Kimunya finally resigns - - Headlines

Finance minister Amos Kimunya has finally bowed to pressure and resigned.

Only last Sunday, an enraged Kimunya strongly asserted that he would not relinquish his Treasury job over the sale of Grand Regency hotel.

However, the embattled Kipipiri MP eventually bowed out on Tuesday to mounting pressure to pave way for investigation into his handling of Grand Regency hotel saga.

"I have requested his Excellency the president, to be allowed to step aside to facilitate the inquiry," said Kimunya in a brief press statement he read on Tuesday afternoon.

Saying his conscience was clean on the saga, Kimunya insisted that he was open to an independent inquiry to prove his innocence.

On Sunday, Kimunya had accused Prime Minister Raila Odinga of being part of a wider scheme to bring him down and said if he had to resign, then Raila, Attorney General Amos Wako, Lands Minister James Orengo and anti-corruption commission director Aaron Ringera must also step aside to allow for investigation.

On Sunday, who had been elusive since Parliament passed a Motion of no confidence in him on Wednesday, retreated to his Kipipiri constituency to launch a fight back at a rally at Miharati Stadium.

Kimunya told his constituents that Orengo blew the whistle after "his bid to solicit a Sh3 million bribe from a legal firm involved in the sale was turned down."

"Orengo went public after he was denied a bribe of Sh3 million he demanded from a Mr Adan, one of the lawyers involved," Kimunya said.

But lawyer Ahmed Adan, hit dismissed Kimunya's allegations as falsehoods, baseless and unfounded:

Said he: "Orengo is a close friend, a polished lawyer I have worked shoulder-to-shoulder with. Kimunya's allegations are falsehoods, baseless and the bribe theory totally unfounded."

Kimunya Was Forced Out

EMBATTLED former Finance minister Amos Kimunya did not resign on his own volition but was forced to quit, thus ending two weeks of a raging debate over his involvement in the clandestine sale of the scandal-ridden Grand Regency hotel.

This somehow also puts to a stop a controversy that had threatened to break the fragile grand coalition government. Sources said President Mwai Kibaki bowed to pressure from both within and outside his government and asked his close ally to step aside to pave way for investigations.

In a surprise turn of events, Kimunya's resignation came barely 48 hours after he marshalled five MPs from Central Province led by Deputy Prime Minister Uhuru Kenyatta in his Kipipiri constituency to defend him, and where he declared that he would rather die than resign.

Addressing a hurriedly-convened press briefing at Treasury Building yesterday afternoon, Kimunya said he reached the decision to step aside after extensive consultations with President Mwai Kibaki in order to pave way for investigations into the scandal.

"I have held several consultations with President Kibaki, my friends and family on the ongoing issue of the disposal of the Grand Regency Hotel.Accordingly, I have requested His Excellency the President to be allowed to step aside to facilitate the inquiry," said the besieged
minister.

Sources told Kenya Times that Kimunya resigned minutes after receiving communication from Head of the Civil Service and Secretary to the Cabinet Francis Muthaura that the Head of State had opted to have Kimunya resign.

Kibaki's move to shed-off Kimunya came after two days of extensive consultations between senior government operatives, donors and some of the President's golfing buddies who are believed to form his kitchen Cabinet. Other sources said that Kimunya's resignation was fast-tracked in order to pre-empt a highly incriminating report that Prime Minister Raila Odinga was scheduled to present to Parliament yesterday afternoon as his response to Kimunya's earlier charge that he (Raila) had a share in the blame over how the Grand Regency transaction was executed.

The President is said to have arrived at his Harambee House office at around 10 am and held consultations with the Prime Minister and later with Internal Security Minister George Saitoti, Deputy Prime Minister Uhuru Kenyatta and Muthaura before the message was delivered to Kimunya.

Raila reportedly left Harambee House and headed to his Treasury Building office for a meeting with the Acting British High Commissioner to Kenya before chairing a Cabinet Sub-Committee on Infrastructure comprising Charity Ngilu (Health), Chirau Mwakwere (Transport) and
Kiraitu Murungi (Energy), among others.


As Kimunya's office hastily convened a press conference for 12.30 pm, the President went back to State House where he called Raila for further consultations that lasted for about an hour. It is speculated that the Head of State impressed upon the Premier to save the embattled Kimunya further embarrassment by toning down the damning report that he would have presented to Parliament.

Sources close to State House intimated that the President had been in close and constant contact with Raila between Monday and yesterday before he decided to tell his former Finance Minister to throw in the towel.

"The President had to act, because where things had reached, it was either the survival of the grand coalition or Kimunya," said the source. By the time Kimunya was throwing in the towel,
he had been isolated by almost all friends, save for Saitoti, Vice-President Kalonzo Musyoka, Uhuru, Michuki , Government Chief Whip George Thuo and four other MPs.

