The hotel maid who accused formerInternational Monetary Fund chief Dominique Strauss-Kahn of sexual assault may have inflicted fatal damage on her own case by lying to prosecutors about her life story and what she did in the moments after the suspected attack, legal experts said.

The Manhattan District Attorney's Office revealed Friday that the 32-year-old woman had committed a host of minor frauds to better her life in the U.S. since arriving in the country seven years ago, including lying on immigration paperwork, cheating on her taxes, and misstating her income so she could live in an apartment reserved for the poor.

In a letter to Strauss-Kahn's lawyers, prosecutors also said she had misrepresented what she did immediately after the alleged attack by Strauss-Kahn - instead of fleeing his luxury suite to a hallway and waiting for a supervisor, she went to clean another room and then returned to clean Strauss-Kahn's suite before reporting the encounter.

That change in her story, and the revelations about her past, wasn't enough to kill the case entirely, but prosecutors acknowledged their position had been shaken, and agreed to a defense request that Strauss-Kahn be freed immediately from house arrest.

The revelations in a case once considered iron-clad came as a shock; prosecutors and police had said repeatedly that the hotel maid was found to be a credible witness.

"Rape cases are especially difficult to try," said Linda Fairstein, who oversaw the sex crimes prosecution unit in the district attorney's office for 25 years. "But they are nearly impossible to try when you find out the witness has already lied to you. The prosecutors and police, they took her word over the word of one of the most powerful men in the financial world."

Investigators have gathered forensic evidence in the case, including traces of Strauss-Kahn's semen found on the woman's work uniform, but that evidence alone isn't enough, said Fairstein, now a crime novelist.

"The DNA clearly suggests there was some kind of sexual exchange between DSK and woman, but it tells you nothing about whether it was forcible," she said. "It can be deposited by consent or by force. Her credibility is the entire case, you have to believe her story."

But she also said that her transgressions don't mean her story is false.

"Bad people, people who lie, they're still sexually assaulted," she said. "So I think what everybody is trying to do now is bring her back again, and say ''OK, you were dishonest about these things, now we have to figure out what really happened between you and this man.'

At a minimum, questions about the woman's credibility could leave a jury doubtful that she was telling the truth about what happened. They also raise the possibility that the woman herself could be in legal trouble, if the government decides to seek punishment for her past fibs and fabrications.

District Attorney Cyrus R. Vance said the charges, which include attempted rape, will stand for now. But prosecutors had a legal duty to turn over the uncovered information to the defense, and they were continuing their investigation.

In a letter sent to Strauss-Kahn's lawyers, they disclosed several instances in which they believed the woman had lied about herself or the circumstances of her life. They said she'd made up being gang raped and beaten in her homeland of Guinea to enhance her application for political asylum in 2004. She now says she was raped there, but not as she initially said.

U.S. officials are often presented with fabricated stories by people seeking refugee status in the country, and the nation's immigration courts are filled with instances of immigrants who have been caught embellishing personal histories to meet the strict conditions for being granted asylum.
Lori Adams, managing attorney of the legal aid group Human Rights First, said that many people in the immigration system don't have a lawyer, and they blunder through proceedings without fully realizing the potential repercussions of embellishing their life stories.

"A lot of people are on their own, or are poorly advised, and could be tempted to present their story in a certain way that might not be truthful," she said. "Sometimes people get desperate."

She said that if the woman's application was based on fraud, the Justice Department could seek to reopen the case and have her thrown out of the country. Her attorney Kenneth Thompson said she went to prosecutors to tell them the truth, and she had initially feared she'd be deported if she told them why she really left: because she was a victim of genital mutilation and she didn't want her daughter, now 15, to be similarly affected, Thompson said.

Prosecutors said the woman had also been lying on her tax returns about how many dependents she had in order to increase her tax refund and had misstated her income to avoid losing her apartment.

While it wasn't detailed in the letter, prosecutors have also raised other questions about the woman's credibility.

Prosecutors located a recording of the woman, days after Strauss-Kahn's arrest, the woman, talking about the case and mentioning Strauss-Kahn's wealth in a phone call to a man incarcerated on a drug charge, a law enforcement official told The Associated Press, speaking on condition of anonymity to discuss matters not made public in court.

The woman also raised questions by saying she knew little about tens of thousands of dollars others have deposited in bank accounts in her name, the official said. Authorities suspect the money might be drug-related, the official said.

Thompson acknowledged the recording, but said any suggestion she was involved with a known dealer or money launderer was a lie.
"I have not heard that tape," Thompson said. But he said that when he discussed the recording with prosecutors, "I said, 'Did she change her story to this guy in prison?' ... They told me no."

He said that since the start of the case, the woman has been consistent in the most important part of her story, saying that as she began cleaning Strauss-Kahn's suite he grabbed her breast, violently knocked her down and forced her to perform oral sex. He said she suffered bruises and torn ligaments.

Strauss-Kahn, who resigned his post at the powerful monetary organization, has denied the charges. He is due back in court July 18. His attorney, Benjamin Brafman, said he believes his client will be vindicated.

The one-time French presidential contender is now free to travel the U.S. while he awaits trial. He had been under a pricey house arrest in a ritzy Tribeca loft after posting a $6 million cash bail and bond. He smiled as he left the court Friday, hand-in-hand with his wife. His attorneys said they are pleased with the decision, and cautioned again not to rush to judgment. His passport remains surrendered and he can't leave the country.

And that is exactly my point. How can we believe that she was raped if she has no credibility? They might actually have agreed to have sex and then later on she changes her story.

