    mwajiri akishindwa kukupa mishahara mitatu(yaani miezi mitatu mfululizo),sheria zinasemaje?

    Sheria ya kazi na mahusiano kazini ya mwaka 2004 kifungu cha 27 inaweka wazi kuwa ni kosa kwa mwajiri kukiuka kifungu hicho. Hivyo unaweza kumshitaki kwa mujibu wa sheria. Ni vyema pia ukaweka wazi namna ya mambo yalivyo ili isije tukawa tunatoa hukumu ya upande mmoja tu. Nashukuru kwa hoja

    Mwajiri kushindwa kumlipa mfanyakazi mshahara kwa muda ulioutaja, kwa mawazo yangu, atakuwa amevunja mkataba wa kazi kimsingi.

    Nadhani ingekuwa vizuri kama maelezo yako yangekuwa marefu kidogo ili tupate uelewa wa mazingira mazima, kwa mfano, hatujajua kama unafanya kwenye kampuni au taasisi au biashara binafsi amboyo si kampuni, kama uko wewe peke yako kwenye hiyo kazi ua kuna wafanyakazi wengine, na kama kuna wafanyakazi wengine je na wao hawajapata mishahara yao au ni wewe tu?


    Najaribu kujiuliza kama wewe(mwajiriwa) ungekosekana kazini kwa kipindi hicho, yeye(mwajiri) angekuvumilia? Anataka maisha yako uyaendesheje? Kama kampuni haiendeshwi kwa faida si waitangaze mufilisi ili wadai, ukiwemo wewe, mlipwe haki zenu? Kwani kuna ulazima wa kuendesha biashara isiyokuwa na faida kiasi cha kuwatesa wafanyakazi kiasi hiki?


    Sheria ya Ajira na Mahusiano Kazini, 2004 kama itasomwa kwa pamoja na Kanuni za Utendaji Bora, 2007 utaona kuwa kutolipwa mshahara ni sababu kati ya sababu zinazoweza kumfanya mwajiriwa kujiuzulu kazi. Na katika hali hiyo inaweza kuchukuliwa kuwa mwajiri amefanya kazi isivumilike hivyo kimsingi mwajiri atakuwa amekulazimisha kuacha kazi kiujaujanja na kwa hiyo atakuwa amekufukuza kazi isivyo halali. Hivyo, unatakiwa kumtaka mwajiri wako akulipe mshahara wako na akikataa kukulipa basi unaweza kuchukua hatua ya kuacha kazi bila notisi kwa kigezo cha mwajiri kufanya ajira isivumilike na kupeleka malalamiko yako CMA au unaweza kuamua kupeleka malalamiko ya kudai mishahara yako CMA wakati unaendelea na kazi kama utaweza kuvumilia zaidi.

    Bandio ameeleza vizuri na yuko sahihi kabisa: labda kama ''kanewi'' ujui utaratibu wa kupeleka lalamiko hilo CMA uliza tena au ni-PM kwa ufafanuzi zaidi.

    CMA-ndiyo.
    Tume ya Usuluhishi na Uhamuzi(Commission for Mediation and Arbitration) - migogoro yote ya ki-kazi na ajira inapelekwa huko, hii Tume hiko chini ya Wizara ya Kazi na Ajira japo inafanya kazi kwa kujitegemea ki-mamlaka.

    mimi ni muajiliwa wa mamlaka ya leri tanzania na zambia tazara,.nazania kwa waliofanikiwa kuufuatilia mgogoro wa wafanyakazi kila kukicha ni mishahara ila sasa imefikia kiwango cha kutisha yaani tangu march mpaka ninavyo tuma post hii wafanyakazi wote hawajapata mishahara,.naomba mnielekeze jinsi ya kufanya hata kama itakuwa kuacha kazi je masrahi yangu nitayapata??maana naona nundu alielezwa akaleta siasa na sasa tunamuangalia mwakyembe ila wafanyakazi wanaishi maisha magumu sana,.nisaidieni ili nianze mchakato wa kuwasaidia na wafanyakazi wenzangu.