He remained an isolated figure amidst unanimous calls for his resignation from both former friends and foes alike. With pressure mounting from the donor community and the President's close associates, Kimunya had no option but quit. And yesterday, Attorney-General Amos
Wako directed the police to commence investigations into the hotel sale transaction and prosecute all those implicated in the saga.

However, Government Spokesman Alfred Mutua said Kimunya will not be immediately replaced since he was just stepping aside temporarily.

A committee appointed by Raila to probe the hotel saga recommended that Kimunya, Central Bank of Kenya Governor Professor Njuguna Ndungu, National Security Intelligence Service Director Brigadier Michael Gichangi and the Secretary to the CBK Board Kennedy Kaunda step aside to give room for further investigations over their role in the clandestine sale of the hotel with total disregard to the laws on public procurement.

The report by the committee led by Attorney-General Amos Wako with ministers James Orengo, Mutula Kilonzo and KACC Director as members was set to be discussed by the cabinet last Thursday but the meeting was called off at the eleventh hour in what appeared like
a plot to try to defend Kimunya. Yesterday afternoon, Raila told parliament he had been briefed on the deal after 10 per cent of the transaction was already through.

He also said that he, alongside Attorney-General Amos Wako and Lands Minister James Orengo will not step aside as demanded by Kimunya since there was no evidence linking them to the controversial sale. Raila walked into the House amid laughter, saying: "When I told him to
resign, he said he would rather die than resigning.Today he has gone, but thank God he is not dead.

On Sunday, Kimunya rubbished the report, saying it was unfair since it was prepared by people
who should also step aside for their involvement in the scam. He maintained that Odinga, Wako, Orengo and Ringera were fully informed and aware of the sale of the hotel and called for their immediate resignation so that justice can be seen to be done to all.

The well coordinated scheme to defend the minister which was hatched in his constituency hit a snag on Monday when a meeting for Mount Kenya MPs held at a Thika hotel ended in disarray with two factions emerging; one group rallying behind him while the other saying he should quit in the interest of the nation. Even as the soft-spoken but tough Kipipiri MP quit the powerful Finance ministry, he insisted that he committed no crime in the sale of the multi-billion shilling hotel saying the transaction was done above board.

Said he: "As I have indicated before, my conscience is very clear on the role of Treasury.
I have maintained the position that I am open to an independent inquiry to prove my innocence."

At the press briefing, Kimunya declined to field questions from journalists on the pretext that he was under instructions from his lawyers to weigh his words now that an independent probe was
about to begin to unravel the scam that had caused a major rift in the cabinet with one faction calling for his immediate resignation or dismissal while the other defended him.

It is for this reason that he thanked all those who stood by him during the trying moment saying the truth would eventually be known over the suspicious disposal of the facility. Kimunya has been in the eye of the storm over the manner in which he handled the sale of the luxurious hotel
with Parliament sealing his fate with the passing of the censure motion against him. The motion presented a major constitutional crisis since MPs had vowed not allow him transact any business hence paralysing major government operations.

Leading calls for his resignation was Lands Minister James Orengo who blew the whistle on the scandal which has renewed rivalry between ODM and PNU presenting a litmus test to the shaky grand coalition government with prophets of doom quickly calling for its dissolution to pave way
for fresh elections. Orengo detailed how the minister allegedly in cahoots with Prof. Ndungu sold the hotel to the Libya Arab African Investment Company in total contravention of the Public Procurement and Disposal Act and Privatisation Act.

The evidence formed the basis of the censure motion moved by Ikolomani MP Dr. Bonny Khalwale who also took issue with the manner in which the minister handled the Safaricom Initial Public Offering and the shadowy company, Mobitelea owning shares in the most profitable company in East Africa. His continued stay at the Treasury had sparked demonstrations in Nairobi and Mombasa led by MPs lobbying for the establishment of the Official Opposition.

Statement by the Prime Minister, the Rt Hon Raila Odinga


The Grand Regency Hotel​

With permission, Mr Speaker, Sir, I wish to make a statement about the controversy surrounding the sale of the Grand Regency Hotel.

I have decided to make my first Prime Ministerial statement on this subject to this House as Iam a fervent advocate and admirer of parliamentary democracy.

The media has a vital role to play, but on some subjects I did not wish to inform the people of Kenya what I knew, when I knew, and what I did through press conferences or paid advertisements.

This House occupies a central role in Kenyan politics. My loyalty is to the supremacy of this parliament rather than any individual.

This House has the power and responsibility to question how and when government decisions are made to ensure greater transparency and that highest standards of financial probity are maintained. I value this immensely.

With these few opening remarks I wish to share the following sequence of events that will inform the members of my role as Prime Minister.

On April 23 this year I received a telephone call from the Governor of the Central Bank who told me that there was something he wished to share with me as Prime Minister, concerning adverse stories appearing in the media. I met him in my office the same evening.

