What next for Gachagua in the impeachment case
Deputy President Rigathi Gachagua is a man who faces an uncertain future following the tabling of an impeachment motion against him.The motion, tabled Tuesday by Kibwezi West MP Mutuse Mwengi, has been approved by the National Assembly Speaker Moses Wetang’ula and is set to undergo the required processes. He has listed 11 grounds to support his case.
The culmination of the whole process will be the voting by the MPs on Tuesday.
In his communication to the House, Wetang’ula said public participation will be conducted across the 47 counties on October 4 (Friday). On Tuesday morning, the MPs will convene to debate on the special motion that is already before the House.
In the afternoon, Gachagua will be given an opportunity to appear before the House to defend himself from the accusations levelled against him. This will happen between 5pm to 7pm. The members will then take a vote. If the motion is supported by at least two-thirds (233) of all the members, Gachagua will stand impeached.
But, this will not end here.
The National Assembly speaker will within two days be required to inform his Senate counterpart of the resolution. The Senate shall be forced to convene a meeting to hear charges against the DP.
This will happen within seven days after receiving the notice from the Speaker of the National Assembly. The Senate may decide to appoint a special committee of 11 members to investigate charges levelled against the DP or dispense the matter on the plenary.
If it settles on a committee, the appointed team will be tasked with investigating the charges against the DP and presenting its report within 10 days. If the committee reports that the particulars of any allegation against the DP have not been substantiated, further proceedings shall not be taken in respect of that allegation.
If it finds that the allegations are substantiated, the Senate shall accord the DP an opportunity to be heard, and vote on the impeachment charges. If at least two-thirds of all the members of the Senate vote to uphold it, Gachagua will stand impeached and cease to hold office immediately.
Gachagua may, however, move to court to appeal the parliament’s decision. If the courts uphold the removal, the vacancy in the office of Deputy President shall be filled within 14 days. The President shall be required to nominate a person to fill the vacancy, and the National Assembly shall vote on the nomination within 60 days of receiving it.
