ICC confirms charges against 4 of the Ocampo 6.

Matawi,

Heshima mbele.

Hapo umenena poa mkuu. Kwa ufupi, they are in it for the long haul. Thats how they anticipated it to play out.

Sasa karata kuu iko wapi tujiulize? Kwanza kabisa huyu Ruto ndo kesha kwenda na maji maana evidence kubwa dhidi yake ilitoka NSIS ambao nd'o intelligensia ya Kenya. Kuanzia simu na text messages. Trial proper ikianza haya mambo yote yatakua faragha.

Sasa unataka kuniambia Kibaki hakujua what was going on? Hapo kazi ipo.

WHY I PREFER THE HAGUE ROUTE

ruto.jpg

Agriculture minister William Ruto wants the secret envelope containing names of the post-election violence suspects handed over to the International Criminal Court at The Hague without further delay.

Mr Ruto says the two-month period given by former UN secretary-general Kofi Annan to Kenya to make a new attempt at setting up a local tribunal to try the suspects was unnecessary.

"Kofi Annan should hand over the envelope that contains names of suspects to the International Criminal Court at The Hague so that proper investigations can start," Mr Ruto said. "Mr Annan should allow us to move forward. We cannot just get stuck in one place addressing the same thing."

Mr Ruto's latest stand contradicts the position of Prime Minister Raila Odinga, leader of his ODM party, who prefers a local tribunal.

A government motion to set up a special local tribunal was defeated in Parliament earlier this month, raising the possibility that suspects whose names were given to Mr Annan in a sealed envelope by the Waki Commssion could be taken to The Hague for trial.

The Hague option was to be activated should Kenya fail to establish a local tribunal as proposed by the commission that investigated the post-election violence.

Mutula: Uhuru and Muthaura must resign!

NAIROBI, Kenya, Jan 23 – Justice and Constitutional Affairs Minister Mutula Kilonzo on Monday renewed his stance that Deputy Prime Minister Uhuru Kenyatta and Head of Civil Service Francis Muthaura must now quit, following confirmation of charges for crimes against humanity by the International Criminal Court (ICC).

Speaking to Capital News immediately after the ruling, Kilonzo maintained that the two must step down until they are cleared of the charges they face at the war crimes court as it constitutes a "serious conflict of interest."

He explained that the two held critical positions in the government and there was a risk that they could undermine the court's process.

"I am totally convinced that Chapter Six and Article 75 of the Constitution demands that someone who is accused of such offences steps aside pending determination of the case. Their stay demeans the integrity of their offices," he argued.

ICC Prosecutor Louis Moreno Ocampo has in the past expressed concern that top government officials were holding critical offices despite facing possible indictment by the court.

Kilonzo further maintained that Kenyatta, who is facing 10 counts of war crimes, and Eldoret North MP William Ruto, who is facing six counts, must cede ground and forget the presidency with the ICC charges hanging over their heads.

He said that the two would not be able to serve the interests of Kenyans, who include victims of the post election violence.

"How can you become the president of the victims who are supposed to give evidence against you? The court can only confirm the charges if it has evidence and that evidence will come from the same Kenyan victims," he said.

"So how do you become their president?" wondered the Justice Minister.

Kilonzo, who however termed the ruling as unfortunate, further revealed that he would make a second attempt for the establishment of a local tribunal to try those who were also responsible for the violence but who are not wanted by the ICC.

He added that war crimes could not have been committed by four individuals only and the rest who were responsible must be held to account.

"There is no charge on earth that's as bad as this. To be charged with a crime against humanity is the peak of crimes; all other crimes will be on judgment day, when Jesus comes back but for humanity this is the pinnacle," he quipped.

Kilonzo's first attempt at getting a local tribunal flopped with many Kenyans across the board stressing that they had no faith in a local process.

uhuru-profile.jpg
The International Criminal Court, after conducting a pre trial hearing, has decided to confirm charges against me.

I would like to reiterate before the people of Kenya and before the entire world, that my conscience is clear, has been clear and will always remain clear that I am innocent of all the accusations that have been leveled against me. I have cooperated with the ICC throughout the process and will continue to do so because I believe in the rule of law.

I thank you all for your moral support, your prayers and your abiding faith in my innocence. I, therefore, urge all Kenyans not to lose hope following today's ruling. I am confident that the truth will come out and I will be vindicated in the fullness of time.

Fellow Kenyans, as I have gone through this process, it has been abundantly clear to me that this trial has not been just about the individuals charged at the ICC. This trial has been about more. This trial has been about a country trying to come to terms with itself and its past - a country that is picking up the broken pieces from this dark period. It is about a country trying to get past the trauma of what happened and seek a fresh start.

I believe in Kenya. I believe that among the many traits that the Kenyan people have in common, none is stronger than our unanimous love for our country and hate of conflict. For in conflict, which brings burdens and dangers to so many – our nationhood and dignity is the biggest casualty.

Let us all remain calm and peaceful during this period.

In due course I will issue a more comprehensive statement.

God bless you, and God bless Kenya.

Hon. Uhuru Kenyatta, EHG, MP
DEPUTY PRIME MINISTER and MINISTER FOR FINANCE
