Kampuni zafungua kesi kudai haki za kipekee katika uwanja wa ndege wa Zanzibar

Sakata la mgogoro wa kimkataba wa utoaji huduma katika Uwanja wa Ndege wa Kimataifa wa Abeid Aman Karume umeiweka matatani Mamlaka ya Usafiri wa Anga Tanzania (TCAA) baada ya mwekezaji katika uwanja huo kufungua maombi mahakamani akiomba ridhaa ya kuishtaki.

Mwekezaji huyo kampuni ya Transworld Aviation FZE, Dubai, Umoja wa Falme za Kiarabu imechukua hatua hiyo baada ya Mamlaka ya Viwanja vya Ndege Zanzibar (ZAA) kuisimamisha kutoa huduma ya kampuni yake dada, Transworld Aviation Limited, Zanzibar huduma uwanja hapo.

ZAA katika barua yake ya Septemba 14, 2022, iliita Transworld kusimama kutoa huduma katika uwanja huo kituo cha tatu (Terminal Three), kuanzia Desemba Mosi 2022 na ilielekeza huduma hizo zitatolewa na kampuni ya Dnata Zanzibar Aviation Services Company Limited.

Hata hivyo, kutokana na mgogoro huo wa kimkataba, kampuni hiyo ya Transworld imefungua shauri la maombi Mahakama Kuu Masjala Kuu dhidi ya TCAA na Mwanasheria Mkuu wa Serikali (AG).

Katika shauri hilo kampuni hiyo inaomba ridhaa ya mahakama hiyo ili iweze kufungua shauri la maombi ya Mapitio ya Kimahakama dhidi ya uamuzi wa TCAA kutambua makubalino baina ya ZAA na kampuni ya Dnata, ambayo pekee yake ndio imeruhusiwa kutoa huduma hiyo.

Katika hati ya maombi kampuni hiyo ya Transworld inaomba kibali ili ifungue shauri hilo la mapitio ya mahakama ili mahakama kuhoji uhalali, mantiki ya uamuzi wa TCAA wa Septemba 6, 2022 kutambua makubaliano hayo ya ZAA na Dnata.

Kwa mujibu wa hati ya kiapo cha afisa wa kampuni hiyo ya Transworld kilichoambatanishwa katika maombi hayo, Mohammed Majid Mohammed, kampuni hiyo ilianzishwa chini ya Sheria za Zanzibar, Desemba 27, 2012 na Juni 24, 2020 ilipata leseni ya kutoa huduma katika viwanja vya ndege nchini.

Mohammed ameleeza Oktoba 2014 kampuni hiyo iliingai mkataba wa miaka 15 na Serikali ya Mapinduzi Zanzibar (SMZ), kutoa huduma katika uwanga huo wa Karume na kwamba katika mkataba huo hakuna mahali ambapo inazuiliwa kutoa huduma katika kituo namba tatu cha uwanja huo.

Hata hivyo Mohammed anadai kuwa TCAA kupitia barua yake ya Septemba 6,2022, ilitambua makubaliano baina ya ZAA na Dnata ambayo yanaipa Dnata pekee haki ya kutoa huduma hizo katika kituo hicho uwanjani hapo.

Pia anaeleza Septemba 14, ZAA iliandikia barua kuijulisha kuwa kuanzia Desemba Mosi, 2022 huduma katika kituo hicho zitakuwa zinatolewa na Dnata pekee.

Hata hivyo anadai kuwa barua hiyo inaizuia kutoa huduma katika kituo hicho uwanjani hapo kinyume cha makubaliano baina yake na ZAA na uamuzi wa TCAA uliofanywa kwa mujibu wa Sheria ya Usafiri wa Anga (kuipa leseni ya kutoa huduma katika viwanja vya ndege).

Mohammed anadai kuwa ikiwa barua hiyo ya ZAA kuizuia kuendelea kutoa huduma uwanjani hapo katika kituo hicho haitatenguliwa, basi itapata hasara ya kibiashara isiyoweza kufidiwa kwa kuwa haitaweza kuwahudumia wateja wake wanaotumia kituo hicho uwanjani hapo.

Hivyo alisema kutokana na mgogoro huo, Desemba 23, 2022 bodi ya wakurugenzi wa kampuni hiyo katika kikao chake cha kawaida iliazimia kuwa mgogoro huo ufikishwe mahakamani na yeye aliteuliwa kusimama kwa niaba ya kampuni.

Shauri hilo awali lilikuwa limepangwa kusikilizwa na Jaji Sekela Moshi, lakini jaji huyo alilazimika kujiondoa jana baada ya wakili wa kampuni hiyo ambaye pia ni Mkurugenzi wa Sheria na Uwekezaji, Peter Madeleka kumuomba ajiondoe kwa maelezo kuwa hawana imani naye.

Hivyo shauri hilo itapangiwa jaji mwingine atakayelisikiliza na wadaiwa watajulishwa terehe nyingine ya kutajwa baada ya kupangiwa jaji mpya.

The saga involving exclusive rights for access to a new terminal granted by the Zanzibar Airports Authority (ZAA) to Dubai National Air Travel Agency (Dnata) took a new twist Tuesday after another company filed a case at the High Court of Tanzania.

Transworld Aviation Limited submitted a petition at the High Court of Tanzania challenging the granting of exclusive rights to Dnata.

However, a legal wrangle ensued as soon as the case came up Tuesday, compelling Judge Sekela Moshi to prematurely recuse herself from handling the matter.

On September 14, 2022, ZAA issued a directive which gave the Dubai-based company exclusive access to the new terminal which was constructed at a cost of $120 million.
Order to vacate terminal

The order by ZAA gave ground handling firms that used to operate at Zanzibar’s Abeid Amani Karume International Airport until December 1, 2022 to vacate the newly constructed Terminal III, and instructed airlines to plan to work with Dnata.

Speaking shortly after filing the lawsuit, Transworld Aviation’s legal and investment director Peter Madeleka said that the Tanzania Civil Aviation Authority (TCAA) and the Attorney-General are the first and second respondents respectively.

“The Transworld Aviation, the applicant in this matter, has brought an application at the High Court of Tanzania’s main registry for the purpose of seeking court orders of mandamus, sociale and prohibition,” he explained.

According to Madeleka, they were taken by surprise as the respondents came with an objection saying the matter was a waste of the court’s precious time.

“We were of the view that it was improper for any issue which is to be determined by the court to be brought at this very early stage of mentioning,” Mdekela urged.
No confidence in judge

Through lawyer Mdekela, Transworld Aviation expressed lack of confidence with Judge Moshi who was presiding over the application.

“We asked the presiding judge to recuse herself because the applicant had no confidence in her, and we thank God that the judge has disqualified herself from determination of that particular application,” he noted.

With the exclusive rights granted to Dnata on September 14, 2022, it is reported that airlines that ply the Zanzibar route have already started withdrawing from the existing ground handlers as directed by ZAA.

Details that The Citizen has seen indicated that Transworld was the first victim of the directive after two airlines it was serving gave notices of stopping using its services.

In November 2021, Dnata signed a contract with authorities in Zanzibar to provide ground handling services at newly built Terminal 3 at the airport.

As part of the contract, two other Emirates’ subsidiaries, Emirates Leisure Retail and MMI, will operate all 13 retailers and two lounges in the terminal. These include restaurants, duty free and commercial outlets.
