Habari Waheshimiwa,

Naomba kuuliza kama ni lazima kwa sheria za kazi Tanzania kwa employer kukupa a written employment contract unapoanza kazi. Na kama ni lazima, na employer akigoma/anazengua...how should i handle this issue - hasa kama kazi inaendelea vizuri?

Employment contract ni haki ya kila mfanyakazi, mara nyingi baadhi ya employers huwa hawatoi contracts kwa watu ambao wana watreat kama vibarua, so in such cases huwa wanawapa mikataba midogo ya kipindi kisichozidi miezi 3, na baada ya hiyo huwapumzisha na kuwaita tena kwa mkataba mwingine mdogo. Kwa jinsi hiyo wanakuwa wameepuka kuwalipa stahili kama NSSF nk.
Kwa case yako nadhani unahitaji kuzungumza nae tu, pengine hajui kuandaa huo mkataba na anahitaji msaada, kuna watu wanaanzisha mashirika na unapata vitu kama hivyo vinahitaji mchakato na hivyo kuchukua muda mrefu. Otherwise kama wafanyakazi wengine wana mikataba, na wewe peke yako ndiye huna, inabidi umtafute mwanasheria akushauri cha kufanya.

shukrani...but just to ask further...katika nchi nyingine mwajiri asipokupa contract, sheria ina-treat kama verbal contract, na kukupa zile minimal rights katika sheria kwa mfano annual leave payments,nk. Je hii nayo ni sahihi kwa Tanzania?

Ukiwa kazini kwa zaidi ya miezi mitatu sheria inakutambua kama mfanyakazi na unastahili zote hata kama huna barua ya kuajiriwa

Thats not a bullshit at the end of the day you have to know it will cost you/job and benefit the others.
In meantime read this section 14. from The Employment and labour Realtions Act 2004.

Contracts

with employees
types

(a) a contract for an unspecified period of time;
(b) a contract for a specified period of time for professionals and
managerial cadre,
(c) a contract for a specific task.
(2) A contract with an employee shall be in writing if the contract
provides that the employee is to work outside the United Republic of
Tanzania.
 
nyinyi mnaodai kukaa kimya na kutodai mkataba eti kuogopa kufukuzwa kazi ndio mnaowapa hao waajiri jeuri ya kunyanyasa wafanyakazi.

Hakuna mwajiri unayewzeza kumshinda mahakani kama yupo ni 2 ama kuna mkono wa baadhi ya maafisa ofisini kwako waliko nyuma yako wanaokderwa na virtuko hivyo ama utatumia fedha,rasilimali na muda mwingi sana kudai haki.

Kimsingi kama mko kwenye goodtems, endelea kudai kwa namna ambayo haitam anoy. Ila ni haki yako kwa lengo la kumbux2

asante kwa hiyo section. nimeipitia...lakini naona haina meno. Ukisoma s15 inafumbua zaidi na inatumia neno ‘shall' lakini pia bado haina meno. Ni mzunguko tu!!

lets be serious...kwani nchi zilizoendelea zilipitia njia gani? Sheria zinatungwa kwenye hewa au vipi? Hizi nchi zote zimepitia huku na ndio maana wakatunga hizi sheria za kazi. I have dealt with a number of people in the developed world who had employment issues. In simple terms, we are all dealing with the same problems. Tofauti ni wao wanashughulikia haya matatizo na sisi tunasema haiwezekani!

Kwani mlikubalianaje kabla hujaanza kazi....
Mfano atakulipa mshahara = 1000
PPF/NSSF= 20
Matibabu = 5
kama hukatwi NSSF/PPF anagalia ukakakosa haki zako lakini kama anakupa malipo kama hayo maana yake uko kwenye Payroll chukua salary slip mpelekee mwana sheria lakini kama una pewa cash kuwa makini anaweza kukugeuka...
Vile vile kuna wakati mikataba utaihitaji mfano ukiacha kazi ili uweze kupata PPF/NSSF huwa wana hitaji barua ya kuajiriwa,salary slip nk
 
Pia ni vyema mkagundua kuwa kwa sasa sheria imefuta casual labourers nowadays wanaitwa temporary employees. NSSF ni lazima kwa kila mfanyakazi hata wa ndani as per the GN no.421 of 1998. Inabidi muwe makini katika kuangalia marekebisho mapya ya sheria
