The CAG said the contract extension process was in breach of Section 69 (1) of the Public Procurement Act of 2004, which states that a procurement contract shall not be altered or amended in any way after it has been signed by both parties, unless such alteration or amendment is to benefit the government or is not disadvantageous to the government.

Ikumbukwe kwamba kamati hiyo ilitembelea kampuni hiyo mwezi February mwaka huu,jamani hii ni 2008,walichokikuta ni kwamba kampuni hiyo ilikutwa tayari inamkataba mwingine wa miaka 15 on top of ten years ambao haujamalizika.Kwa maana nyingine ni kwamba kabla ya miaka miwili ya kuisha kwa mkataba wa awali tayari mkataba mwingine unaongezwa,kwa TZ linawezekana na limewezekana tayari lakini kwa mataifa yaliyo makini na viongozi wapo kwa maslahi ya mataifa yao hili haliwezekani.

Kamati hiyo ilihoji ni kwa niniserikali haikungoja mpaka mkataba wa awali umalizike mwaka 2010 na kuongeza miaka mingine 15 wakati ule wa mwanzo ukiwa katikati?

Hata hivyo,spika wabunge,Mzee Six,aliitaka serrikali ijipange vizuri kwa vile inaonekana majibu hayajitoshelezi na wabunge bado wanayo kiu juu ya mkataba huo.

Legislators who were planning to table a private motion against the renewal of the embattled Tanzania International Containers Terminal Services (Ticts) contract have suspended their move under unclear circumstances.

But a reliable source within Ticts told The Citizen that the troubled firm had sought audience with the lawmakers to 'explain the real situation on the ground' that was resulting in persistent congestion at the Dar es Salaam port.

According to the source, Ticts management organised a marathon seminar to narrate the story 'from their own perspective'.

"All the MPs who had planned to table the motion had one-sided information, but after giving them the inside information on the real situation they decided to withdraw their motion," said a senior Ticts official, preferring anonymity.

Parliament had been expected to debate the Ticts issue, with some MPs demanding that the contract be terminated immediately since the company had no capacity to handle the increasing volumes of containers at the port.

Ticts officials have, however, defended their company saying the number of containers exported and imported through the Dar port was currently bigger than the available infrastructure, which had nothing to do with the company.

According to Ticts, the port was originally designed to handle only 250,000 twenty-foot equivalent unit containers per year, but the number is now fast approaching 400,000.

By the end of last year, the port recorded a total of 343,000 containers, surpassing its handling capacity by 37 percent, according to statistics released by Ticts on Friday.

And the company projects that in 2010, the total number of containers handled by Dar port would reach 525,000, two times its yearly capacity.

The port is currently reeling in deep congestion problems resulting partly from increased cargo over the last few years. The great lakes region, which is mostly served by the Dar port, has of late been experiencing relatively high economic growth and political stability, two factors that have seen increased cargo.

Analysts also say the rising foreign direct investment (FDI) flow in minerals- rich DR Congo and the booming copper production in Zambia are among the factors behind the rising volume of containers.

This year alone, for instance, Zambia has said it would export about 1million tonnes of copper through the Dar port.

Other landlocked countries like Malawi, Rwanda, Burundi, and Uganda have also lately opted using the strategically located Dar port, instead of Beira, Durban and Mombassa ports, due its modern equipment.

Ticts officials say the port has become a viable location to facilitate booming regional transshipment traffic, which has grown by 2500 percent to 56,249 from only 2,194.

However, despite these factors, stakeholders believe Ticts is largely to blame for the congestion. And a few days ago some MPs said they wanted its contract terminated.

Some people have also blamed port officials for delaying clearing processes through poor documentation of import and export declaration forms.

Others say congestion is worsened by the poor road infrastructure used to transport the containers to their respective destinations.

TICTS opts for workshop to discuss customers` queries

The Tanzania International Container Terminal Services (TICTS) has been making efforts to reduce congestion of containers at Dar es Salaam port, according to the firm`s commercial manager Jay New.

During a presentation by Terminal Manager Cassian N`gamilo, New, pointed out a number of improvements to customer service when responding to various queries and suggestions from customers and container handling stakeholders at a one-day workshop organised by his company in Dar es Salaam.

TICTS had invited a group of compliant traders to inform them on container handling operations with particular reference to delays caused to customers`containers as a result of congestion at the port.

Representatives of Tanzania Revenue Authority as well as TISCAN (which carries out inspections on containerised cargo) were also present at the workshop.

New also discussed other time-saving measures that TICTS would consider in order to ``fast track`` containers, which had already complied with other regulatory processes, which are the responsibility of other port stakeholders such as TRA and TISCAN.

