SERIKALI imetangaza neema ya kifuta machozi cha Sh1.7 bilioni kwa wakazi Tabata Dampo, jijini Dar es Salaam kufuatia ubomoaji haramu wa nyumba 88.

Uamuzi huo wa serikali wa kujikuta katika hasara hiyo, umetokana na kubaini uzembe wa baadhi ya maafisa wake kushindwa kusimamia kanuni na taratibu katika zoezi zima la ubomoaji wa nyumba hizo.

Kutokana na uzembe huo wa ukiukwaji wa taratibu na kanuni za notisi kuhusu ubomoaji nyumba unaohusishwa na ufisadi, serikali italazimika kulipa Sh 20 milioni kwa kila nyumba iliyobomolewa na kutoa kiwanja bure eneo Buyuni, Wilaya ya Ilala, kwa kila mkazi.

Akisoma Tamko la Serikali jijini Dar es Salaam jana kufuatia matokeo ya Tume Maalumu ya Kuchunguza Ubomoaji wa Nyumba hizo, Waziri wa Nchi Ofisi ya Waziri Mkuu (Tamisemi), Stephen Wassira, alisema uamuzi huo wa serikali unatokana na kubaini kwamba ubomoaji huo haukuzingatia uamuzi wa Baraza la Ardhi.

Wassira alifafanua kwamba, uamuzi wa Baraza la Ardhi ulitaka Halmashauri (Ilala) iangalie taratibu zilizopo katika kuwaondoa wavamizi katika eneo husika.

Akifafanua kuhusu hilo, Wassira alitaja taratibu hizo ambazo zilipaswa kuzingatiwa kwamba ni kufikisha dhamira hiyo ya ubomoaji kwanza katika vikao vya juu vya timu ya menejimenti na vikao vya Baraza la Madiwani.

Wassira aliongeza kwamba, taratibu nyingine zilizokiukwa, ni wananchi kutoshirikishwa katika azma ya ubomoaji huo kitu ambacho ni kinyume cha misingi na kanuni za utawala bora huku kukiwa na harufu ya rushwa.

"Kuwepo kwa viashiria vya vitendo vya rushwa japo haikuweza kuthibitishwa," alikiri ufisadi katika ubomoaji huo ambao hata hivyo, alipobanwa alishindwa kufafanua waliohusika.

Alisema taratibu zinataka notisi ya ubomoaji wa nyumba za makazi uwe siku 30, lakini katika ubomoaji wa Tabata notisi ilitolewa Febrari 27 na utekelezaji ukaanza Februari 29, ikiwa ni siku mbili.

Alisema uamuzi wa serikali kulipa fidia hiyo, haukuzingatia kama wakazi hao wanaishi kihalali au haramu bali umetokana na kubaini ukiukwaji wa taratibu ambazo zilitokana na maafisa wake kushindwa kuzisimamia.

Waziri Wassira aliweka bayana msimamo wa serikali kwamba, malipo hayo hayahusiani na nyumba ambazo hazijabomolewa kwani wakazi hao hadi sasa wamefungua kesi Mahakama Kuu kupinga kuondolewa katika eneo hilo.

Hata hivyo, alitoa ushauri wa bure kwa wakazi hao kuachana na ujenzi katika eneo hilo badala yake watumie fedha hizo kujenga nyumba eneo la Buyuni ambalo serikali imewatengea ili kuepuka uwezako mwingine wa kupoteza mali iwapo Mahakama Kuu itaamuru waondoke.

Eneo la Tabata Dampo liko katika mvutano kati ya wananchi na Kampuni ya Allied Cargo, hali ambayo ilisababisha nyumba 88 kuvunjwa hapo Februari 29.

Hata hivyo, Mahakama Kuu haijatoa uamuzi wa kesi namba 18, 2008 kuhusu mgogoro huo.

Tayari baadhi ya watendaji wa Halmashauri ya Manispaa ya Ilala akiwemo aliyekuwa Mkurugenzi Mtendaji John Lubuva, wamesimamishwa kazi, huku serikali ikielezwa kutumia Sh 600,000 kila mwezi kwa ajili ya chakula cha watu hao.

