TanRoads sued over 3.5bn/- contract

An Engineering consulting company has filed an application in the High Court seeking orders to restrain the Tanzania National Roads Agency (TanRoads) from terminating their contract worth 3.5bn/-.
Norconsult Tanzania Limited filed the application in the courts commercial division through their advocate Gasper Nyika of IMMMA Advocates under the certificate of urgency. Judge Amir Mruma is set to hear the application tomorrow.
In the application, the company is asking the court to temporarily restrain the TanRoads from breaching terms of their contracts they signed between May 26, 2003 and September 18, 2007 in which the company was hired to provide consultancy service on road projects.
Furthermore, the company is asking the court to restrain TanRoads from demanding the handing over of all the projects it has undertaken by virtue of the contracts pending final determination of the matter under arbitration.
The contracts signed include consultancy services for detailed design and supervision of the contract for the upgrading of Marangu-Tarakea Road and consultancy services for updating tender documents, administration and supervision of Usagara-Geita Road.
Other contracts include consultancy services for investigation, detailed engineering design of remedial measures and preparations of tender documents for the Kirumi cable stayed bridge and feasibility study for upgrading Nzega-Tabora Road.
In his affidavit to support the application, acting managing director of the company Chrispin Mwashala stated that after signing the contracts, his company continued to discharge its obligations diligently and with utmost standard care and quality. He stated that on May 21, this year, however, TanRoads issued a letter, accusing the company of failure to live up to its obligations especially paying taxes.
In its letter, Mr Mwashala stated, TanRoads demanded his company to hand over the projects. He stated that at no point in time his company evaded paying tax as they had paid all the applicable taxes and that being a reason why the Tanzania Revenue Authority (TRA) never accused it of evading tax. The company acting chief stated further that the firm would suffer irreparable loss if the injunctive orders would not be granted as it has already invested and incurred considerable expenses in the performance of its obligations under the contracts.