``Dwell time, that is the time a container stays in the terminal awaiting clearance, is one of the most important factors causing the congestion presently experienced at Dar es Salaam port.`` had explained.

Earlier, N`gamilo had explained: ``Long dwell time add to the constraints resulting from the limited space in which we have to work the ships as well as maneuver and stack the containers``.

He also emphasised the work of the special operations committee recently appointed by the Permanent Secretary in the Infrastucture Development ministry, describing how TICTS was seeking ways to reduce congestion in co-operation with the other port stakeholders, including TRA and TISCAN.

In a gathering where traders and other stakeholders were also present there was a lively interchange with several saying that TICTS had taken the initiative of calling them all together.

Some of the suggestions from the traders included doing away with the present post-lodgment of documents at TISCAN, saying it greatly contributed to delays in clearance of cargo.

However, TISCAN\'s head of Risk Management, John Ogonji told the gathering that his firm, in it`s contribution to helping decongest the port now, accepts pre-lodgment of documents.

Other customers reported that the physical examination of goods done at the port by TRA was a major cause of delay in releasing their containers.

This was countered by an official from TRA who said that his authority doesn`t conduct any examination at port for compliant traders adding that any such incident should be reported immediately.

The poor condition of the access roads to the port was severely criticised as well as routes and border posts connecting the neighbouring countries especially at the borders of Zambia, DRC and Malawi.

TICTS contract extension: Govt reverses Mkapa order

As Karamagi is elbowed out of company chairmanship

The government is now moving to cancel the dubious 15-year extension of the contract of the Tanzania International Container Terminal Services (TICTS) at the Dar es Salaam port, which was granted by former president Benjamin Mkapa in controversial circumstances in 2005.

At the same time, former Cabinet minister Nazir Karamagi has been elbowed out as a shareholder of TICTS, in what is described as an attempt to clear the battered image of the company currently leasing the port’s lucrative container terminal.

The twin developments were confirmed by well-placed sources yesterday.

It has been revealed that the Attorney General’s chambers has already sent a formal notice of intention to cancel the contract extension to Hong Kong’s Hutchinson Port Holdings (HPH), which owns a 70 per cent stake in TICTS.

With this move which effectively reverses that of ex-president Mkapa, the current TICTS lease agreement at the Dar es Salaam port will expire in 2010 as initially agreed, and not 2025 as dubiously extended by Mkapa.

The Attorney General, Johnson Mwanyika, was not immediately available yesterday to comment on the process set in motion to cancel the deal, which was endorsed by the National Assembly last month following the tabling of a private member’s motion by Mbozi East member of parliament Godfrey Zambi (CCM).

Zambi’s motion recommended that the original 10-year TICTS contract be allowed to run its course until its natural expiry in two years’ time, after which the company’s overall performance be properly evaluated before any decision to renew the contract is made.

In the meantime, our sources say the pressure to remove Karamagi from the TICTS chairmanship and shareholders list came from Hong Kong’s Hutchinson Port Holdings (HPH), which owns a 70 per cent stake in TICTS.

The remaining 30 per cent of shares in the company are owned by Karamagi and some other high-profile local businessmen.

’’He has been under pressure to step down as TICTS chairman ever since it became clearly evident that his presence was not doing the company any favours, but instead casting it in a poor light,’’ a source said.

The scandal-prone Karamagi was forced to resign as energy and minerals minister earlier this year after being implicated in the Richmond power generation contract scandal.

It is believed that a senior executive from Hutchinson�s headquarters in Hong Kong will likely replace Karamagi as company chairman.

According to the sources, TICTS chief executive officer David Cotty is also in line to be replaced in the coming few weeks, as part of major changes within the company.

’’Cotty will be leaving the country in July this year, and is to replaced by a new CEO who comes from Hutchinson’s Egypt operations,’’ said a source.

Sources say TICTS is planning to announce the new changes in company ownership and management at a news conference in Dar es Salaam today.

With the company being at the centre of an ongoing containers congestion crisis at the port of Dar es Salaam, the circumstances behind the contract extension granted by ex-president Mkapa in 2005 � just halfway through the original 10-year lease � has come under heavy scrutiny and criticism in recent months.

Earlier investigations by THISDAY established that the company was officially registered on April 19, 2000, and in September of the same year (barely five months later) was awarded the original 10-year contract to lease the container terminal - one of the most profitable units under the then Tanzania Harbours Authority (now Tanzania Ports Authority).

Then came the 15-year extension granted by Mkapa, which was declared illegal by the Controller and Auditor General, Ludovick Utuoh, in his latest government audit report.

A scrutiny by the CAG revealed that there was gross violation of the Public Procurement Act (PPA) of 2004 in the whole process of extending the TICTS lease contract.