Katika hatua nyingine, waathirika wa bomoa bomoa ya Tabata wamesema hawatachukua hundi wala kiwanja mpaka waonane na Waziri wa Nchi Ofisi ya Waziri Mkuu Tawala za Mikoa na Serikali za Mitaa (TAMISEMI) kwa kuwa hawana imani na matokeo ya tume yake.

Mwenyekiti wa Kamati ya Maafa, Said Masoud alisema jana kuwa msimamo wa waathiri hao ni kutochukua fidia yoyote mpaka serikali iseme malipo hayo ya Sh20milioni ni ya kitu gani.

Kimsingi sisi hatuchukui hela wala kiwanja mpaka Wassira atueleze ametulipa kitu gani. Kwanza malipo yenyewe ni kidogo na pia hayaelezi ni ya kitu gani,alisema Masoud akizungukwa na wakazi wengine wa eneo hilo waliokuwa katika mkutano kuhusiana na suala hilo.

Masoud alisema mbali na mapungufu mengine, tume aliyoiunda Waziri Wassira kuchunguza maafa hayo imepoteza uaminifu kwa kuficha ukweli kuhusu rushwa na imewadhalilisha kwa kuwaita wavamizi katika eneo hilo.

Alisema ni udhalilishaji kuwaita wavamizi kwani wamekuwapo katika eneo hilo tangu mwaka 1964 na serikali imewatambua kwa kuwapa hati za makazi kwa malipo halali yaliyofanywa kiofisi.

Sisi tumedhalilishwa kuitwa wavamizi, lakini pia ripoti imeshindwa kusema ukweli kwamba kulikuwa na rushwa katika zoezi zima hilo, rushwa ambayo sisi tumeiona katika hatua mbalimbali kabla ya zoezi lenyewe,alisema Masoud

Alitaja mapungufu mengine katika ripoti hiyo kuwa ni kutoweka bayana malipo ya Sh1.7 bilioni yanahusu fidia ya jambo gani wakati madai yanayoendana na mali iliyoharibiwa katika zoezi hilo ni Sh5.7bilioni.

Alisema mbali na fedha hiyo kutokidhi haja, bado kuna upungufu wa wapangaji walioharibiwa mali zao katika bomoa bomoa kutolipwa chochote wakati nao ni waathirika.

Masoud alimwomba Rais Jakaya Kikwete kuingilia kati suala hilo na kuunda tume nyingine huru zaidi kama alivyofanya katika matukio mengine ya kitaifa ili kubaini ukweli na kuhakikisha haki inatendeka kwa waathirika wote.

Kuanzia leo tunakutana na kutafuta namna ya kuwapata viongozi hao wa serikali lakini ni vema rais akaunde tume nyingine ili kubaini ukweli kuhusu tukio hilo kwani matokeo ya tume ya Wassira hayana ukweli.

SERIKALI imesema kutokana na ukiukwaji wa sheria, kanuni na taratibu za ubomoaji wa makazi uliofanywa na Manispaa ya Ilala katika eneo la Tabata Dampo, Dar es Salaam, imeamua kulipa fidia ya Sh milioni 20 kwa wote ambao nyumba zao zimebomolewa.

Imesema tayari kuna baadhi ya maofisa na watendaji wa manispaa hiyo ambao wamesimamishwa kazi na uchunguzi unaendelea ili hatua za kisheria zichukuliwe dhidi yao uko chini ya mamlaka husika, kwa mujibu wa Sheria Namba Nane ya Utumishi wa Umma ya mwaka 1982.

Hata hivyo, Mwenyekiti wa Waathirika wa Ubomolewaji wa Nyumba katika eneo hilo, Said Masoud, alidai hawatopokea fedha hizo kwa kuwa hawafahamu kigezo kilichotumika hadi kufikia kila muathirika wa nyumba kulipwa Sh milioni 20 wakati viwango na thamani za nyumba zinatofautiana.

Akizungumza na waandishi wa habari Dar es Salaam jana, Waziri wa Nchi, Ofisi ya Waziri Mkuu, Tawala za Mikoa na Serikali za Mitaa, Stephen Wassira, alisema pamoja na fidia hiyo, pia waathirika hao ambao orodha ya majina yao ipo, watapatiwa viwanja vya bure katika eneo la Buyuni Chanika.