The Governor presented me with an eight-page, undated, unsigned, typed document which purported to give a background to the Central Bank’s involvement with Kamlesh Pattni and the case of the Grand Regency hotel, in which the Bank had a charge over the land and buildings. Mr Speaker, Sir, I will be placing this document and others in my possession in the Library of the House.

The document noted that the Bank had held a Board Meeting on April 7, 2008, to chart the way forward. It stated that the Libyan government was “very eager to have a foothold in the hotel industry” and that “consultations have been ongoing, at the highest levels of the two governments, where it has been agreed that Libyan investors be encouraged to purchase the Grand Regency hotel when the opportunity arises”. The investors had agreed to buy the hotel as a going concern and at market value.

The Governor told me a deal had in fact been concluded on 23rd April with the Libyan investors, who had paid 10 per cent of the purchase price of US$45 million but the deposit was not made until 8th May.

This was the narrative according to the Governor of the Central Bank.

The Finance Minister, on his part, told Parliament that the hotel had not been sold on 29th April. He informed the public that the hotel would be sold through public auction.

This was the rapid rebuttal from the Minister of Finance.

I then began reading in the media often contradictory statements. Because of this, on 25th April 25, two days after my meeting with the Governor of the Central Bank, I directed my Chief of Staff, to write to the Director-General of the Kenya Anti-Corruption Commission. In this letter, I requested information on or sight of:

  • the status of the receivership accounts relating to the hotel;
  • · the status of pending civil suits filed by the Commission against Pattni and his codefendants;
  • · the surrender and transfer documents;
  • · the consent orders/extracted orders as might have been made;
  • · the counsel who advised on and prepared the transactional documents;
  • · the breakdown of the transaction costs;
  • · how the transaction had been or was being handled in the context of the Privatisation Act; and
  • · all other relevant documents, including correspondence exchanged over the transaction.

The letter was copied to the Attorney-General, to the Finance Minister and to the Governor of the Central Bank, and to Head of the Civil Service.

On June 12th I received a reply from the Director General of KACC confirming that the Grand Regency hotel had been recovered from Pattni’s Uhuru Highway Development Ltd and handed over to the Central Bank of Kenya.

Attached to the letter was a copy of the Court Order issued under Civil Suit No. 111 of 2003, instituted under the Kenya Anti-Corruption and Economic Crimes Act, showing that a settlement had been reached between the Bank and Pattni regarding the handing-over of the Grand Regency in exchange for the Bank’s abandoning all claims against Pattni and all other defendants in the case.

The KACC however did not furnish me with all the documents as per my request of 25th April. I was thus forwarded partial evidence but not the whole so I can make an informed assessment.

What precipitated my action to call the Cabinet Committee on Finance, Administration and Planning was that the Minister of Lands discovered that the transfer had been mysteriously effected on 25th June and made a press briefing to that effect on the same day. On 27th June the Finance Minister for the first time acknowledged that indeed the hotel had been sold. At the meeting held on 1st July the Cabinet Committee constituted a technical sub-committee with the mandate to collect and review all available documents and records relating to sale of the Grand Regency Hotel.

The Committee reported back on the evening of 1st July and by that time this House had carried the motion of “No Confidence” in the Minister of Finance.

The Committee’s deliberations, observations and findings compelled them to make recommendations that the Minister for Finance and others be directed to step aside until an in-depth investigation on the purported sale are carried out.

I am very pleased that the Minister of Finance has deemed it important to step aside. This is an honourable action for which I commend him.

Mr Speaker, Sir let me at this juncture say that the Government values Libyan investment and we have no quarrel with the Libyan government. In fact the Libyan investors are not only interested in hotel developments but have also expressed interest in refinery, pipeline and other infrastructural projects. I wish to assure the Libyan investors that the Government is committed to resolving the sale of Grand Regency hotel in a mutually agreeable manner.

As this crisis was raging on during the last two weeks I also heard that some of our development partners were considering withdrawing financial support and development assistance. The news headlines may have also deterred potential investors that Kenya is back in business as before where financial transparency and accountability are just meaningless words. Well my message to them is that this is the new Kenya where people regardless of
their status are accountable for their actions. Justice for all but not the chosen few remains our motto.

The establishment of good governance – i.e. the practice by political leadership of accountability, transparency, openness, predictability and the rule of the law – is widely accepted as a critical element in securing stable economic development for market oriented growth in our country. Governance is not necessarily limited to government in which all public affairs are conducted for instance in the economic sector.

Good governance depends on the extent to which a government is perceived and accepted by the general citizenry to be legitimate and responsive to the needs of the citizenry; competent in ensuring law and order and in delivery of public services; and equitable in its conduct, favouring no special interest or groups.

Achieving Good Governance and overcoming the practices of profligacy and corruption inherited from the past is one of the most important challenges facing the country and our government of Grand Coalition. But in facing this challenge we must not be shackled by the fear of being perceived to be corrupt in pursuing genuine opportunities to enhance our economic development.