Your claim that the rape case ipo palepale is just a matter of time before it is thrown out. The other women in his life does not mean hi is guilty of rape this time. The semen and a bruised vag... also does not mean there was rape. A bruised vag... can also be a result of the way they did their "thing". Kuchanwa gauni nako means nothing as she might have done it herself as part of her plan.

Her story has huge holes which point to one conclusion!!!

Strauss-Kahn may face new sex charges in France

Paris (CNN) -- Former International Monetary Fund head Dominique Strauss-Kahn may face new sexual assault charges in France this week, days after charges against him in New York appeared to be on shaky ground.
The French writer Tristane Banon will file a criminal complaint with prosecutors against Strauss-Kahn on Tuesday, alleging attempted rape, her lawyer David Koubbi told CNN Monday.


Prosecutors will then decide whether there is enough evidence to charge him.
Banon's mother, Socialist politician Anne Mansouret, said in May that her daughter had been attacked by Strauss-Kahn in 2003 but that she had discouraged her daughter at the time from filing charges.


A judge freed him from house arrest Friday morning after "serious issues" were raised about the credibility of his accuser.
He was never charged in connection with the alleged attack on Banon in France.
Mansouret, a member of parliament, said she cautioned her daughter not to file a police report at the time for fear it would hurt her career.
At the time, Banon was an aspiring journalist.

However, in light of the charges against Strauss-Kahn after the alleged incident at a Sofitel hotel in New York in May, Banon's attorney, Koubbi, said a few week ago that he and the young woman were considering whether to file a complaint.
Koubbi said the cases were not connected.

"I don't see any reason why these two cases should be joined because either the prosecutor has enough elements to condemn Dominique Strauss-Kahn in the United States -- and if he does he should do it -- or he needs to bring two cases together to get a conviction," he said.
"In that case we do not want to participate," he told CNN in June.

Strauss-Kahn's attorney in France, Leon Lef Forster, did not respond to CNN's requests for comment on the allegations in May.
His lawyers in New York did not immediately respond Monday to fresh questions about the Banon allegations.
Mansouret, the Socialist politician whose daughter is the alleged victim, described herself last week as "the woman who embarrasses the Socialist party."

"I am ... a sort of collateral damage in the DSK affair. I knew for a long time that my political career was sealed with this bomb, but I didn't imagine that this bitter past could be revived so violently," she wrote July 1 on the Rue89 website, referring to the alleged attack.
Mansouret recently pulled out of the Socialist party presidential primaries. Strauss-Kahn had been a front-runner for the party nomination until the New York arrest, and suggestions that the case was foundering revived talk of his chances of becoming president of France in next year's elections.

Mansouret told CNN in May that as a young journalist in 2003, her daughter had asked to interview Strauss-Kahn. She met him in his office in the National Assembly and the initial interview went well, the politician said.

However, Strauss-Kahn sent Banon a text message later, saying he was not happy with the interview and asking if he could speak with her again. He sent her an address, she said.
Banon went to the address, where Strauss-Kahn then locked the door to the room they were in, took her hand and grabbed her arm, according to Mansouret.
Banon told him to let her go, and the incident ended with the two struggling on the floor, Mansouret said. Banon managed to escape the apartment and locked herself in her car outside, calling her mother.

Mansouret said she arrived about an hour and a half later to find her daughter still locked in the car and looking "roughed up." The heel of one shoe was broken, Mansouret recalled to CNN.
But Mansouret told her daughter not to file a complaint out of concern she would become known as Strauss-Kahn's victim.
CNN does not typically name assault victims, but Mansouret said her daughter gave permission for her name to be disclosed.

    The lawyer for a French journalist and writer claims she will file a lawsuit accusing former International Monetary Fund chief Dominique Strauss-Kahn of attempted rape.
    Lawyer David Koubbi told the Associated Press that Tristane Banon will file the suit on Tuesday in Paris.
    Banon has described an encounter in 2002 in which Strauss-Kahn allegedly sexually assaulted her.
    Strauss-Kahn was arrested in New York in May on charges that he tried to rape a hotel maid. Strauss-Kahn, who vigorously denied wrongdoing, was released without bail last week after questions emerged about the maid's credibility.
    Koubbi had said in the past that they would not file a lawsuit until the US trial was finished. He said on Monday that they had decided to move forward now instead of waiting.
    Banon came forward after Strauss-Kahn's arrest on 14 May in New York. She accused him of wrenching open her bra and trying to unbutton her jeans in 2002. Lawyer David Koubbi said Banon had been dissuaded at the time from filing charges by her mother, a regional councillor in Strauss-Kahn's Socialist party.
    Before Koubbi's announcement, the country was divided on whether it wanted Strauss-Kahn back in public life: two polls showed an almost even division between those who thought he should return, and those who believed his political career was over.
    A poll released on Monday found that 51% of French people found that Strauss-Kahn no longer had a political future, versus 42% who thought he did.
    Another poll published on Sunday conducted by Harris Interactive for Le Parisien showed 49% wanted Strauss-Kahn to return to French politics.

Strauss-Kahn to make slander claim against accuser

PARIS (AP) — Lawyers for Dominique Strauss-Kahn say they will file a slander complaint against a writer who accuses the former International Monetary Fund head of sexually assaulting her in 2002.
Tristane Banon, 31, says she plans to file a criminal complaint Tuesday accusing Strauss-Kahn of trying to rape her in 2002.
Strauss-Kahn's lawyers say in a statement Monday that Strauss-Kahn "has always said that the incident described by Ms Banon since 2007 is imaginary.".