"Wajibu wa Serikali ni kulinda haki za raia hasa jambo kama hili ambalo tena limefanywa na maofisa wake linapotokea, ila nataka mjue hatuchukui hatua hii ya kulipa fidia kwa vile wakazi hawa wamebomolewa nyumba zao, la hasha, ila kwa sababu hatua na sheria hazikufuatwa," alisema Wassira.

Alisema kwa mujibu wa Tume ya uchunguzi wa ubomoaji huo iliyoundwa Machi 13, mwaka huu, ubomoaji huo haukuzingatia sheria, kanuni na taratibu za ubomoaji ambazo ilitakiwa kabla ya wakazi hao kubomolewa, wangepatiwa notisi ya siku 30.

Alisema kwa mujibu wa Tume hiyo iligundulika kuwa nyumba hizo 88 zilibomolewa Februari 29, mwaka huu, siku mbili baada ya Mahakama ya Ardhi kutoa uamuzi kuwa eneo hilo mmiliki wake ni Allied Cargo Freighters Ltd bila kutoa notisi kwa wakazi hao; jambo ambalo ni kinyume cha sheria.

Wassira alisema kutokana na kukiukwa kwa kanuni na taratibu husika za ubomoaji, ubomoaji huo uliwanyanyasa na kuwatesa wananchi kisaikolojia na alizitaka halmashauri hasa za miji kuhakikisha kuwa zinakataaa ukiukwaji wa kanuni na sheria zilizopo.

Alikiri kuwapo kwa watu waliosimamishwa kazi baada ya taarifa hiyo ambao watawasilishwa katika mamlaka zao husika na wengine wanaohisiwa kuhusika na rushwa, watakabidhiwa kwa Taasisi ya Kuzuia na Kupambana na Rushwa (Takukuru).

Akizungumzia suala la yeye kutakiwa kujiuzulu kuhusiana na sakata hilo la wakazi wa Tabata Dampo kubomolewa nyumba zao, Wassira alisema hahusiki na wala hakutoa amri yoyote ya kubomolewa kwa nyumba hizo hivyo hana hatia na hatojiuzulu.

Naye Mkuu wa Mkoa wa Dar es Salaam, Abbas Kandoro, alisema kwa mujibu wa sheria zilizopo hasa Sheria Namba Nane ya Utumishi wa Umma, si rahisi kwa Waziri kutamka kumfukuza kazi mtumishi wa manispaa ingawa anaruhusiwa kumchunguza.

Akizungumzia suala hilo, Mwenyekiti wa Waathirika wa Ubomolewaji wa Nyumba katika eneo hilo, Said Masoud, alidai hawatopokea fedha hizo kwa kuwa hawafahamu kigezo kilichotumika hadi kufikia kila muathirika wa nyumba kulipwa Sh milioni 20 wakati viwango na thamani za nyumba zinatofautiana.

"Hata hivyo, tangu awali tulishasema hatuna imani na Tume ilitumwa kuja kuchunguza huku, hivyo msimamo wetu hatukubaliani na hatupokei kiwango hicho, na ieleweke kuwa sisi si wavamizi tuko hapa kwa amri ya Mahakama Kuu tangu mwaka 2003 mvamizi ni huyo mtu wao," alidai Masoud.

Demolition saga: Govt offers Sh20m for each house

At last the government has bowed to Tabata Dampo residents whose houses were demolished, pledging to pay compensation amounting to 1.7 billion shillings for the 88 families left homeless last month.

The move means that each family will pocket about Sh20 million, on the basis of a decision announced by the Minister for Regional Administration and Local Governments in the Prime Minister's Office, Mr Stephen Wasira at press conference in his office yesterday.

In a three page summarized report, the government said it was sad about the eviction exercise, noting that the compensation will be paid on account of the gross inconvenience the demolition victims suffered.

He said their suffering was caused by government officials who failed to abide to the governing regulations on the issue, and simply abused of their authority to conduct the demolition exercise.

The minister said the officials have dearly cost the government as compensation funds to enable the residents resettle, "for simply failing to understand that the demolition had to wait until 30 days notice has been served or seven days if the houses weren't occupied."

�Because of this gross negligence made by its own staff, the government is really sorry and is ready to pay all the costs as compensation for losses and psychological torture the residents suffered,� he stated.

