acquittal brings the case to a close, it raises concerns about the strength of investigations and the quality of evidence presented in court, reinforcing the need for stronger systems to support accountability.