He said that Ilala municipal officials are to blame for taking their own decision to carry out the demolition while it knew that there was a court ruling that ordered the same municipal authorities to respect regulations and legal procedure and not impose its own ruling on the houses.

"But surprisingly the officials acted contrary to the ruling and to municipal procedures governing demolition exercises," the minister noted.


He said in this case the government abused general human rights and specific civic rights of the residents. The probe report on the incident raises suspicion on the possibility of corruption in the whole saga, he equally affirmed.

It was difficult to discover the occurrence of corruption beyond reasonable doubt, but the government has ordered the Prevention and Combating of Corruption Bureau (PCCB) to investigate and come out with clear findings, he elaborated.

Minister Wasira said the government had played its part following the scandal by holding its officials accountable whereby the Ilala municipal director, the engineer and the legal officer are already out of office.

Other officials connected to the scandal will be identified thorough investigation, he stated. He urged local government authorities to respect the rule of law and act carefully whenever any decisions that touch people and their properties like demolition of houses arise.

He said the Ilala Municipal Council will be required to act on the report and take disciplinary action on some councilors suspected to have led the exercise, in full compliance with council procedures on such abuses.

�Do you want me to suggest a punishment to the municipal mayor? No, I can�t do that but I believe the council will do something on the matter, using its procedures.

But on my side I am innocent,� he said. On the compensation rate the minister said the government arrived at the figure following a survey to value the houses.

He said most of the houses had a small value estimated at two million and four million shillings, "so the government's offer should be taken as the highest possible compensation rate."

The residents recently estimated that total value of the houses and other properties were at cost of 5.7 billion shillings. They wanted the government to pay them basing on current building costs and inflation rates. The estimated quotation was submitted to the State House, and to the Regional Commissioner�s offices where they said they were received.

Minister Wasira said the government maintains that the residents shift from Tabata Dampo area and go to Buyuni area where new plots had been secured for them.

He said they will be given the plots free of charge. He said when one calculates the value of the plots and the amounts the government has decided to pay as compensation, it was obvious that the government has been quite generous.

�Had it been that these officials followed the legal procedures before demolishing the houses, the government wouldn�t pay the compensation, so the payments will be purely for those who lost houses," he said.

But in what can be seen as confusion for the victims, the government said it was not sure when it will pay the money. Minister Wasira said the victims will have to wait until the money is sourced, as "the government never moves with money."

�You ask when they will be paid, I say they will be paid so long the government has committed itself to pay, but don�t ask when because the government never moves with money,� he said, looking a bit furious.

Responding to reporters who asked him why he didn�t resign following the demolition, Regional Commissioner Abbas Kandoro said normally his office or the District Commissioner aren't tasked with controlling the various decisions reached by councilors in the municipal councils.

He said existing procedures provides that the RC or DC may intervene if they doubt the implementation of decisions reached by councilors.

Therefore neither he RC's office nor the DC had any doubt until the demolition took place at Tabata Dampo.

Recently, Ilala District Commissioner Patrick Tsere told the Citizen that there is a communication gap between his office and that of the municipal mayor. He said ordinarily there is disquiet among councilors about some issues decided in the council.

On February 29, a battalion of about 100 city militia invaded the Tabata Mandela 52 plot and demolished 88 houses leaving more than 500 people homeless and displaced. The demolition exercise was led by Ilala deputy mayor Mohamed Yakoub who told The Citizen later that he did so to make sure the demolition exercise was done smoothly and peacefully.

He said under municipal procedure it was normal for either him or the mayor to supervise such exercises to the end.

He said he had supervised similar exercises in other municipal areas before. �Yes, I was there to make sure the ruling of the court is respected and that the exercise is done according to the governing law.

I am a custodian of the law in the municipality and I remind the residents residing in unsurveyed areas and valleys to move and obey various orders requiring them to vacate,� said the defiant deputy mayor to The Citizen a few days after the Tabata demolitions.

On March 28, a special meeting called at Ilala municipal offices to discuss the involvement of the deputy mayor in the demolitions was called off and no communication was given when it would be called again.

The mayor said apologetically in an interview that he did not know what happened until the deputy mayor decided to officiate the demolition exercise.

"I think he was misled, as he was to check with me first. Come 28th we will be having a strong meeting on that issue,� he had been quoted, even inviting The Citizen to attend the then cancelled meeting. ends
